SYNOPSIS AS INTRODUCED:
 
20 ILCS 3105/12  from Ch. 127, par. 782

    Amends the Capital Development Board Act. Provides that for any capital construction project approved for a public university, the university shall have the option of employing the services of the Capital Development Board or utilizing its own available internal services, including without limitation architectural, contractual, procurement, engineering, project oversight, and other related services. Provides that, prior to utilizing its own internal services, the university shall demonstrate its ability to manage the project, pursuant to State laws and rules, through an application and approval process developed by the Board, in cooperation with university personnel, and adopted by Board rule. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Capital Development Board Act is amended by
5changing Section 12 as follows:
 
6    (20 ILCS 3105/12)  (from Ch. 127, par. 782)
7    Sec. 12. Nothing in this Act shall be construed to include
8the power to abrogate those powers vested in the boards of the
9local public community college districts and the Illinois
10Community College Board by the Public Community College Act,
11the Board of Trustees of the University of Illinois, The Board
12of Trustees of Southern Illinois University, the Board of
13Trustees of Chicago State University, the Board of Trustees of
14Eastern Illinois University, the Board of Trustees of Governors
15State University, the Board of Trustees of Illinois State
16University, the Board of Trustees of Northeastern Illinois
17University, the Board of Trustees of Northern Illinois
18University, and the Board of Trustees of Western Illinois
19University, hereinafter referred to as Governing Boards. In the
20exercise of the powers conferred by law upon the Board and in
21the exercise of the powers vested in such Governing Boards, it
22is hereby provided that (i) the Board and any such Governing
23Board may contract with each other and other parties as to the

1design and construction of any project to be constructed for or
2upon the property of such Governing Board or any institution
3under its jurisdiction; (ii) in connection with any such
4project, compliance with the provisions of the Illinois
5Purchasing Act by either the Board or such Governing Board
6shall be deemed to be compliance by the other; (iii) funds
7appropriated to any such Governing Board may be expended for
8any project constructed by the Board for such Governing Board;
9(iv) in connection with any such project the architects and
10engineers retained for the project and the plans and
11specifications for the project must be approved by both the
12Governing Board and the Board before undertaking either design
13or construction of the project, as the case may be.
14    For any capital construction project approved for a public
15university, the university shall have the option of employing
16the services of the Board or utilizing its own available
17internal services, including without limitation architectural,
18contractual, procurement, engineering, project oversight, and
19other related services. Prior to utilizing its own internal
20services, the university shall demonstrate its ability to
21manage the project, pursuant to State laws and rules, through
22an application and approval process developed by the Board, in
23cooperation with university personnel, and adopted by Board
24rule.
