105 ILCS 5/3-2.5

    Amends the School Code. Prohibits the salary of the regional superintendent of schools and any assistant regional superintendent or other employee of the regional office of education from being enhanced for administering a grant program with the use of money from the grant or other funds.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
53-2.5 as follows:
 
6    (105 ILCS 5/3-2.5)
7    Sec. 3-2.5. Salaries.
8    (a) Except as otherwise provided in this Section, the
9regional superintendents of schools shall receive for their
10services an annual salary according to the population, as
11determined by the last preceding federal census, of the region
12they serve, as set out in the following schedule:

16    Less than 48,000                     $73,500
17    48,000 to 99,999                     $78,000
18    100,000 to 999,999                   $81,500

20    The changes made by Public Act 86-98 in the annual salary
21that the regional superintendents of schools shall receive for
22their services shall apply to the annual salary received by the
23regional superintendents of schools during each of their

1elected terms of office that commence after July 26, 1989 and
2before the first Monday of August, 1995.
3    The changes made by Public Act 89-225 in the annual salary
4that regional superintendents of schools shall receive for
5their services shall apply to the annual salary received by the
6regional superintendents of schools during their elected terms
7of office that commence after August 4, 1995 and end on August
81, 1999.
9    The changes made by this amendatory Act of the 91st General
10Assembly in the annual salary that the regional superintendents
11of schools shall receive for their services shall apply to the
12annual salary received by the regional superintendents of
13schools during each of their elected terms of office that
14commence on or after August 2, 1999.
15    Beginning July 1, 2000, the salary that the regional
16superintendent of schools receives for his or her services
17shall be adjusted annually to reflect the percentage increase,
18if any, in the most recent Consumer Price Index, as defined and
19officially reported by the United States Department of Labor,
20Bureau of Labor Statistics, except that no annual increment may
21exceed 2.9%. If the percentage of change in the Consumer Price
22Index is a percentage decrease, the salary that the regional
23superintendent of schools receives shall not be adjusted for
24that year.
25    When regional superintendents are authorized by the School
26Code to appoint assistant regional superintendents, the

1assistant regional superintendent shall receive an annual
2salary based on his or her qualifications and computed as a
3percentage of the salary of the regional superintendent to whom
4he or she is assistant, as set out in the following schedule:

19    However, in any region in which the appointment of more
20than one assistant regional superintendent is authorized,
21whether by Section 3-15.10 of this Code or otherwise, not more
22than one assistant may be compensated at the 90% rate and any
23other assistant shall be paid at not exceeding the 75% rate, in
24each case depending on the qualifications of the assistant.
25    The salaries provided in this Section plus an amount for
26other employment-related compensation or benefits for regional

1superintendents and assistant regional superintendents are
2payable monthly by the State Board of Education out of the
3Personal Property Tax Replacement Fund through a specific
4appropriation to that effect in the State Board of Education
5budget for the fiscal year 2012 only, and are payable monthly
6from the Common School Fund for fiscal year 2013 and beyond
7through a specific appropriation to that effect in the State
8Board of Education budget. The State Comptroller in making his
9or her warrant to any county for the amount due it from the
10Personal Property Tax Replacement Fund for the fiscal year 2012
11only, and from the Common School Fund for fiscal year 2013 and
12beyond shall deduct from it the several amounts for which
13warrants have been issued to the regional superintendent, and
14any assistant regional superintendent, of the educational
15service region encompassing the county since the preceding
16apportionment from the Personal Property Tax Replacement Fund
17for the fiscal year 2012 only, and from the Common School Fund
18for fiscal year 2013 and beyond.
19    County boards may provide for additional compensation for
20the regional superintendent or the assistant regional
21superintendents, or for each of them, to be paid quarterly from
22the county treasury.
23    Notwithstanding any other provision of law to the contrary,
24the salary of the regional superintendent of schools and any
25assistant regional superintendent or other employee of the
26regional office of education must not be enhanced for

1administering a grant program with the use of money from the
2grant or other funds.
3    (b) Upon abolition of the office of regional superintendent
4of schools in educational service regions containing 2,000,000
5or more inhabitants as provided in Section 3-0.01 of this Code,
6the funds provided under subsection (a) of this Section shall
7continue to be appropriated and reallocated, as provided for
8pursuant to subsection (b) of Section 3-0.01 of this Code, to
9the educational service centers established pursuant to
10Section 2-3.62 of this Code for an educational service region
11containing 2,000,000 or more inhabitants.
12    (c) If the State pays all or any portion of the employee
13contributions required under Section 16-152 of the Illinois
14Pension Code for employees of the State Board of Education, it
15shall also, subject to appropriation in the State Board of
16Education budget for such payments to Regional Superintendents
17and Assistant Regional Superintendents, pay the employee
18contributions required of regional superintendents of schools
19and assistant regional superintendents of schools on the same
20basis, but excluding any contributions based on compensation
21that is paid by the county rather than the State.
22    This subsection (c) applies to contributions based on
23payments of salary earned after the effective date of this
24amendatory Act of the 91st General Assembly, except that in the
25case of an elected regional superintendent of schools, this
26subsection does not apply to contributions based on payments of

1salary earned during a term of office that commenced before the
2effective date of this amendatory Act.
