SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/8A-18 new

    Amends the Public Assistance Fraud Article of the Illinois Public Aid Code. Provides that the Department of Human Services or the Department of Healthcare and Family Services shall provide a monetary award to any person who furnishes information that leads to the recovery of State or federal monies that represent benefits improperly and erroneously paid by the Department as a result of a fraudulent action. Provides that no money shall be awarded to a person who willfully participated in the reported fraudulent action or who knowingly received any amount paid for benefits obtained as a result of the reported fraudulent action. Provides that in determining the award amount, the Department shall assess the value of the information furnished by the person and award between 15% and 25% of the recovered amount.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 8A-18 as follows:
 
6    (305 ILCS 5/8A-18 new)
7    Sec. 8A-18. Monetary award for reporters of public
8assistance fraud. The Department shall provide a monetary award
9to any person who furnishes information that leads to the
10recovery of State or federal monies that represent benefits
11improperly and erroneously paid by the Department as a result
12of a fraudulent action. No money shall be awarded to a person
13who willfully participated in the reported fraudulent action or
14who knowingly received any amount paid for benefits obtained as
15a result of the reported fraudulent action. In determining the
16award amount, the Department shall assess the value of the
17information furnished by the person and award between 15% and
1825% of the recovered amount.
