SYNOPSIS AS INTRODUCED:
 
20 ILCS 1605/15  from Ch. 120, par. 1165

    Amends the Illinois Lottery Law. Provides that a licensed retail sales agent must obtain adequate written evidence of the age and identity of a person before that licensed retail sales agent solicits that person for the sale of lottery tickets or shares. Provides that a violation of this requirement shall be grounds for suspension or revocation of a license under the Act.

1    AN ACT concerning the Lottery.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Section 15 as follows:
 
6    (20 ILCS 1605/15)  (from Ch. 120, par. 1165)
7    Sec. 15. Minimum age for purchase; criminal penalty;
8solicitation.
9    (a) No minor under 18 years of age shall buy a lottery
10ticket or share. No person shall sell, distribute samples of,
11or furnish a lottery ticket or share to any minor under 18
12years of age, buy a lottery ticket or share for any minor under
1318 years of age, or aid and abet in the purchase of lottery
14tickets or shares by a minor under 18 years of age.
15    No ticket or share shall be purchased by, and no prize
16shall be paid to any of the following persons: any member of
17the Board or any officer or other person employed by the Board
18or by the Department; any spouse, child, brother, sister or
19parent residing as a member of the same household in the
20principal place of abode of any such persons; or any minor
21under 18 years of age.
22    Any violation of this subsection (a) Section by a person
23other than the purchasing minor shall be a Class B misdemeanor;

1provided, that if any violation of this subsection (a) Section
2is a subsequent violation, the offender shall be guilty of a
3Class 4 felony. Notwithstanding any provision to the contrary,
4a violation of this subsection (a) Section by a minor under 18
5years of age shall be a petty offense.
6    (b) A licensed retail sales agent must obtain adequate
7written evidence of the age and identity of a person before
8that licensed retail sales agent solicits that person for the
9sale of lottery tickets or shares. A violation of this
10subsection (b) shall be grounds for suspension or revocation of
11a license under this Act.
12    For the purpose of this Section, "adequate written evidence
13of the age and identity of the person" means a document issued
14by a federal, state, county, or municipal government, or
15subdivision or agency thereof, including, but not limited to, a
16motor vehicle operator's license, a registration certificate
17issued under the Federal Selective Service Act, or an
18identification card issued to a member of the Armed Forces.
