HOUSE RESOLUTION

 
2    WHEREAS, According to the Des Plaines, Illinois-based
3National Insurance Crime Bureau (NICB), during the past 3
4years, there has been a significant increase in insurance
5fraud, specifically in Illinois, staged motor vehicle
6accidents, false claims of bodily injury, and medical provider
7fraud; and
 
8    WHEREAS, Illinois ranks fifth nationally in submitted
9questionable claims related to bodily injury; and
 
10    WHEREAS, Illinois has adequate insurance fraud laws,
11especially in relation to immunity for reporting and sharing
12information; and
 
13    WHEREAS, Illinois has strong criminal penalties for
14insurance fraud; and
 
15    WHEREAS, A fraud bureau exists to investigate workers'
16compensation fraud; and
 
17    WHEREAS, Illinois has a Motor Vehicle Theft Prevention
18Council, funded by a $1 charge per auto insurance policy, that
19helps combat vehicle theft and has contributed to a 60% decline
20in vehicle theft since 1991; and

1    WHEREAS, A bureau or other facility to investigate property
2and casualty and medical fraud does not exist; and
 
3    WHEREAS, The top recommendation arising from the 2008
4Illinois Insurance Fraud Summit held by the NICB was the need
5for a dedicated insurance fraud prosecutor; therefore, be it
 
6    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
7NINETY-SEVENTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
8there is created the Illinois Insurance Fraud Task Force; and
9be it further
 
10    RESOLVED, That the Task Force shall be composed of the
11following members: the Director of the Illinois Department of
12Insurance or his or her designee, the Director of the Illinois
13State Police or his or her designee, the Director of the
14Criminal Justice Information Authority or his or her designee;
15the Attorney General or his or her designee; the Cook County
16State's Attorney or his or her designee; the Superintendent of
17the Chicago Police Department or his or her designee; a local
18Police Chief designated by the Illinois Association of Chiefs
19of Police; a County Sheriff designated by the Illinois County
20Sheriff's Association; three property and casualty insurance
21companies designated by the Illinois Insurance Association;
22the President of the National Insurance Crime Bureau or his or

1her designee; the President of the Illinois Insurance
2Association or his or her designee; and the Governor of the
3State of Illinois or his or her designee; and be it further
 
4    RESOLVED, That at the first meeting of the Task Force a
5chairperson be selected from among its members; and be it
6further
 
7    RESOLVED, That the Illinois Insurance Fraud Task Force
8shall (i) investigate the issue of organized insurance fraud
9crime, especially as related to the rapidly escalating problem
10of medical fraud, (ii) examine methods to unite the collective
11resources of the insurance industry with appropriate
12components of federal, State, and local law enforcement
13agencies to pinpoint organized criminal schemes, and (iii)
14examine concepts for establishing a permanent and financially
15sustained public-private partnership to combat insurance fraud
16crimes with emphasis placed on the establishment of a dedicated
17investigative and prosecutorial focus on insurance fraud
18crimes; and be it further
 
19    RESOLVED, That the Illinois Insurance Fraud Task Force
20submit a report of its findings and recommendations to this
21body on or before August 30, 2013.
