SYNOPSIS AS INTRODUCED:
Amends the Code of Criminal Procedure of 1963. Makes a technical
change in a Section concerning lineup and photo spread procedure.

AN ACT concerning criminal law.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
The Code of Criminal Procedure of 1963 is
amended by changing Section 107A-5 as follows:
(725 ILCS 5/107A-5)
Lineup and photo spread procedure.
(a) All lineups
be photographed or otherwise
be disclosed to the accused
and his or her defense counsel during discovery
provided in Illinois Supreme Court Rules. All photographs
suspects shown to an eyewitness during the photo spread shall
disclosed to the accused and his or her defense counsel
proceedings as provided in Illinois Supreme
(b) Each eyewitness who views a lineup or photo spread
sign a form containing the following information:
(1) The suspect might not be in the lineup or photo
spread and the eyewitness is not obligated to make an
(2) The eyewitness should not assume that the person
administering the lineup or photo spread knows which
is the suspect in the case.
