1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-709.2 and by adding Section 11-709.4 as follows:
 
6    (625 ILCS 5/11-709.2)
7    Sec. 11-709.2. Bus on shoulder pilot program.
8    (a) For purposes of this Section, "bus on shoulders" is the
9use of specifically designated shoulders of roadways by
10authorized transit buses. The shoulders may be used by transit
11buses at times and locations as set by the Department in
12cooperation with the Regional Transportation Authority and the
13Suburban Bus Division of the Regional Transportation
14Authority.
15    (b) Commencing on the effective date of this amendatory Act
16of the 97th General Assembly, the Department along with the
17Regional Transportation Authority and Suburban Bus Division of
18the Regional Transportation Authority in cooperation with the
19Illinois State Police shall establish a 5-year pilot program
20within the boundaries of the Regional Transportation Authority
21for transit buses on highways and shoulders. The pilot program
22may be implemented on shoulders of highways as designated by
23the Department in cooperation with the Regional Transportation

1Authority and Suburban Bus Division of the Regional
2Transportation Authority and any affected local highway
3authorities. The Department may adopt rules necessary for
4approving, establishing, operating, evaluating, and reporting
5on the pilot program for transit buses to use roadway
6shoulders.
7    (c) After the pilot program established under subsection
8(b) of this Section has been operating for 2 years, the
9Department in cooperation with the Regional Transit Authority,
10the Suburban Bus Division of the Regional Transportation
11Authority, and the Illinois State Police shall issue a report
12to the General Assembly on the effectiveness of the bus on
13shoulders pilot program.

16    Sec. 11-709.4. Randall Road bus on shoulder pilot program.
17    (a) One year after the effective date of this amendatory
18Act of the 97th General Assembly, the Department, along with
19the Regional Transportation Authority and Suburban Bus
20Division of the Regional Transportation Authority, in
21cooperation with the Kane County Division of Transportation,
22shall establish a 5-year pilot program on the Randall Road
23corridor in Kane County for transit buses. The Department may
24adopt rules for approving, establishing, operating,
25evaluating, and reporting on the pilot program for transit

1buses to use roadway shoulders.
2    (b) After the pilot program established under subsection
3(a) of this Section has been operating for 2 years, the
4Department, in cooperation with the Regional Transit
5Authority, the Suburban Bus Division of the Regional
6Transportation Authority, and the Kane County Division of
7Transportation, shall issue a report to the General Assembly on
8the effectiveness of the bus pilot program.
9     (c) The pilot program is subject to appropriation and
10approval by the Department, the Regional Transportation
11Authority, the Suburban Bus Division of the Regional
12Transportation Authority, and the Kane County Division of
13Transportation.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
