1    AN ACT concerning public utilities.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Public Utilities Act is amended by changing
5Section 20-120 as follows:
 
6    (220 ILCS 5/20-120)
7    Sec. 20-120. Residential and small commercial retail
8electric competition. Within 12 months after the effective date
9of this amendatory Act of the 94th General Assembly, the
10Director shall conduct research, gather input from all
11interested parties and develop and present to the Commission,
12the General Assembly, and the Governor a detailed plan designed
13to promote, in the most expeditious manner possible, retail
14electric competition for residential and small commercial
15electricity consumers while maintaining safe, reliable, and
16affordable service. Interested parties shall be given the
17opportunity to review the plan and provide written comments
18regarding the plan prior to its submission to the Commission,
19the General Assembly, and the Governor. Any written comments
20received by the Office shall be posted on the Commission's web
21site. The final plan submitted to the Commission, the General
22Assembly, and the Governor must include summaries of any
23written comments and must also be posted on the Commission's

1web site.
2    To the extent the plan calls for Commission action, the
3Commission shall initiate any proceeding or proceedings called
4for in the final plan within 60 days after receipt of the final
5plan and complete those proceedings within 11 months after
6their initiation.
7    Nothing in this Section shall prevent the Commission from
8acting earlier to remove identified barriers to retail electric
9competition for residential and small commercial consumers.
10    Beginning in 2013, the Office of Retail Market Development
11shall review the practices of door-to-door sales within both
12the electric and natural gas market, gather input from all
13interested parties, and present to the Commission, the General
14Assembly, and the Governor a plan to identify problems in
15door-to-door sales and recommend any possible solutions or
16improvements for either legislative action or rulemaking by the
17Commission.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.
