1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-335 as follows:
 
7    (20 ILCS 405/405-335)
8    Sec. 405-335. Illinois Transparency and Accountability
9Portal (ITAP).
10    (a) The Department, within 12 months after January 1, 2010
11the effective date of this amendatory Act of the 96th General
12Assembly, shall establish and maintain a website, known as the
13Illinois Transparency and Accountability Portal (ITAP), with a
14full-time webmaster tasked with compiling and updating the ITAP
15database with information received from all State agencies as
16defined in this Section. Subject to appropriation, the
17full-time webmaster must also compile and update the ITAP
18database with information received from all counties,
19townships, and municipalities.
20    (a-5) As soon as practical after this amendatory Act of the
2198th General Assembly, the Department must compile and update
22the ITAP database with information received under subsection
23(c-5) of this Section.

1    (b) For purposes of this Section:
2    "State agency" means the offices of the constitutional
3officers identified in Article V of the Illinois Constitution,
4executive agencies, and departments, boards, commissions, and
5Authorities under the Governor.
6    "Contracts" means payment obligations with vendors on file
7with the Office of the Comptroller to purchase goods and
8services exceeding $10,000 in value (or, in the case of
9professional or artistic services, exceeding $5,000 in value).
10    "Appropriation" means line-item detail of spending
11approved by the General Assembly and Governor, categorized by
12object of expenditure.
13    "Individual consultants" means temporary workers eligible
14to receive State benefits paid on a State payroll.
15    "Recipients" means State agencies receiving
16appropriations.
17    "Unit of local government" or "local government" includes,
18without limitation, counties, townships, municipalities,
19community college districts, school districts, special purpose
20districts, and any other unit of government with the power to
21levy taxes. "Unit of local government" or "local government"
22does not include a State agency as defined in this subsection.
23    (c) The ITAP shall provide direct access to each of the
24following:
25        (1) A database of all current State employees and
26    individual consultants, except sworn law enforcement

1    officers, sorted separately by:
2            (i) Name.
3            (ii) Employing State agency.
4            (iii) Employing State division.
5            (iv) Employment position title.
6            (v) Current pay rate and year-to-date pay.
7        (2) A database of all current State expenditures,
8    sorted separately by agency, category, recipient, and
9    Representative District.
10        (3) A database of all development assistance
11    reportable pursuant to the Corporate Accountability for
12    Tax Expenditures Act, sorted separately by tax credit
13    category, taxpayer, and Representative District.
14        (4) A database of all revocations and suspensions of
15    State occupation and use tax certificates of registration
16    and all revocations and suspensions of State professional
17    licenses, sorted separately by name, geographic location,
18    and certificate of registration number or license number,
19    as applicable. Professional license revocations and
20    suspensions shall be posted only if resulting from a
21    failure to pay taxes, license fees, or child support.
22        (5) A database of all current State contracts, sorted
23    separately by contractor name, awarding officer or agency,
24    contract value, and goods or services provided.
25        (6) A database of all employees hired after the
26    effective date of this amendatory Act of 2010, sorted

1    searchably by each of the following at the time of
2    employment:
3            (i) Name.
4            (ii) Employing State agency.
5            (iii) Employing State division.
6            (iv) Employment position title.
7            (v) Current pay rate and year-to-date pay.
8            (vi) County of employment location.
9            (vii) Rutan status.
10            (viii) Status of position as subject to collective
11        bargaining, subject to merit compensation, or exempt
12        under Section 4d of the Personnel Code.
13            (ix) Employment status as probationary, trainee,
14        intern, certified, or exempt from certification.
15            (x) Status as a military veteran.
16        (7) (Blank). A searchable database of all current
17    county, township, and municipal employees sorted
18    separately by:
19            (i) Employing unit of local government.
20            (ii) Employment position title.
21            (iii) Current pay rate and year-to-date pay.
22        (8) (Blank). A searchable database of all county,
23    township, and municipal employees hired on or after the
24    effective date of this amendatory Act of the 97th General
25    Assembly, sorted separately by each of the following at the
26    time of employment:

1            (i) Employing unit of local government.
2            (ii) Employment position title.
3            (iii) Current pay rate and year-to-date pay.
4    (c-5) The ITAP shall provide direct access to each of the
5following with respect to each unit of local government:
6        (1) a database of all current employees of the unit of
7    local government, except sworn law enforcement officers,
8    sorted separately by:
9            (i) Name.
10            (ii) Employing unit of local government.
11            (iii) Employment position title.
12            (iv) Current pay rate and year-to-date pay.
13        (2) All financial reports and audits required to be
14    filed by the unit of local government with a State agency
15    or another unit of local government, including, but not
16    limited to, reports and audits required to be filed with
17    the Comptroller under Section 8-8-3 of the Illinois
18    Municipal Code.
19        (3) All Tax Increment Financing Reports required to be
20    filed with the Comptroller under Section 8-8-3.5 of the
21    Illinois Municipal Code.
22        (4) The account of the municipal treasurer required
23    under Section 3.1-35-65 of the Illinois Municipal Code.
24        (5) The report of the police and firefighter pension
25    board that is required to be issued to a municipality under
26    Section 3-143 or 4-134 of the Illinois Pension Code.

1        (6) The report filed by the Illinois Municipal
2    Retirement Fund under Section 7-192 of the Illinois Pension
3    Code and each Governmental Accounting Standards Board
4    Pension Disclosure that the Fund provides to a unit of
5    local government.
6    (d) The ITAP shall include all information required to be
7published by subsections subsection (c) and (c-5) of this
8Section that is available to the Department in a format the
9Department can compile and publish on the ITAP. The Department
10shall update the ITAP as additional information becomes
11available in a format that can be compiled and published on the
12ITAP by the Department.
13    (e) Each State agency, county, township, and municipality,
14or other unit of local government shall cooperate with the
15Department in furnishing the information necessary for the
16implementation of this Section within a timeframe specified by
17the Department. The Department, however, may not require that
18any report, accounting, or other filing that is filed pursuant
19to a statute or other law be submitted at a different time or
20in a different manner or format than was used by the State
21agency or local government in creating the document.
22    (f) Each county, township, or municipality, or other unit
23of local government submitting information to be displayed on
24the Illinois Transparency and Accountability Portal (ITAP) is
25responsible for the accuracy of the information provided.

2    Section 99. Effective date. This Act takes effect upon
3becoming law.
