SYNOPSIS AS INTRODUCED:

    Amends the Illinois Lottery Law. Requires the Department of Revenue to offer a special instant scratch-off game, named Scratch-out Lung Cancer, to commence on July 1, 2014. Provides that the net revenue from the scratch-off game shall be deposited into the Lung Cancer Research Fund for appropriation by the General Assembly to the Department of Public Health for the purpose of making grants to organizations in Illinois that conduct research concerning lung cancer. Sets forth certain provisions for the operation of the scratch-off game. Amends the State Finance Act to create the Lung Cancer Research Fund as a special fund in the State treasury. Effective January 1, 2014.

1    AN ACT concerning the lottery.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Lottery Law is amended by changing
5Sections 2 and 20 and by adding Section 21.9 as follows:

7    Sec. 2. This Act is enacted to implement and establish
8within the State a lottery to be conducted by the State through
9the Department. The entire net proceeds of the Lottery are to
10be used for the support of the State's Common School Fund,
11except as provided in subsection (o) of Section 9.1 and
12Sections 21.2, 21.5, 21.6, 21.7, and 21.8, and 21.9. The
13General Assembly finds that it is in the public interest for
14the Department to conduct the functions of the Lottery with the
15assistance of a private manager under a management agreement
16overseen by the Department. The Department shall be accountable
17to the General Assembly and the people of the State through a
18comprehensive system of regulation, audits, reports, and
19enduring operational oversight. The Department's ongoing
20conduct of the Lottery through a management agreement with a
21private manager shall act to promote and ensure the integrity,
22security, honesty, and fairness of the Lottery's operation and
23administration. It is the intent of the General Assembly that

1the Department shall conduct the Lottery with the assistance of
2a private manager under a management agreement at all times in
3a manner consistent with 18 U.S.C. 1307(a)(1), 1307(b)(1),
41953(b)(4).

9    Sec. 20. State Lottery Fund.
10    (a) There is created in the State Treasury a special fund
11to be known as the "State Lottery Fund". Such fund shall
12consist of all revenues received from (1) the sale of lottery
13tickets or shares, (net of commissions, fees representing those
14expenses that are directly proportionate to the sale of tickets
15or shares at the agent location, and prizes of less than $600
16which have been validly paid at the agent level), (2)
17application fees, and (3) all other sources including moneys
18credited or transferred thereto from any other fund or source
19pursuant to law. Interest earnings of the State Lottery Fund
20shall be credited to the Common School Fund.
21    (b) The receipt and distribution of moneys under Section
2221.5 of this Act shall be in accordance with Section 21.5.
23    (c) The receipt and distribution of moneys under Section
2421.6 of this Act shall be in accordance with Section 21.6.

121.7 of this Act shall be in accordance with Section 21.7.
2    (e) The receipt and distribution of moneys under Section
321.8 of this Act shall be in accordance with Section 21.8.
4    (f) The receipt and distribution of moneys under Section
521.9 of this Act shall be in accordance with Section 21.9.

9    (20 ILCS 1605/21.9 new)
10    Sec. 21.9. Scratch-out Lung Cancer scratch-off game.
11    (a) The Department shall offer a special instant
12scratch-off game for the benefit of research pertaining to lung
13cancer. The game shall commence on July 1, 2014 or as soon
14thereafter, in the discretion of the Superintendent, as is
15reasonably practical. The operation of the game shall be
16governed by this Act and any rules adopted by the Department.
17If any provision of this Section is inconsistent with any other
18provision of this Act, then this Section governs.
19    (b) The Lung Cancer Research Fund is created as a special
20fund in the State treasury. The net revenue from the
21Scratch-out Lung Cancer scratch-off game created under this
22Section shall be deposited into the Fund for appropriation by
23the General Assembly to the Department of Public Health for the
24purpose of making grants to organizations in Illinois that
25conduct research concerning lung cancer.

1    Moneys received for the purposes of this Section,
2including, without limitation, net revenue from the special
3instant scratch-off game and from gifts, grants, and awards
4from any public or private entity, must be deposited into the
5Fund. Any interest earned on moneys in the Fund must be
6deposited into the Fund.
7    The grant funds may not be used for institutional,
8organizational, or community-based overhead costs, indirect
9costs, or levies.
10    For purposes of this subsection, "net revenue" means the
11total amount for which tickets have been sold less the sum of
12the amount paid out in the prizes and the actual administrative
13expenses of the Department solely related to the scratch-off
14game under this Section.
15    (c) During the time that tickets are sold for the
16Scratch-out Lung Cancer scratch-off game, the Department shall
17not unreasonably diminish the efforts devoted to marketing any
18other instant scratch-off lottery game.
19    (d) The Department may adopt any rules necessary to
20implement and administer the provisions of this Section.
 
21    Section 10. The State Finance Act is amended by adding
22Section 5.826 as follows:

1    Section 99. Effective date. This Act takes effect January
21, 2014.
