SYNOPSIS AS INTRODUCED:

    Amends the State Finance Act. Creates the Childhood Cancer Research Fund as a special fund in the State treasury. Provides that moneys in the Fund shall be used by the Department of Public Health to make grants to public or private not-for-profit entities for the purpose of conducting childhood cancer research. Amends the Illinois Income Tax Act. Provides that the Department of Revenue shall print, on its standard individual income tax form, a provision indicating that, if the taxpayer wishes to contribute to the Childhood Cancer Research Fund, then he or she may do so by stating the amount of the contribution on the return and indicating that the contribution will reduce the taxpayer's refund or increase the amount of payment. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Sections 5.826 and 6z-98 as follows:
 
6    (30 ILCS 105/5.826 new)
7    Sec. 5.826. The Childhood Cancer Research Fund. Fund.
 
8    (30 ILCS 105/6z-98 new)
9    Sec. 6z-98. Childhood Cancer Research Fund; creation. The
10Childhood Cancer Research Fund is created as a special fund in
11the State treasury. Moneys in the fund shall be used by the
12Department of Public Health to make grants to public or private
13not-for-profit entities for the purpose of conducting
14childhood cancer research. For the purposes of this Section,
15"research" includes, but is not limited to, expenditures to
16develop and advance the understanding, techniques, and
17modalities effective in early detection, prevention, cure,
18screening, and treatment of childhood cancer and may include
19clinical trials. The grant funds may not be used for
20institutional overhead costs, indirect costs, other
21organizational levies, or costs of community-based support
22services.

1    Section 10. The Illinois Income Tax Act is amended by
2adding Section 507DDD as follows:
 
3    (35 ILCS 5/507DDD new)
4    Sec. 507DDD. The Childhood Cancer Research Fund checkoff.
5For taxable years ending on or after December 31, 2013, the
6Department shall print, on its standard individual income tax
7form, a provision indicating that, if the taxpayer wishes to
8contribute to the Childhood Cancer Research Fund, as authorized
9by this amendatory Act of the 98th General Assembly, then he or
10she may do so by stating the amount of the contribution (not
11less than $1) on the return and indicating that the
12contribution will reduce the taxpayer's refund or increase the
13amount of payment to accompany the return. The taxpayer's
14failure to remit any amount of the increased payment reduces
15the contribution accordingly. This Section does not apply to
16any amended return.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.
