1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Demonstrations Law is
5amended by changing Sections 3, 4, 5, and 6 as follows:
 
6    (430 ILCS 70/3)  (from Ch. 38, par. 85-3)
7    Sec. 3. Unlawful action-Parade permit.
8    It is unlawful for any person, group or organization to
9conduct or participate in any march, assembly, meeting, parade,
10or gathering on roadways in more than one specific area of or
11location in, any municipality or the unincorporated area of a
12county, on any given day, unless it is acting under authority
13of a duly issued municipal or county parade or demonstration
14permit if local ordinance or regulation requires a such permit,
15or, if not, with permission of the principal law enforcement
16officer for the such area. Only the person, group, or
17organization responsible for organizing the march, assembly,
18meeting, parade, or gathering is required to obtain a permit or
19the permission of the principal law enforcement officer, which
20shall be sufficient to encompass all participants. If a march,
21assembly, meeting, parade, or gathering on roadways involves
22the act of crossing or traversing over or upon active railroad
23tracks, the municipal or county authority or principal law

1enforcement officer, as part of its permit or permission
2process, may prohibit any portion of the route that involves
3the act of crossing or traversing over or upon active railroad
4tracks.

7    Sec. 4. Acting with other groups - Size of assemblage. It
8is unlawful for any group or organization or any individual
9acting with the such group or organization, to conduct or
10participate in any march, assembly, meeting, parade, or
11gathering on roadways unless the such march, assembly, meeting,
12parade, or gathering is limited to such numbers that as, in the
13opinion of the principal law enforcement officer, will not
14obstruct pedestrian or vehicular traffic in an unreasonable
15manner. The principal law enforcement officer shall, within 12
16hours of receiving the notice required by Section 5, inform the
17group or organization as to the limitation on number of persons
18allowed to participate.

21    Sec. 5. Notice of assemblage in writing-Contents.
22    It is unlawful for any group or organization to conduct or
23participate in any march, assembly, meeting, parade, or
24gathering on roadways unless the principal law enforcement

1officer has been given notice in writing of the location, the
2maximum number of persons participating, and the names and
3addresses of the organizers of the any such march, assembly,
4meeting, parade, or gathering, its route, and its time of
5inception and duration at least 24 hours before such inception.

8    Sec. 6. Time of holding.
9    It is unlawful for any group, organization, or any
10individual to conduct or participate in any march, assembly,
11meeting, parade, or gathering on roadways during peak traffic
12periods unless authorized by the principal law enforcement
13officer for the area in which the march, assembly, meeting,
14parade, or gathering is to be held. Peak traffic periods,
15unless otherwise set by municipal or county authority, are for
16the purposes of this Act declared to be 7:30 a.m. o'clock to
179:00 a.m. o'clock in the forenoon, and from 4:30 p.m. o'clock
18to 6:00 p.m. o'clock in the afternoon, Monday through Friday
19except for State and National holidays.

21    Section 99. Effective date. This Act takes effect upon
22becoming law.
