1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Private College Act is amended by changing
5Sections 4 and 5 and by adding Section 4.5 as follows:
 
6    (110 ILCS 1005/4)  (from Ch. 144, par. 124)
7    Sec. 4. Upon the filing of an application for a certificate
8of approval, the Board shall make an examination to ascertain
9the following:
10        1. That each course of instruction to be offered or
11    given is adequate, suitable, and proper. ;
12        2. That the fee to be charged for the courses of
13    instruction, and the conditions and terms under which such
14    fees are to be paid are reasonable. ;
15        3. That an adequate physical plant and adequate
16    facilities are provided. ;
17        4. That the members of the teaching staff are
18    adequately prepared to fulfill their instructional
19    obligations. ;
20        5. That the institution does not promise or agree to
21    any right or privilege in respect to professional
22    examinations or to the practice of any profession in
23    violation of the laws of this State. ;

1        6. That the institution does not offer inducements that
2    are designed to deceive the prospective student or make any
3    promises which it does not have the present means or
4    ability to perform.
5        7. That the institution complies with Section 4.5 of
6    this Act.
7    If the examination shows that the applicant has such
8qualifications a certificate of approval shall be issued.

11    Sec. 4.5. Employment data. Any employment data that a
12post-secondary educational institution regulated under this
13Act (i) reports to the Board for the purpose of gaining or
14retaining required approval, (ii) uses for marketing,
15advertising, or statistical purposes, or (iii) conveys to
16existing or anticipated students in this State via the Internet
17or any of its publications or other written or oral
18communications must set forth the following data separately:
19        (1) Recent graduate employment lasting fewer than 3
20    months.
21        (2) Recent graduate employment lasting 3 months or
22    more.
23        (3) Recent graduate employment of graduates who are
24    employed on a temporary basis.
25        (4) Recent graduate employment of graduates who are

1    employed on a permanent basis.
2        (5) Employment data from any of its campuses located
3    within this State.
4        (6) Employment data from any of its campuses located
5    outside the territorial boundaries of this State.

7    Sec. 5. A certificate of approval of a post-secondary
8educational institution may be revoked for any of the
9following:
10        1. Violation of any of the conditions governing the
11    issuance of the certificate. ;
12        2. Failure to comply with any of the rules adopted by
13    the Board. ;
14        3. Fraudulent conduct on the part of any person
15    conducting the institution or of any person, acting within
16    the scope of his employment, employed by the owners or
17    persons conducting the institution, on account of which
18    conduct any student enrolled in the institution has been
19    injured or has suffered financial loss.
20        4. Failure to comply with Section 4.5 of this Act.

22    Section 10. The Academic Degree Act is amended by adding
23Section 7.5 as follows:

1    (110 ILCS 1010/7.5 new)
2    Sec. 7.5. Employment data. Any employment data that a
3degree granting institution regulated under this Act (i)
4reports to the Board for the purpose of gaining or retaining
5required authorization or approval, (ii) uses for marketing,
6advertising, or statistical purposes, or (iii) conveys to
7existing or anticipated students in this State via the Internet
8or any of its publications or other written or oral
9communications must set forth the following data separately:
10        (1) Recent graduate employment lasting fewer than 3
11    months.
12        (2) Recent graduate employment lasting 3 months or
13    more.
14        (3) Recent graduate employment of graduates who are
15    employed on a temporary basis.
16        (4) Recent graduate employment of graduates who are
17    employed on a permanent basis.
18        (5) Employment data from any of its campuses located
19    within this State.
20        (6) Employment data from any of its campuses located
21    outside the territorial boundaries of this State.
22    The Board may deny authorization or approval or revoke
23authorization or approval for failure of an institution to
24comply with this Section.
