SYNOPSIS AS INTRODUCED:

40 ILCS 5/3-148.5 new
40 ILCS 5/4-139.5 new

Amends the Downstate Police and Firefighter Articles of the Illinois Pension Code. Provide that the municipality is entitled to appear, as a matter of right, in any proceeding involving a duty disability benefit. Effective immediately.

AN ACT in relation to public employee benefits.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Pension Code is amended by adding Sections 3-148.5 and 4-139.5 as follows:

(40 ILCS 5/3-148.5 new)

Sec. 3-148.5. Right of employer to intervene. If not otherwise a party, the municipality is entitled to appear, as a matter of right, in any proceeding involving a duty disability benefit.

Sec. 4-139.5. Right of employer to intervene. If not otherwise a party, the municipality is entitled to appear, as a matter of right, in any proceeding involving a duty disability benefit.

Section 99. Effective date. This Act takes effect upon becoming law.
