425 ILCS 35/2 rep.

    Amends the Pyrotechnic Use Act. Repeals a provision prohibiting the sale and use of fireworks. Provides that fireworks may only be discharged by individuals over the age of 18. Provides that fireworks may only be discharged between the hours of 9:00 a.m. to 11:00 p.m. except on Memorial Day, Independence Day, Labor Day, and New Year's Eve.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Pyrotechnic Use Act is amended by changing
5Section 2.2 as follows:
 
6    (425 ILCS 35/2.2)
7    Sec. 2.2. Consumer displays.
8    (a) Fireworks may only be discharged by individuals over
9the age of 18.
10    (b) Fireworks may only be discharged between the hours of
119:00 a.m. to 11:00 p.m. except on Memorial Day, Independence
12Day, Labor Day, and New Year's Eve. On those specified
13holidays, fireworks may be discharged between the hours of 9:00
14a.m. to midnight.
15Each consumer display shall be handled by a competent
16individual who has received training from a consumer fireworks
17training class approved by the Office of the State Fire
18Marshal. Applications for consumer display permits shall be
19made in writing at least 15 days in advance of the date of the
20display, unless agreed to otherwise by the local jurisdiction
21issuing the permit and the fire chief of the jurisdiction in
22which the display will occur. After a permit has been granted,
23sales, possession, use, and distribution of consumer fireworks

1for display shall be lawful for that purpose only. No permit
2granted hereunder shall be transferable.
3    Permits may be granted hereunder to any adult individual
4applying for a permit who provides proof that he or she has
5received the requisite training. The local jurisdiction
6issuing the permit is authorized to conduct a criminal
7background check of the applicant as a condition of issuing a
8permit.
9    A permit shall be issued only after inspection of the
10display site by the fire chief providing fire protection
11coverage to the area of display, or his or her designee, to
12determine that the display is in full compliance with the rules
13adopted by the State Fire Marshal. Nothing in this Section
14shall prohibit the issuer of a permit from adopting more
15stringent rules.
