SYNOPSIS AS INTRODUCED:
 
20 ILCS 862/45

    Amends the Recreation Trails of Illinois Act. Provides that individuals with a current Off-Highway Vehicle Usage Stamp are not required to have a public access sticker to operate their off-highway vehicles on lands or waters in public off-highway vehicle parks paid for, operated by, or supported by a grant program established under the Act. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Recreational Trails of Illinois Act is
5amended by changing Section 45 as follows:
 
6    (20 ILCS 862/45)
7    Sec. 45. Public access sticker.
8    (a) Except as provided in subsection (b), after January 1,
91998, a person may not operate and an owner may not give
10permission to another to operate an off-highway vehicle on land
11or lands or waters in public off-highway vehicle parks paid
12for, operated, or supported by the grant program established
13under subsection (d) of Section 15 unless the off-highway
14vehicle displays an off-highway vehicle public access sticker
15in a manner prescribed by the Department by rule.
16    (b) An off-highway vehicle does not need a public access
17sticker if (1) the off-highway vehicle is used on private land,
18(2) the off-highway vehicle has a current Off-Highway Vehicle
19Usage Stamp and the off-highway vehicle is only operated on
20lands or water in public off-highway vehicle parks paid for,
21operated by, or supported by the grant program established
22under subsection (d) of Section 15 of this Act, or (3) if the
23off-highway vehicle is owned by the State, the federal

1government, or a unit of local government.
2    (c) The Department shall issue the public access stickers
3and shall charge the following fees:
4        (1) $30 for 3 years for individuals.
5        (2) $50 for 3 years for rental units.
6        (3) $75 for 3 years for dealer and manufacturer
7    demonstrations and research.
8        (4) $50 for 3 years for an all-terrain vehicle or
9    off-highway motorcycle used for production agriculture, as
10    defined in Section 3-821 of the Illinois Vehicle Code.
11        (5) $50 for 3 years for residents of a State other than
12    Illinois that does not have a reciprocal agreement with the
13    Department, pursuant to subsection (d).
14        (6) $50 for 3 years for an all-terrain vehicle or
15    off-highway motorcycle that does not have a title.
16The Department, by administrative rule, may make replacement
17stickers available at a reduced cost. These fees for public
18access stickers shall be deposited into the Off-Highway Vehicle
19Trails Fund.
20    (d) The Department is authorized to enter into reciprocal
21agreements with other states that have a similar off-highway
22vehicle public access sticker program to allow residents of
23such states to operate off-highway vehicles on land or lands or
24waters in public off-highway vehicle parks paid for, operated,
25or supported by the grant program established under subsection
26(d) of Section 15 without acquiring an off-highway vehicle

1public access sticker in this State pursuant to subsection (a).
2    (e) The Department may license vendors to sell off-highway
3vehicle public access stickers. Issuing fees may be set by
4administrative rule.
5    (f) Any person participating in an organized competitive
6event on land or lands in off-highway vehicle parks paid for,
7operated by, or supported by the grant program established in
8subsection (d) of Section 15 shall display the public access
9sticker required under subsection (c) of this Section or pay $5
10per event. Fees collected under this subsection shall be
11deposited into the Fund.
12    (g) The Department is authorized to modify any or all
13provisions of this Section 45 by rule.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
