1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Township Code is amended by adding Section
5170-65 as follows:
 
6    (60 ILCS 1/170-65 new)
7    Sec. 170-65. Dissolution of the Wood River Township
8Hospital.
9    (a) Dissolution.
10        (1) The Wood River Township Hospital is dissolved 180
11    days after the effective date of this amendatory Act of the
12    98th General Assembly.
13        (2) In the 180-day period prior to dissolution, the
14    hospital board shall be vested with the powers to wrap up
15    the affairs of the closed hospital under subsection (b) of
16    this Section, and to transfer any remaining hospital funds
17    under subsection (c) of this Section.
18    (b) Wrapping up the affairs of the Wood River Township
19Hospital.
20        (1) Within the first 10 business days of the 180-day
21    period provided in paragraph (2) of subsection (a) of this
22    Section, the chairman of the hospital board shall cause an
23    audit of all claims against the Wood River Township

1    Hospital, all receipts of the Wood River Township Hospital,
2    the inventory of all real and personal property owned by
3    the Wood River Township Hospital or under its control or
4    management, and any debts owed by the Wood River Township
5    Hospital. The chairman may, at his or her discretion,
6    undertake any other audit of the Wood River Township
7    Hospital. The person or entity conducting such audit shall
8    report the findings of the audit to the hospital board
9    within 30 days.
10        (2) Following the return of the audit provided in
11    paragraph (1) of this subsection, the hospital board shall:
12            (i) Pay the debts, obligations, and liabilities of
13        the Wood River Township Hospital that are outstanding
14        upon completion of the audit in paragraph (1) of this
15        subsection and all necessary expenses of closing up the
16        affairs of the Wood River Township Hospital.
17            (ii) Enter into an agreement with a hospital within
18        Madison County to ensure all patient records are
19        properly transferred. If no hospital in Madison County
20        is able or willing to accept the records, the records
21        may be transferred to a hospital within a neighboring
22        county contiguous to Madison County. The Wood River
23        Township Hospital will be responsible for paying a
24        reasonable service fee to the hospital that accepts and
25        retains records pursuant to this subsection. Following
26        successful transfer of the patient records, the

1        receiving hospital shall retain and destroy the
2        transferred patient records in accordance with the
3        receiving hospital's record retention schedule and
4        policies.
5            (iii) Sell the property of the Wood River Township
6        Hospital if any excess remains after all the
7        liabilities of the Wood River Township Hospital are
8        paid.
9    (c) Transfer of surplus funds. If any funds are available,
10the hospital board shall transfer, no later than 10 business
11days prior to the conclusion of the 180-day period provided in
12subsection (a) of this Section, all surplus funds, if any, to
13the Madison County Treasurer to be maintained in the Wood River
14Township Hospital Fund and be disposed of pursuant to
15subsection (d) of this Section.
16    If any liabilities remain, the funds available shall be set
17apart by the Madison County Treasurer and held for the purpose
18of retiring such liabilities.
19    (d) Payment of remaining liabilities and disposal of
20surplus funds. The Madison County Clerk shall pay any remaining
21liabilities of the Wood River Township Hospital from the Wood
22River Township Hospital Fund. After all the liabilities of the
23Wood River Township Hospital are paid, the Madison County Clerk
24shall distribute any funds remaining in the Wood River Township
25Hospital Fund to the property owners in Wood River Township as
26of the date of dissolution of Wood River Township Hospital. The

1distribution shall be proportional to the assessed value of the
2property in the 2005 levy year.
3    (e) Outstanding indebtedness.
4        (1) In the event that the Wood River Township Hospital
5    has notes outstanding which are a lien on funds available
6    in the Wood River Township Hospital Fund at the time of
7    dissolution, such lien shall be unimpaired by such
8    dissolution and the lien shall continue in favor of the
9    note holders.
10        (2) In the event that the Wood River Township Hospital
11    has unsecured debts outstanding at the time of dissolution,
12    any funds in the Wood River Township Hospital Fund or
13    otherwise available and not committed shall, to the extent
14    necessary, be applied to the payment of such debts.
15        (3) Madison County may levy a tax, on behalf of the
16    Wood River Township Hospital, upon all taxable real
17    property located in Wood River Township for the purpose of
18    paying the outstanding debts and obligations of the Wood
19    River Township Hospital.
20    (f) Tax collection and enforcement. The dissolution of the
21Wood River Township Hospital shall not adversely affect
22proceedings for the collection or enforcement of any tax. Those
23proceedings shall continue to finality as though no dissolution
24had taken place. The proceeds thereof shall be paid over to the
25Madison County Treasurer to be transferred pursuant to
26subsection (c) of this Section. Proceedings to collect and

1enforce such taxes may be instituted and carried on in the name
2of the Wood River Township Hospital.
3    (g) Litigation. All suits pending in any court on behalf of
4or against the Wood River Township Hospital may be prosecuted
5or defended in the name of Madison County by the State's
6attorney. All judgments obtained for the Wood River Township
7Hospital shall be collected and enforced by Madison County and
8transferred and disposed of pursuant to subsections (c) and (d)
9of this Section respectively.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.
