SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/17-6.1 new

    Amends the Criminal Code of 2012. Provides that any person, firm, corporation, association, agency, institution, or other legal entity that knowingly, by means of a false statement, false representation, concealment of any material fact, or by other fraudulent scheme or device on behalf of himself, herself, or others, obtains payments from a school district to which he, she, or it is not entitled, or in a greater amount than that to which he, she, or it is entitled, commits vendor fraud against a school district. Establishes penalties. Provides that a person convicted of vendor fraud against a school district shall be assessed an additional fine, as determined by the court, which fine shall be deposited in a special fund in the county treasury. Provides that moneys in the fund shall be disbursed upon order of the court for the purpose of funding job training and educational programs for pupils in the school district that has been defrauded.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by adding
5Section 17-6.1 as follows:
 
6    (720 ILCS 5/17-6.1 new)
7    Sec. 17-6.1. Vendor fraud against a school district.
8    (a) Any person, firm, corporation, association, agency,
9institution, or other legal entity commits vendor fraud against
10a school district when he, she, or it knowingly, by means of a
11false statement, false representation, concealment of any
12material fact, or by other fraudulent scheme or device on
13behalf of himself, herself, or others, obtains payments from a
14school district to which he, she, or it is not entitled, or in
15a greater amount than that to which he, she, or it is entitled.
16    (b) Sentence. Vendor fraud against a school district is a
17Class 4 felony except when more than $300 in payments is
18obtained, in which case vendor fraud against a school district
19is a Class 3 felony.
20    (c) In addition to the penalties provided in subsection
21(b), a person convicted of vendor fraud against a school
22district shall be assessed an additional fine, as determined by
23the court, which fine shall be deposited in a special fund in
