1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
527A-5.5 as follows:
 
6    (105 ILCS 5/27A-5.5 new)
7    Sec. 27A-5.5. Charter school truancy.
8    (a) A charter school shall comply with all applicable
9absenteeism and truancy policies and requirements applicable
10to public schools under the laws of the State of Illinois.
11    (b) A charter school shall define a truant as a child who
12is subject to compulsory school attendance and who is absent
13without valid cause from such attendance for a school day or
14portion thereof.
15    (c) A charter school shall define a chronic or habitual
16truant as a child who is subject to compulsory school
17attendance and who is absent without valid cause from such
18attendance for 5% or more of the previous 180 regular
19attendance days.
20    (d) A charter school shall define a truant minor as a
21chronic truant to whom supportive services, including
22prevention, diagnostic, intervention, and remedial services,
23alternative programs, and other school and community resources

1have been provided and have failed to result in the cessation
2of chronic truancy or have been offered and refused.
3    (e) A charter school shall define a dropout as any child
4enrolled in grades 9 through 12 whose name has been removed
5from the charter school enrollment roster for any reason other
6than the student's death, extended illness, removal for medical
7non-compliance, expulsion, aging out, graduation, or
8completion of a program of studies and who has not transferred
9to another public or private school and is not known to be
10home-schooled by his or her parents or guardians or continuing
11school in another country.
 
12    Section 99. Effective date. This Act takes effect upon
13becoming law.
