SYNOPSIS AS INTRODUCED:
 
215 ILCS 5/356z.23 new

    Amends the Illinois Insurance Code. Provides that any individual or group policy of accident and health insurance amended, delivered, issued, or renewed in this State after the effective date of the Act that provides coverage for prescription drugs must allow for the refilling of prescription eye drop medication prior to the last day of the approved dosage period without regard to coverage restrictions on early refills. Provides that any refills dispensed prior to the expiration of the prescription and approved coverage period pursuant to the Section shall, to the extent practicable, be limited in quantity so as not to exceed the remaining dosage initially approved for coverage. Provides that nothing in the provisions limits or restricts coverage with regard to any previously or subsequently approved prescription for eye drop medication and affected prescriptions shall otherwise be subject to the terms and conditions of the policy, and that nothing in the provisions shall be interpreted as prohibiting a pharmacist from contacting the prescribing physician or health care provider to verify the prescription.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Insurance Code is amended by adding
5Section 356z.23 as follows:
 
6    (215 ILCS 5/356z.23 new)
7    Sec. 356z.23. Eye drop refill coverage. An individual or
8group policy of accident and health insurance amended,
9delivered, issued, or renewed in this State after the effective
10date of this amendatory Act of the 99th General Assembly that
11provides coverage for prescription drugs must allow for the
12refilling of prescription eye drop medication prior to the last
13day of the approved dosage period without regard to coverage
14restrictions on early refills. Any refill dispensed prior to
15the expiration of the prescription and approved coverage period
16pursuant to this Section shall, to the extent practicable, be
17limited in quantity so as not to exceed the remaining dosage
18initially approved for coverage. Nothing in this Section limits
19or restricts coverage with regard to any previously or
