SYNOPSIS AS INTRODUCED:
 
730 ILCS 5/3-7-8 new

    Amends the Unified Code of Corrections. Provides that the Department of Corrections shall adopt rules requiring each institution and facility of the Department to permit a committed person to be examined by a physician or clinical psychologist chosen by the committed person or his or her guardian, if the institution or facility determines that the examination would not be harmful or dangerous to the security or safety of the committed person or other persons in the institution or facility. Provides that nothing in this provision shall be construed to create a right of any committed person, who cannot afford the examination or obtain the examination without charge, to any assistance from the Department, financial or otherwise, in obtaining or paying for the examination. Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Unified Code of Corrections is amended by
5adding Section 3-7-8 as follows:
 
6    (730 ILCS 5/3-7-8 new)
7    Sec. 3-7-8. Examination of committed person by a physician
8or clinical psychologist chosen by the committed person or his
9or her guardian. The Department shall adopt rules requiring
10each institution and facility of the Department to permit a
11committed person to be examined by a physician or clinical
12psychologist chosen by the committed person or his or her
13guardian, if the institution or facility determines the
14examination would not be harmful or dangerous to the security
15or safety of the committed person or other persons in the
16institution or facility. Nothing in this Section shall be
17construed to create a right of any committed person, who cannot
18afford the examination or obtain the examination without
19charge, to any assistance from the Department, financial or
20otherwise, in obtaining or paying for the examination.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
