1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Trustees Act is
5amended by changing Section 1 as follows:
 
6    (110 ILCS 310/1)  (from Ch. 144, par. 41)
7    Sec. 1. The Board of Trustees of the University of Illinois
8shall consist of the Governor and at least 12 trustees. Nine
9trustees shall be appointed by the Governor, by and with the
10advice and consent of the Senate. The other trustees shall be
11students, of whom one student shall be selected from each
12University campus.
13    Each student trustee shall serve a term of one year,
14beginning on July 1 or on the date of his or her selection,
15whichever is later, and expiring on the next succeeding June
1630.
17    Each trustee shall have all of the privileges of
18membership, except that only one student trustee shall have the
19right to cast a legally binding vote. The Governor shall
20designate which one of the student trustees shall possess, for
21his or her entire term, the right to cast a legally binding
22vote. Each student trustee who does not possess the right to
23cast a legally binding vote shall have the right to cast an

1advisory vote and the right to make and second motions and to
2attend executive sessions.
3    Each trustee shall be governed by the same conflict of
4interest standards. Pursuant to those standards, it shall not
5be a conflict of interest for a student trustee to vote on
6matters pertaining to students generally, such as tuition and
7fees. However, it shall be a conflict of interest for a student
8trustee to vote on faculty member tenure or promotion. For the
9purposes of this Section, a student member shall not be deemed
10to have a direct conflict of interest in and may vote on any
11item involving the employment or compensation of the Chancellor
12at any campus or the President of the University or the
13election of officers. Student trustees shall be chosen by
14campus-wide student election, and the student trustee
15designated by the Governor to possess a legally binding vote
16shall be one of the students selected by this method. A student
17trustee who does not possess a legally binding vote on a
18measure at a meeting of the Board or any of its committees
19shall not be considered a trustee for the purpose of
20determining whether a quorum is present at the time that
21measure is voted upon. To be eligible for selection as a
22student trustee and to be eligible to remain as a voting or
23nonvoting student trustee, a student trustee must be a resident
24of this State, must have and maintain a grade point average
25that is equivalent to at least 2.5 on a 4.0 scale, and must be a
26full time student enrolled at all times during his or her term

1of office except for that part of the term which follows the
2completion of the last full regular semester of an academic
3year and precedes the first full regular semester of the
4succeeding academic year at the University (sometimes commonly
5referred to as the summer session or summer school). If a
6voting or nonvoting student trustee fails to continue to meet
7or maintain the residency, minimum grade point average, or
8enrollment requirement established by this Section, his or her
9membership on the Board shall be deemed to have terminated by
10operation of law. The University may not use residency for
11tuition purposes as a factor in making the determination that a
12student is or is not a resident of this State. The following
13factors shall positively demonstrate residency in this State
14for the purposes of the residency requirement for student
15trustees and candidates for student trustee:
16        (1) evidence of the student's Illinois domicile for at
17    least the previous 6 months;
18        (2) evidence of the student's current, valid Illinois
19    driver's license; and
20        (3) evidence of the student's valid Illinois voter
21    registration.
22A positive demonstration of residency in this State for student
23trustees and candidates for student trustees under this Section
24does not apply to residency requirements for tuition purposes.
25    If a voting student trustee resigns or otherwise ceases to
26serve on the Board, the Governor shall, within 30 days,

1designate one of the remaining student trustees to possess the
2right to cast a legally binding vote for the remainder of his
3or her term. If a nonvoting student trustee resigns or
4otherwise ceases to serve on the Board, the chief executive of
5the student government from that campus shall, within 30 days,
6select a new nonvoting student trustee to serve for the
7remainder of the term.
8    No more than 5 of the 9 appointed trustees shall be
9affiliated with the same political party. Each trustee
10appointed by the Governor must be a resident of this State. A
11failure to meet or maintain this residency requirement
12constitutes a resignation from and creates a vacancy in the
13Board. The term of office of each appointed trustee shall be 6
14years from the third Monday in January of each odd numbered
15year. The regular terms of office of the appointed trustees
16shall be staggered so that 3 terms expire in each odd-numbered
17year.
18    Vacancies for appointed trustees shall be filled for the
19unexpired term in the same manner as original appointments. If
20a vacancy in membership occurs at a time when the Senate is not
21in session, the Governor shall make temporary appointments
22until the next meeting of the Senate, when he shall appoint
23persons to fill such memberships for the remainder of their
24respective terms. If the Senate is not in session when
25appointments for a full term are made, appointments shall be
26made as in the case of vacancies.

1    No action of the board shall be invalidated by reason of
2any vacancies on the board, or by reason of any failure to
3select student trustees.

5    Section 10. The Southern Illinois University Management
6Act is amended by changing Section 5 as follows:

8    Sec. 5. Members of the Board shall elect annually by secret
9ballot from their own number a chairman who shall preside over
10meetings of the Board and a secretary.
11    Meetings of the Board shall be held at least once each
12quarter on a campus of Southern Illinois University. At all
13regular meetings of the Board, a majority of its voting members
14shall constitute a quorum. The student members shall have all
15of the privileges of membership, including the right to make
16and second motions and to attend executive sessions, other than
17the right to vote, except that the student member designated by
18the Governor as the voting student member shall have the right
19to vote on all Board matters except those involving faculty
20tenure, faculty promotion or any issue on which the student
21member has a direct conflict of interest. For the purposes of
22this Section, a student member shall not be deemed to have a
23direct conflict of interest in and may vote on any item
24involving the employment or compensation of the Chancellor at

2of officers. A student member who is not entitled to vote on a
3measure at a meeting of the Board or any of its committees
4shall not be considered a member for the purpose of determining

6upon. No action of the Board shall be invalidated by reason of
7any vacancies on the Board, or by reason of any failure to
8select a student member.
9    Special meetings of the Board may be called by the chairman
10of the Board or by any 3 members of the Board.
11    At each regular and special meeting that is open to the
12public, members of the public and employees of the University
13shall be afforded time, subject to reasonable constraints, to
14make comments to or ask questions of the Board.

18vacancies on the Board or by reason of any failure to select a
19student member.
20    Special meetings of the Board may be called by the chairman

2    Section 20. The Eastern Illinois University Law is amended
3by changing Section 10-25 as follows:

5    Sec. 10-25. Officers; meetings. Members of the Board shall
6elect annually by secret ballot from their own number a
7chairman who shall preside over meetings of the Board and a
8secretary.
9    Meetings of the Board shall be held at least once each
10quarter on the campus of Eastern Illinois University at
11Charleston, Illinois. At all regular meetings of the Board, a
12majority of its members shall constitute a quorum. The student
13member shall have all of the privileges of membership,
14including the right to make and second motions, to attend
15executive sessions, and to vote on all Board matters except
16those involving faculty tenure, faculty promotion or any issue
17on which the student member has a direct conflict of interest.
18For the purposes of this Section, a student member shall not be
19deemed to have a direct conflict of interest in and may vote on
20any item involving the employment or compensation of the
21President of the University or the election of officers. Unless
22the student member is entitled to vote on a measure at a

14by changing Section 15-25 as follows:

18chairman who shall preside over meetings of the Board and a
19secretary.
20    Meetings of the Board shall be held at least once each
21quarter on the campus of Governors State University at
22University Park, Illinois. At all regular meetings of the
23Board, a majority of its members shall constitute a quorum. The

1including the right to make and second motions, to attend
2executive sessions, and to vote on all Board matters except
3those involving faculty tenure, faculty promotion or any issue

7any item involving the employment or compensation of the
8President of the University or the election of officers. Unless

8Illinois. At all regular meetings of the Board, a majority of
9its members shall constitute a quorum. The student member shall
10have all of the privileges of membership, including the right
11to make and second motions, to attend executive sessions, and
12to vote on all Board matters except those involving faculty
13tenure, faculty promotion or any issue on which the student
14member has a direct conflict of interest. For the purposes of
15this Section, a student member shall not be deemed to have a
16direct conflict of interest in and may vote on any item
17involving the employment or compensation of the President of
18the University or the election of officers. Unless the student
19member is entitled to vote on a measure at a meeting of the

2of the Board or by any 3 members of the Board.
3    At each regular and special meeting that is open to the
4public, members of the public and employees of the University
5shall be afforded time, subject to reasonable constraints, to
6make comments to or ask questions of the Board.

9    Section 35. The Northeastern Illinois University Law is
10amended by changing Section 25-25 as follows:
 
11    (110 ILCS 680/25-25)
12    Sec. 25-25. Officers; meetings. Members of the Board
13appointed by the Governor shall elect by secret ballot from
14their own number a chairperson, who shall serve for a period of
152 years from his or her election and who shall preside over
16meetings of the Board, a secretary, and other officers that the
17Board deems necessary. The secretary and other officers shall
18also serve for a period of 2 years from their election.
19    Meetings of the Board shall be held at least once each
20quarter on the campus of Northeastern Illinois University at
21Chicago, Illinois. At all regular meetings of the Board, a
22majority of its members shall constitute a quorum. The student
23member shall have all of the privileges of membership,
24including the right to make and second motions, to attend

1executive sessions, and to vote on all Board matters except
2those involving faculty tenure, faculty promotion or any issue
3on which the student member has a direct conflict of interest.

9executive sessions, and to vote on all Board matters except
10those involving faculty tenure, faculty promotion or any issue
11on which the student member has a direct conflict of interest.
12For the purposes of this Section, a student member shall not be

14any item involving the employment or compensation of the
15President of the University or the election of officers. Unless

5    Section 45. The Western Illinois University Law is amended
6by changing Section 35-25 as follows:

8    Sec. 35-25. Officers; meetings. Members of the Board shall
9elect annually by secret ballot from their own number a
10chairman who shall preside over meetings of the Board and a
11secretary.
12    Meetings of the Board shall be held at least once each
13quarter. One of these meetings must be held on the Quad Cities
14campus of Western Illinois University and all other meetings
15must be held on the campus of Western Illinois University at
16Macomb, Illinois. At all regular meetings of the Board, a
17majority of its members shall constitute a quorum. The student
18member shall have all of the privileges of membership,
19including the right to make and second motions, to attend
20executive sessions, and to vote on all Board matters except
21those involving faculty tenure, faculty promotion or any issue
22on which the student member has a direct conflict of interest.
23For the purposes of this Section, a student member shall not be
24deemed to have a direct conflict of interest in and may vote on

17    Section 99. Effective date. This Act takes effect upon
18becoming law.
