SYNOPSIS AS INTRODUCED:
 
410 ILCS 625/3.08 new

    Amends the Food Handling Regulation Enforcement Act. Provides that the Department of Public Health shall establish a food allergy awareness program that requires each food service establishment in the State to either: (1) display, in a prominent location accessible by the food service establishment's consumers, a poster that concerns food allergy awareness and is approved by the Department, or (2) make available, upon request, a comprehensive list of the foods that the food service establishment serves and a list of the allergens contained within the foods that includes information on the risk of cross-contamination for the foods. Provides that a food service establishment that makes available a comprehensive list shall update it as is necessary. Provides that the Department shall maintain a website that lists the food service establishments that have violated these provisions and the number of violations for each food service establishment. Provides that the Department shall adopt any rules necessary to enforce these provisions.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Food Handling Regulation Enforcement Act is
5amended by adding Section 3.08 as follows:
 
6    (410 ILCS 625/3.08 new)
7    Sec. 3.08. Food allergy information required.
8    (a) The Department of Public Health shall establish a food
9allergy awareness program that requires a food service
10establishment in the State to either:
11        (1) display, in a prominent location accessible by the
12    food service establishment's consumers, a poster that
13    concerns food allergy awareness and is approved by the
14    Department of Public Health; or
15        (2) make available, upon request, a comprehensive list
16    of the foods that the food service establishment serves and
17    a list of the allergens contained within the foods that
18    includes information on the risk of cross-contamination
19    for the foods.
20    A food service establishment that makes available a
21comprehensive list under paragraph (2) of this subsection shall
22update the comprehensive list as is necessary.
23    (b) The Department of Public Health shall maintain a

1website that lists the food service establishments that have
2violated this Section and the number of times each food service
3establishment has violated this Section.
4    (c) The Department of Public Health shall adopt any rules
5necessary to enforce this Section.
