HOUSE RESOLUTION

 
2    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
3HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the
4Rules of the House of Representatives of the 100th General
5Assembly are amended by changing Rules 32 and 49 and by adding
6Rule 21.5 as follows:
 
 
7    (House Rule 21.5 new)
8    21.5 Committee and Task Force Hearing Accessibility.
9    (a) The regular meeting location for committee and task
10force hearings shall be the seat of government in Springfield.
11Committee and task force hearings may also be held at the
12Michael A. Bilandic Building, located at 160 North LaSalle
13Street in Chicago, and at other locations authorized by the
14Speaker that are suitable for interactive video conference
15participation.
16    (b) Whenever the location for a committee or task force
17hearing is not in Springfield, the Clerk shall provide for a
18secondary location in Springfield where members and the public
19may participate in the hearing through an interactive video
20conference.
21    Notwithstanding any other rule to the contrary, committee
22or task force members with voting rights participating in a
23hearing through the interactive video conference shall be

1included in the quorum roll call for the hearing and shall be
2allowed to participate in the hearing, including speaking in
3debate, making motions, and casting votes, in the same manner
4as members who are physically present at the hearing location.
5    Any person wishing to offer testimony at a committee
6hearing, pursuant to Rule 26, or a task force hearing may do so
7at the secondary location in the same manner as a person who is
8physically present at the hearing location.
9    All votes shall be by roll call whenever one or more
10committee or task force members with voting rights are
11participating in the hearing through an interactive video
12conference. Participation in a hearing at the secondary
13location shall not be allowed during any time periods of
14interruption in interactive video conference service. No
15action of the committee or task force shall be invalidated on
16the grounds that the loss of, or poor quality of, the
17interactive video conference service prevented a committee or
18task force member, or a person wishing to offer testimony, from
19participating in the hearing.
20    The Clerk shall (i) include in the committee or task force
21hearing notice the secondary location for the hearing, and (ii)
22ensure that a committee clerk is present at the secondary
23location to operate necessary equipment, to record committee or
24task force member participation in quorum and vote roll calls,
25and to record requests to provide testimony.
26    (c) The Speaker may suspend the requirements of subsection

1(b) for interactive video conference participation when (i) the
2Clerk has determined that the condition of equipment or
3communication services at the hearing location will not allow
4for interactive video conference participation, and (ii) such
5conditions are first identified or arise after the hearing was
6scheduled. A detailed explanation of the conditions and their
7discovery that led to such determination shall be provided by
8the Clerk and included in the Journal.

10    (House Rule 32)
11    32. Quorum.
12    (a) A majority of those elected constitutes a quorum of the
13House, and a majority of those appointed constitutes a quorum
14of a committee, but a smaller number may adjourn from day to
15day, or recess for less than one day, and compel the attendance
16of absent members. Members of a committee with voting rights
17who are attending a hearing through an interactive video
18conference pursuant to Rule 21.5 shall count towards
19determining a quorum. When a quorum is not present for a
20hearing of a committee, a smaller number may conduct a hearing
21on a subject matter as authorized by Rule 21 or Rule 25. The
22attendance of absent members may also be compelled by order of
23the Speaker. This subsection may not be suspended.
24    (b) The question of the presence of a quorum in any
25committee may not be raised on consideration of a legislative

1measure by the House unless the same question was previously
2raised before the committee with respect to that legislative
3measure.
4    (c) Any member not answering the quorum roll call of the
5House on any session day who is in attendance and wishes to be
6added to that quorum roll call must file a request to be shown
7present on the quorum roll call with the Clerk. The request
8must be in writing and filed in person by the member on the
9same calendar day the quorum roll call was taken.

11    (House Rule 49)
12    49. Voting. The Presiding Officer shall put all questions
13distinctly, as follows: "All those in favor vote AYE, and those
14opposed vote NAY." No member may vote on any question before
15the House unless on the floor before the vote is announced. No
16member of a committee may vote except in person or through
17interactive video conference participation pursuant to Rule
1821.5 at the time of the committee vote, provided the member is
19on the committee roll before the vote is announced. Any vote of
20the House shall be by record vote whenever 5 Representatives
21shall so request or whenever the Presiding Officer shall so
22order.
