| 1 | | AN ACT concerning State government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. This Act may be referred to as the Illinois | 5 | | State Police Line of Duty Preference Act of 2018. | 6 | | Section 5. The State Police Act is amended by changing | 7 | | Section 9 as follows:
| 8 | | (20 ILCS 2610/9) (from Ch. 121, par. 307.9)
| 9 | | Sec. 9. Appointment; qualifications.
| 10 | | (a) Except as otherwise provided in this Section, the | 11 | | appointment of
Department of State Police officers shall be | 12 | | made from those applicants who
have been certified by the Board | 13 | | as being qualified for appointment. All
persons so appointed | 14 | | shall, at the time of their appointment, be not less than
21 | 15 | | years of age, or 20 years of age and have successfully | 16 | | completed 2 years of
law enforcement studies at an accredited | 17 | | college or university. Any person
appointed subsequent to | 18 | | successful completion of 2 years of such law
enforcement | 19 | | studies shall not have power of arrest, nor shall he be | 20 | | permitted
to carry firearms, until he reaches 21 years of age. | 21 | | In addition,
all persons so certified for appointment shall be | 22 | | of sound mind and body, be of
good moral character, be citizens |

| 1 | | of the United States, have no criminal
records, possess such | 2 | | prerequisites of training, education and experience as
the | 3 | | Board may from time to time prescribe, and shall be required to | 4 | | pass
successfully such mental and physical tests and | 5 | | examinations as may be
prescribed by the Board. Notwithstanding | 6 | | any Board rule to the contrary, all persons who meet one of the | 7 | | following requirements are deemed to have met the collegiate | 8 | | educational requirements: | 9 | | (i) have been honorably discharged and who have been | 10 | | awarded a Southwest Asia Service Medal, Kosovo Campaign | 11 | | Medal, Korean Defense Service Medal, Afghanistan Campaign | 12 | | Medal, Iraq Campaign Medal, or Global War on Terrorism | 13 | | Expeditionary Medal by the United States Armed Forces; | 14 | | (ii) are active members of the Illinois National Guard | 15 | | or a reserve component of the United States Armed Forces | 16 | | and who have been awarded a Southwest Asia Service Medal, | 17 | | Kosovo Campaign Medal, Korean Defense Service Medal, | 18 | | Afghanistan Campaign Medal, Iraq Campaign Medal, or Global | 19 | | War on Terrorism Expeditionary Medal as a result of | 20 | | honorable service during deployment on active duty; | 21 | | (iii) have been honorably discharged who served in a | 22 | | combat mission by proof of hostile fire pay or imminent | 23 | | danger pay during deployment on active duty; or | 24 | | (iv) have at least 3 years of full active and | 25 | | continuous military duty and received an honorable | 26 | | discharge before hiring. |

| 1 | | Preference shall be given in such appointments to
persons | 2 | | who have honorably served in the military or naval services of | 3 | | the
United States or to the son, daughter, stepson, | 4 | | stepdaughter, grandson, granddaughter, brother, or sister of a | 5 | | law enforcement officer who was killed in the line of duty as | 6 | | defined in Section 2 of the Line of Duty Compensation Act . In | 7 | | this paragraph, "law enforcement officer" means any person | 8 | | employed by a State, county, municipality, special district, | 9 | | college, unit of government, or any other entity authorized by | 10 | | law to employ peace officers or exercise police authority and | 11 | | who is primarily responsible for the prevention or detection of | 12 | | crime and the enforcement of the laws of this State. All | 13 | | appointees shall serve a probationary period of 12 months
from | 14 | | the date of appointment and during that period may be | 15 | | discharged at the
will of the Director. However, the Director | 16 | | may in his or her sole discretion
extend the probationary | 17 | | period of an officer up to an additional 6 months when
to do so | 18 | | is deemed in the best interest of the Department.
| 19 | | (b) Notwithstanding the other provisions of this Act, after | 20 | | July 1,
1977 and before July 1, 1980, the Director of State | 21 | | Police may appoint and
promote not more than 20 persons having | 22 | | special qualifications as special
agents as he deems necessary | 23 | | to carry out the Department's objectives. Any
such appointment | 24 | | or promotion shall be ratified by the Board.
| 25 | | (c) During the 90 days following the effective date of this | 26 | | amendatory Act
of 1995, the Director of State Police may |

| 1 | | appoint up to 25 persons as State
Police officers. These | 2 | | appointments shall be made in accordance with the
requirements | 3 | | of this subsection (c) and any additional criteria that may be
| 4 | | established by the Director, but are not subject to any other | 5 | | requirements of
this Act. The Director may specify the initial | 6 | | rank for each person appointed
under this subsection.
| 7 | | All appointments under this subsection (c) shall be made | 8 | | from personnel
certified by the Board. A person certified by | 9 | | the Board and appointed by the
Director under this subsection | 10 | | must have been employed by the Illinois Commerce
Commission on | 11 | | November 30, 1994 in a job title
subject to the Personnel Code | 12 | | and in a position for which the person was
eligible to earn | 13 | | "eligible creditable service" as a "noncovered employee", as
| 14 | | those terms are defined in Article 14 of the Illinois Pension | 15 | | Code.
| 16 | | Persons appointed under this subsection (c) shall | 17 | | thereafter be subject to
the same requirements and procedures | 18 | | as other State police officers. A person
appointed under this | 19 | | subsection must serve a probationary period of 12 months
from | 20 | | the date of appointment, during which he or she may be | 21 | | discharged at the
will of the Director.
| 22 | | This subsection (c) does not affect or limit the Director's | 23 | | authority to
appoint other State Police officers under | 24 | | subsection (a) of this Section.
