1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Small
5Business Contracts Act.
 
6    Section 5. Definitions. For the purposes of this Act, the
7following terms shall have the following definitions:
8    "Small business" means a small business as defined in the
9Illinois Procurement Code.
10    "State contract" means a State contract, as defined in the
11Illinois Procurement Code, funded with State or federal funds,
12whether competitively bid or negotiated.
13    "State official or agency" means a department, officer,
14board, commission, institution, or body politic or corporate of
15the State.
 
16    Section 10. Award of State contracts.
17    (a) Not less than 10% of the total dollar amount of State
18contracts shall be established as a goal to be awarded to small
19businesses.
20    (b) The percentage in subsection (a) relates to the total
21dollar amount of State contracts during each State fiscal year,
22calculated by examining independently each type of contract for

1each State official or agency which lets such contracts.
 
2    Section 15. Compliance plans.
3    (a) Each State official or agency shall file with its
4respective chief procurement officer an annual compliance plan
5which shall outline the goals of the State official or agency
6for contracting with small businesses for the then current
7fiscal year, the manner in which the official or agency intends
8to reach these goals, and a timetable for reaching these goals.
9The chief procurement officer shall review and approve the plan
10of the State official or agency and may reject any plan that
11does not comply with this Act or any rules promulgated pursuant
12to this Act.
13    (b) Each State official or agency shall file with its
14respective chief procurement officer an annual report of its
15utilization of small businesses during the preceding fiscal
16year including lapse period spending and a mid-fiscal year
17report of its utilization to date for the then current fiscal
18year. The reports shall include a self-evaluation of the
19efforts of the State official or agency to meet its goals under
20the Act.
 
21    Section 20. Annual report. Each chief procurement officer
22shall file no later than March 1 of each year, an annual report
23that shall detail the level of achievement toward the goals
24specified in this Act over the 3 most recent fiscal years. The

1annual report shall include, but need not be limited to, the
2following:
3        (1) a summary detailing State appropriations subject
4    to the goals, the actual goals specified, and the goals
5    attained by each State official or agency;
6        (2) a summary of the number of contracts awarded and
7    the average contract amount by each State official or
8    agency; and
9        (3) an analysis of the level of overall goal
10    achievement concerning purchases from small businesses.
 
11    Section 99. Effective date. This Act takes effect upon
12becoming law.
