SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/31-4.6 new

    Amends the Criminal Code of 1961. Creates the offense of making a false statement to a peace officer or criminal investigative officer. Provides that a person commits the offense if: (1) the person knowingly makes a false statement to a peace officer or criminal investigative officer of the State or a unit of local government regarding a criminal matter that the person knows to be under investigation by the officer; and (2) during the interview, the person is first informed by a prosecutor who is working with the officer on the investigation that a knowing false statement to the officer relating to the investigation would constitute a criminal offense. Provides that a violation is a Class 4 felony.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 1961 is amended by adding
5Section 31-4.6 as follows:
 
6    (720 ILCS 5/31-4.6 new)
7    Sec. 31-4.6. Making a false statement to a peace officer or
8criminal investigative officer.
9    (a) A person commits the offense of making a false
10statement to a peace officer or criminal investigative officer
11if:
12        (1) the person knowingly makes a false statement to a
13    peace officer or criminal investigative officer of the
14    State or a unit of local government regarding a criminal
15    matter that the person knows to be under investigation by
16    the officer; and
17        (2) during the interview, the person is first informed
18    by a prosecutor who is working with the officer on the
19    investigation that a knowing false statement to the officer
20    relating to the investigation would constitute a criminal
21    offense.
22    (b) Sentence. Making a false statement to a peace officer
23or criminal investigative officer is a Class 4 felony.
