SYNOPSIS AS INTRODUCED:

105 ILCS 5/10-30 new
105 ILCS 5/34-21.9 new
30 ILCS 805/8.35 new

    Amends the Illinois Municipal Code. Provides that a municipality shall require that all vehicles purchased or leased on or after the effective date of the amendatory Act for use by the municipality have a Vehicle Identification Number that begins with the number one, the number 4, or the number 5. Limits home rule powers. Amends the School Code. Provides that a school board shall require that all vehicles purchased or leased on or after the effective date of the amendatory Act that are used for the practice driving part of a driver education course offered by the school district have a Vehicle Identification Number that begins with the number one, the number 4, or the number 5. Provides for the waiver of the Vehicle Identification Number requirements imposed under this Section. Amends the State Mandates Act to require implementation without reimbursement.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-40-4 as follows:
 
6    (65 ILCS 5/11-40-4 new)
7    Sec. 11-40-4. American-made vehicles. A municipality shall
8require that all vehicles purchased or leased on or after the
9effective date of this amendatory Act of the 97th General
10Assembly for use by the municipality have a Vehicle
11Identification Number that begins with the number one, the
12number 4, or the number 5. A municipality may not regulate the
13purchase or lease of vehicles in a manner less restrictive than
14as provided in this Section. This Section is a limitation under
15subsection (i) of Section 6 of Article VII of the Illinois
16Constitution on the concurrent exercise by home rule units of
17powers and functions exercised by the State.
 
18    Section 10. The School Code is amended by adding Sections
1910-30 and 34-21.9 as follows:

3the 97th General Assembly that are used for the practice

5district under Section 27-24.2 of this Code have a Vehicle
6Identification Number that begins with the number one, the
7number 4, or the number 5.
8    School districts on the financial watch, the financial
9early warning, or the financial difficulty list, as defined by
10the State Board of Education, may waive the requirements of
11this Section for any year following (i) a public hearing and
12(ii) an affirmative vote of at least two-thirds of the school
13board members of the district to waive the requirements. Any
14district waiving the requirements imposed under this Section
15shall notify the State Board of Education within 45 days after
16the wavier.

18    Sec. 34-21.9. American-made driver education vehicles. The
19board shall require that all vehicles purchased or leased on or
20after the effective date of this amendatory Act of the 97th
21General Assembly that are used for the practice driving part of
22a driver education course offered by the school district under
23Section 27-24.2 of this Code have a Vehicle Identification
24Number that begins with the number one, the number 4, or the
25number 5.

1    School districts on the financial watch, the financial

10    Section 90. The State Mandates Act is amended by adding
11Section 8.35 as follows:
 
12    (30 ILCS 805/8.35 new)
13    Sec. 8.35. Exempt mandate. Notwithstanding Sections 6 and 8
14of this Act, no reimbursement by the State is required for the
15implementation of any mandate created by this amendatory Act of
16the 97th General Assembly.
