2 AMENDMENT NO. . Amend House Bill 60, AS AMENDED, by

5 "Section 5. The University of Illinois Act is amended by
6 adding Section 7e-5 as follows:
7 (110 ILCS 305/7e-5 new)
8 Sec. 7e-5. In-state tuition charge.
9 (a) Notwithstanding any other provision of law to the
10 contrary, for tuition purposes, the Board of Trustees shall
11 deem an individual an Illinois resident, until the individual
12 establishes a residence outside of this State, if all of the
13 following conditions are met:
14 (1) The individual resided with his or her parent
15 or guardian while attending a public or private high
16 school in this State.
17 (2) The individual graduated from a public or
18 private high school or received the equivalent of a high
19 school diploma in this State.
20 (3) The individual attended school in this State
21 for at least 3 years as of the date the individual
22 graduated from high school or received the equivalent of

1 a high school diploma.
2 (4) The individual registers as an entering student
3 in the University not earlier than the 2003 fall
4 semester.
5 (5) In the case of an individual who is not a

9 become a permanent resident of the United States at the
10 earliest opportunity the individual is eligible to do so.
11 (b) This Section applies only to tuition for a term or

14 Section 10. The Southern Illinois University Management
15 Act is amended by adding Section 8d-5 as follows:
16 (110 ILCS 520/8d-5 new)
17 Sec. 8d-5. In-state tuition charge.
18 (a) Notwithstanding any other provision of law to the
19 contrary, for tuition purposes, the Board shall deem an
20 individual an Illinois resident, until the individual
21 establishes a residence outside of this State, if all of the
22 following conditions are met:
23 (1) The individual resided with his or her parent
24 or guardian while attending a public or private high
25 school in this State.
26 (2) The individual graduated from a public or
27 private high school or received the equivalent of a high
28 school diploma in this State.
29 (3) The individual attended school in this State
30 for at least 3 years as of the date the individual
31 graduated from high school or received the equivalent of
32 a high school diploma.
