1 AN ACT concerning agriculture.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois AgriFIRST Program Act of 2001 is
5 amended by changing Section 5 as follows:
6 (505 ILCS 19/5)
7 Sec. 5. Definitions. In this Act:
8 "Agribusiness" means any sole proprietorship, limited
9 partnership, co-partnership, joint venture, corporation, or
10 cooperative that operates or will operate a facility located
11 within the State of Illinois that is related to the
12 processing of agricultural commodities (including, but not
13 limited to, the products of aquaculture, hydroponics, and
14 silviculture) or the manufacturing, production, or
15 construction of agricultural buildings, structures,
16 equipment, implements, and supplies, or any other facilities
17 or processes used in agricultural production. "Agribusiness"
18 includes but is not limited to the following:
19 (1) grain handling and processing, including grain
20 storage, drying, treatment, conditioning, milling, and
21 packaging;
22 (2) seed and feed grain development and processing;
23 (3) fruit and vegetable processing, including
24 preparation, canning, and packaging;
25 (4) processing of livestock and livestock products,
26 dairy products, poultry and poultry products, fish or
27 apiarian products, including slaughter, shearing,
28 collecting, preparation, canning, and packaging;
29 (5) fertilizer and agricultural chemical
30 manufacturing, processing, application and supplying;
31 (6) farm machinery, equipment, and implement

1 manufacturing and supplying;
2 (7) manufacturing and supplying of agricultural
3 commodity processing machinery and equipment, including
4 machinery and equipment used in slaughter, treatment,
5 handling, collecting, preparation, canning, or packaging
6 of agricultural commodities;
7 (8) farm building and farm structure manufacturing,
8 construction, and supplying;
9 (9) construction, manufacturing, implementation,
10 supplying, or servicing of irrigation, drainage, and soil
11 and water conservation devices or equipment;
12 (10) fuel processing and development facilities
13 that produce fuel from agricultural commodities or
14 by-products;
15 (11) facilities and equipment for processing and
16 packaging agricultural commodities specifically for
17 export;
18 (12) facilities and equipment for forestry product
19 processing and supplying, including sawmilling
20 operations, wood chip operations, timber harvesting
21 operations, and manufacturing of prefabricated buildings,
22 paper, furniture, or other goods from forestry products;
23 and
24 (13) facilities and equipment for research and
25 development of products, processes, and equipment for the
26 production, processing, preparation, or packaging of
27 agricultural commodities and by-products.
28 "Agricultural facility" means land, any building or other
29 improvement on or to land, and any personal properties deemed
30 necessary or suitable for use, whether or not now in
31 existence, in farming, ranching, the production of
32 agricultural commodities (including, but not limited to, the
33 products of aquaculture, hydroponics, and silviculture) or
34 the treating, processing, or storing of agricultural

1 commodities.
2 "Agricultural land" means land suitable for agriculture
3 production.
4 "Asset" includes, but is not limited to, the following:
5 cash crops or feed on hand; livestock held for sale; breeding
6 stock; marketable bonds and securities; securities not
7 readily marketable; accounts receivable; notes receivable;
8 cash invested in growing crops; net cash value of life
9 insurance; machinery and equipment; cars and trucks; farm and
10 other real estate including life estates and personal
11 residence; value of beneficial interest in trusts; government
12 payments or grants; and any other assets.
13 "Department" means the Department of Agriculture.
14 "Director" means the Director of Agriculture.
15 "Fund" means the Illinois AgriFIRST Program Fund.
16 "Grantee" means the person or entity to whom a grant is
17 made to from the Fund.
18 "Lender" means any federal or State chartered bank,
19 federal land bank, production credit association, bank for
20 cooperatives, federal or state chartered savings and loan
21 association or building and loan association, small business
22 investment company, or any other institution qualified within
23 this State to originate and service loans, including, but not
24 limited to, insurance companies, credit unions, and mortgage
25 loan companies. "Lender" includes a wholly owned subsidiary
26 of a manufacturer, seller or distributor of goods or services
27 that makes loans to businesses or individuals, commonly known
28 as a "captive finance company".
29 "Liability" includes, but is not limited to, the
30 following: accounts payable; notes or other indebtedness owed
31 to any source; taxes; rent; amounts owed on real estate
32 contracts or real estate mortgages; judgments; accrued
33 interest payable; and any other liability.
34 "Person" means, unless limited to a natural person by the

1 context in which it is used, a person, corporation,
2 association, trust, partnership, limited partnership, joint
3 venture, or cooperative.
4 "Research" means activities related to feasibility
5 studies and technical assistance for the purpose of adding
6 commercial value to agricultural commodities.
7 "State" means the State of Illinois.
8 "Value-added" means the processing, packaging, or
9 otherwise enhancing the value of farm and agricultural
10 products or by-products produced in Illinois.
