AMENDMENT TO HOUSE BILL 834

2     AMENDMENT NO. ______. Amend House Bill 834 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Municipal Code is amended by
5 adding Section 11-1-8a as follows:
 
6     (65 ILCS 5/11-1-8a new)
7     Sec. 11-1-8a. Agreements with school districts concerning
8 truancy. The corporate authorities of each municipality may
9 enter into agreements and cooperate with a school district for
10 purposes related to the enforcement of the provisions of
11 Article 26 of the School Code.
 
12     Section 10. The School Code is amended by changing Sections
13 26-2a and 26-5 as follows:
 
14     (105 ILCS 5/26-2a)  (from Ch. 122, par. 26-2a)
15     Sec. 26-2a. A "truant" is defined as a child subject to
16 compulsory school attendance and who is absent without valid
17 cause from such attendance for a school day or portion thereof.
18     "Valid cause" for absence shall be illness, observance of a
19 religious holiday, death in the immediate family, family
20 emergency, and shall include such other situations beyond the
21 control of the student as determined by the board of education
22 in each district, or such other circumstances which cause

1 reasonable concern to the parent for the safety or health of
2 the student.
3     "Chronic or habitual truant" shall be defined as a child
4 subject to compulsory school attendance and who is absent
5 without valid cause from such attendance for 10% or more of the
6 previous 180 regular attendance days.
7     "Truant minor" is defined as a chronic truant to whom
8 supportive services, including prevention, diagnostic,
9 intervention and remedial services, alternative programs and
10 other school and community resources have been provided and
11 have failed to result in the cessation of chronic truancy, or
12 have been offered and refused.
13     "Truant officer" means any person designated as the truant
14 officer of a school district or a county or any person
15 designated as a truant officer in accordance with an agreement
16 between a municipality and a school district under Section
17 11-1-8a of the Illinois Municipal Code.
18     A "dropout" is defined as any child enrolled in grades 1
19 through 12 whose name has been removed from the district
20 enrollment roster for any reason other than his death, extended
21 illness, graduation or completion of a program of studies and
22 who has not transferred to another public or private school.
23     "Religion" for the purposes of this Article, includes all
24 aspects of religious observance and practice, as well as
25 belief.

28     Sec. 26-5. Duties of truant officers.
29     The truant officer of the school district or any other
30 person designated as a truant officer in accordance with an
31 agreement between a municipality and a school district under
32 Section 11-1-8a of the Illinois Municipal Code, whenever
33 notified by the Superintendent, teacher, or other person of

1 violations of this Article, or the county truant officer, when
2 notified by the County Superintendent, shall investigate all
3 cases of truancy or non-attendance at school in their
4 respective jurisdictions, and if the children complained of are
5 not exempt under the provisions of this Article, the truant
6 officer shall proceed as is provided in this Article. The
7 county truant officer, within the county and the district
8 truant officers, within their respective districts, shall in
9 the exercise of their duties be conservators of the peace and
10 shall keep the same, suppress riots, routs, affray, fighting,
11 breaches of the peace, and prevent crime; and may arrest
12 offenders on view and cause them to be brought before proper
13 officials for trial or examination.

15     Section 99. Effective date. This Act takes effect upon
16 becoming law.".
