AMENDMENT TO HOUSE BILL 929

2     AMENDMENT NO. ______. Amend House Bill 929 by replacing
3 everything after the enacting clause with the following:
4     "Section 5. The State Employees Group Insurance Act of 1971
5 is amended by changing Sections 6.5 and 6.6 as follows:
 
6     (5 ILCS 375/6.5)
7     (Section scheduled to be repealed on July 1, 2004)
8     Sec. 6.5. Health benefits for TRS benefit recipients and
9 TRS dependent beneficiaries.
10     (a) Purpose. It is the purpose of this amendatory Act of
11 1995 to transfer the administration of the program of health
12 benefits established for benefit recipients and their
13 dependent beneficiaries under Article 16 of the Illinois
14 Pension Code to the Department of Central Management Services.
15     (b) Transition provisions. The Board of Trustees of the
16 Teachers' Retirement System shall continue to administer the
17 health benefit program established under Article 16 of the
18 Illinois Pension Code through December 31, 1995. Beginning
19 January 1, 1996, the Department of Central Management Services
20 shall be responsible for administering a program of health
21 benefits for TRS benefit recipients and TRS dependent
22 beneficiaries under this Section. The Department of Central
23 Management Services and the Teachers' Retirement System shall
24 cooperate in this endeavor and shall coordinate their

1 activities so as to ensure a smooth transition and
2 uninterrupted health benefit coverage.
3     (c) Eligibility. All persons who were enrolled in the
4 Article 16 program at the time of the transfer shall be
5 eligible to participate in the program established under this
6 Section without any interruption or delay in coverage or
7 limitation as to pre-existing medical conditions. Eligibility
8 to participate shall be determined by the Teachers' Retirement
9 System. Eligibility information shall be communicated to the
10 Department of Central Management Services in a format
11 acceptable to the Department.
12     A TRS dependent beneficiary who is an unmarried child age
13 19 or over and mentally or physically disabled handicapped does
14 not become ineligible to participate by reason of (i) becoming
15 ineligible to be claimed as a dependent for Illinois or federal
16 income tax purposes or (ii) receiving earned income, so long as
17 those earnings are insufficient for the child to be fully
18 self-sufficient.
19     (d) Coverage. The level of health benefits provided under
20 this Section shall be similar to the level of benefits provided
21 by the program previously established under Article 16 of the
22 Illinois Pension Code.
23     Group life insurance benefits are not included in the
24 benefits to be provided to TRS benefit recipients and TRS
25 dependent beneficiaries under this Act.
26     The program of health benefits under this Section may
27 include any or all of the benefit limitations, including but
28 not limited to a reduction in benefits based on eligibility for
29 federal medicare benefits, that are provided under subsection
30 (a) of Section 6 of this Act for other health benefit programs
31 under this Act.
32     (e) Insurance rates and premiums. The Director shall
33 determine the insurance rates and premiums for TRS benefit
34 recipients and TRS dependent beneficiaries, and shall present

1 to the Teachers' Retirement System of the State of Illinois, by
2 April 15 of each calendar year, the rate-setting methodology
3 (including but not limited to utilization levels and costs)
4 used to determine the amount of the health care premiums.
5         For Fiscal Year 1996, the premium shall be equal to the
6     premium actually charged in Fiscal Year 1995; in subsequent
7     years, the premium shall never be lower than the premium
8     charged in Fiscal Year 1995.
9         For Fiscal Year 2003, the premium shall not exceed 110%
10     of the premium actually charged in Fiscal Year 2002.
11         For Fiscal Year 2004, the premium shall not exceed 112%
12     of the premium actually charged in Fiscal Year 2003.
13         For Fiscal Year 2005, the premium shall not exceed a
14     weighted average of 106.6% of the premium actually charged
15     in Fiscal Year 2004.
16         For Fiscal Year 2006, the premium shall not exceed a
17     weighted average of 109.1% of the premium actually charged
18     in Fiscal Year 2005.
19         For Fiscal Year 2007, the premium shall not exceed a
20     weighted average of 103.9% of the premium actually charged
21     in Fiscal Year 2006.
22         For Fiscal Year 2008 and thereafter, the premium in
23     each fiscal year shall not exceed 105% of the premium
24     actually charged in the previous fiscal year.
25     Rates and premiums may be based in part on age and
26 eligibility for federal medicare coverage. However, the cost of
27 participation for a TRS dependent beneficiary who is an
28 unmarried child age 19 or over and mentally or physically
29 disabled handicapped shall not exceed the cost for a TRS
30 dependent beneficiary who is an unmarried child under age 19
31 and participates in the same major medical or managed care
32 program.
33     The cost of health benefits under the program shall be paid
34 as follows:

1         (1) For a TRS benefit recipient selecting a managed
2     care program, up to 75% of the total insurance rate shall
3     be paid from the Teacher Health Insurance Security Fund.
4     Effective with Fiscal Year 2007 and thereafter, for a TRS
5     benefit recipient selecting a managed care program, 75% of
6     the total insurance rate shall be paid from the Teacher
7     Health Insurance Security Fund.
8         (2) For a TRS benefit recipient selecting the major
9     medical coverage program, up to 50% of the total insurance
10     rate shall be paid from the Teacher Health Insurance
11     Security Fund if a managed care program is accessible, as
12     determined by the Teachers' Retirement System. Effective
13     with Fiscal Year 2007 and thereafter, for a TRS benefit
14     recipient selecting the major medical coverage program,
15     50% of the total insurance rate shall be paid from the
16     Teacher Health Insurance Security Fund if a managed care
17     program is accessible, as determined by the Department of
18     Central Management Services.
19         (3) For a TRS benefit recipient selecting the major
20     medical coverage program, up to 75% of the total insurance
21     rate shall be paid from the Teacher Health Insurance
22     Security Fund if a managed care program is not accessible,
23     as determined by the Teachers' Retirement System.
24     Effective with Fiscal Year 2007 and thereafter, for a TRS
25     benefit recipient selecting the major medical coverage
26     program, 75% of the total insurance rate shall be paid from
27     the Teacher Health Insurance Security Fund if a managed
28     care program is not accessible, as determined by the
29     Department of Central Management Services.
30         (3.1) For a TRS dependent beneficiary who is Medicare
31     primary and enrolled in a managed care plan, or the major
32     medical coverage program if a managed care plan is not
33     available, 25% of the total insurance rate shall be paid
34     from the Teacher Health Security Fund as determined by the

1     Department of Central Management Services. For the purpose
2     of this item (3.1), the term "TRS dependent beneficiary who
3     is Medicare primary" means a TRS dependent beneficiary who
4     is participating in Medicare Parts A and B.
5         (4) Except as otherwise provided in item (3.1), the The
6     balance of the rate of insurance, including the entire
7     premium of any coverage for TRS dependent beneficiaries
8     that has been elected, shall be paid by deductions
9     authorized by the TRS benefit recipient to be withheld from
10     his or her monthly annuity or benefit payment from the
11     Teachers' Retirement System; except that (i) if the balance
12     of the cost of coverage exceeds the amount of the monthly
13     annuity or benefit payment, the difference shall be paid
14     directly to the Teachers' Retirement System by the TRS
15     benefit recipient, and (ii) all or part of the balance of
16     the cost of coverage may, at the school board's option, be
17     paid to the Teachers' Retirement System by the school board
18     of the school district from which the TRS benefit recipient
19     retired, in accordance with Section 10-22.3b of the School
20     Code. The Teachers' Retirement System shall promptly
21     deposit all moneys withheld by or paid to it under this
22     subdivision (e)(4) into the Teacher Health Insurance
23     Security Fund. These moneys shall not be considered assets
24     of the Retirement System.
25     (f) Financing. Beginning July 1, 1995, all revenues arising
26 from the administration of the health benefit programs
27 established under Article 16 of the Illinois Pension Code or
28 this Section shall be deposited into the Teacher Health
29 Insurance Security Fund, which is hereby created as a
30 nonappropriated trust fund to be held outside the State
31 Treasury, with the State Treasurer as custodian. Any interest
32 earned on moneys in the Teacher Health Insurance Security Fund
33 shall be deposited into the Fund.
34     Moneys in the Teacher Health Insurance Security Fund shall

1 be used only to pay the costs of the health benefit program
2 established under this Section, including associated
3 administrative costs, and the costs associated with the health
4 benefit program established under Article 16 of the Illinois
5 Pension Code, as authorized in this Section. Beginning July 1,
6 1995, the Department of Central Management Services may make
7 expenditures from the Teacher Health Insurance Security Fund
8 for those costs.
9     After other funds authorized for the payment of the costs
10 of the health benefit program established under Article 16 of
11 the Illinois Pension Code are exhausted and until January 1,
12 1996 (or such later date as may be agreed upon by the Director
13 of Central Management Services and the Secretary of the
14 Teachers' Retirement System), the Secretary of the Teachers'
15 Retirement System may make expenditures from the Teacher Health
16 Insurance Security Fund as necessary to pay up to 75% of the
17 cost of providing health coverage to eligible benefit
18 recipients (as defined in Sections 16-153.1 and 16-153.3 of the
19 Illinois Pension Code) who are enrolled in the Article 16
20 health benefit program and to facilitate the transfer of
21 administration of the health benefit program to the Department
22 of Central Management Services.
23     (g) Contract for benefits. The Director shall by contract,
24 self-insurance, or otherwise make available the program of
25 health benefits for TRS benefit recipients and their TRS
26 dependent beneficiaries that is provided for in this Section.
27 The contract or other arrangement for the provision of these
28 health benefits shall be on terms deemed by the Director to be
29 in the best interest of the State of Illinois and the TRS
30 benefit recipients based on, but not limited to, such criteria
31 as administrative cost, service capabilities of the carrier or
32 other contractor, and the costs of the benefits.
33     (g-5) Committee. A Teacher Retirement Insurance Program
34 Committee shall be established, to consist of 10 persons

1 appointed by the Governor.
2     The Committee shall convene at least 4 times each year, and
3 shall consider and make recommendations on issues affecting the
4 program of health benefits provided under this Section.
5 Recommendations of the Committee shall be based on a consensus
6 of the members of the Committee.
7     If the Teacher Health Insurance Security Fund experiences a
8 deficit balance based upon the contribution and subsidy rates
9 established in this Section and Section 6.6 for Fiscal Year
10 2008 or thereafter, the Committee shall make recommendations
11 for adjustments to the funding sources established under these
12 Sections.
13     (h) Continuation and termination of program. It is the
14 intention of the General Assembly that the program of health
15 benefits provided under this Section be maintained on an
16 ongoing, affordable basis. through June 30, 2004. The program
17 of health benefits provided under this Section is terminated on
18 July 1, 2004.
19     The program of health benefits provided under this Section
20 may be amended by the State and is not intended to be a pension
21 or retirement benefit subject to protection under Article XIII,
22 Section 5 of the Illinois Constitution.
23     (i) Repeal. (Blank). This Section is repealed on July 1,
24 2004.

29     Sec. 6.6. Contributions to the Teacher Health Insurance
30 Security Fund.
31     (a) Beginning July 1, 1995, all active contributors of the
32 Teachers' Retirement System (established under Article 16 of
33 the Illinois Pension Code) who are not employees of a

1 department as defined in Section 3 of this Act shall make
2 contributions toward the cost of annuitant and survivor health
3 benefits. These contributions shall be at the following rates:
4 until January 1, 2002, 0.5% of salary; beginning January 1,
5 2002, 0.65% of salary; beginning July 1, 2003, 0.75% of salary;
6 beginning July 1, 2005, 0.80% of salary; beginning July 1,
7 2007, a percentage of salary to be determined by the Department
8 of Central Management Services by rule, which in each fiscal
9 year shall not exceed 105% of the percentage of salary actually
10 required to be paid in the previous fiscal year.
11     These contributions shall be deducted by the employer and
12 paid to the System as service agent for the Department of
13 Central Management Services. The System may use the same
14 processes for collecting the contributions required by this
15 subsection that it uses to collect contributions received from
16 school districts and other covered employers under Sections
17 16-154 and 16-155 of the Illinois Pension Code.
18     An employer may agree to pick up or pay the contributions
19 required under this subsection on behalf of the teacher; such
20 contributions shall be deemed to have to have been paid by the
21 teacher. Beginning January 1, 2002, if the employer does not
22 directly pay the required member contribution, then the
23 employer shall reduce the member's salary by an amount equal to
24 the required contribution and shall then pay the contribution
25 on behalf of the member. This reduction shall not change the
26 amounts reported as creditable earnings to the Teachers'
27 Retirement System.
28     A person who purchases optional service credit under
29 Article 16 of the Illinois Pension Code for a period after June
30 30, 1995 must also make a contribution under this subsection
31 for that optional credit, at the rate provided in subsection
32 (a), based on the salary used in computing the optional service
33 credit, plus interest on this employee contribution. This
34 contribution shall be collected by the System as service agent

1 for the Department of Central Management Services. The
2 contribution required under this subsection for the optional
3 service credit must be paid in full before any annuity based on
4 that credit begins.
5     (a-5) Beginning January 1, 2002, every employer of a
6 teacher (other than an employer that is a department as defined
7 in Section 3 of this Act) shall pay an employer contribution
8 toward the cost of annuitant and survivor health benefits.
9 These contributions shall be computed as follows:
10         (1) Beginning January 1, 2002 through June 30, 2003,
11     the employer contribution shall be equal to 0.4% of each
12     teacher's salary.
13         (2) Beginning July 1, 2003, the employer contribution
14     shall be equal to 0.5% of each teacher's salary.
15         (3) Beginning July 1, 2005, the employer contribution
16     shall be equal to 0.6% of each teacher's salary.
17         (4) Beginning July 1, 2007, the employer contribution
18     shall be a percentage of each teacher's salary to be
19     determined by the Department of Central Management
20     Services by rule, which in each fiscal year shall not
21     exceed 105% of the percentage of each teacher's salary
22     actually required to be paid in the previous fiscal year.
23     These contributions shall be paid by the employer to the
24 System as service agent for the Department of Central
25 Management Services. The System may use the same processes for
26 collecting the contributions required by this subsection that
27 it uses to collect contributions received from school districts
28 and other covered employers under the Illinois Pension Code.
29     The school district or other employing unit may pay these
30 employer contributions out of any source of funding available
31 for that purpose and shall forward the contributions to the
32 System on the schedule established for the payment of member
33 contributions.
34     (b) The Teachers' Retirement System shall promptly deposit

1 all moneys collected under subsections (a) and (a-5) of this
2 Section into the Teacher Health Insurance Security Fund created
3 in Section 6.5 of this Act. The moneys collected under this
4 Section shall be used only for the purposes authorized in
5 Section 6.5 of this Act and shall not be considered to be
6 assets of the Teachers' Retirement System. Contributions made
7 under this Section are not transferable to other pension funds
8 or retirement systems and are not refundable upon termination
9 of service.
10     (c) On or before November 15 of each year, the Board of
11 Trustees of the Teachers' Retirement System shall certify to
12 the Governor, the Director of Central Management Services, and
13 the State Comptroller its estimate of the total amount of
14 contributions to be paid under subsection (a) of this Section
15 6.6 for the next fiscal year. The amount certified shall be
16 decreased or increased each year by the amount that the actual
17 active teacher contributions either fell short of or exceeded
18 the estimate used by the Board in making the certification for
19 the previous fiscal year. The certification shall include a
20 detailed explanation of the methods and information that the
21 Board relied upon in preparing its estimate. As soon as
22 possible after the effective date of this amendatory Act of the
23 92nd General Assembly, the Board shall recalculate and
24 recertify its certifications for fiscal years 2002 and 2003.
25     (d) Beginning in fiscal year 1996, on the first day of each
26 month, or as soon thereafter as may be practical, the State
27 Treasurer and the State Comptroller shall transfer from the
28 General Revenue Fund to the Teacher Health Insurance Security
29 Fund 1/12 of the annual amount appropriated for that fiscal
30 year to the State Comptroller for deposit into the Teacher
31 Health Insurance Security Fund under Section 1.3 of the State
32 Pension Funds Continuing Appropriation Act.
33     (e) Except where otherwise specified in this Section, the
34 definitions that apply to Article 16 of the Illinois Pension

1 Code apply to this Section.
2     (f) (Blank). This Section is repealed on July 1, 2004.

4     Section 10. The State Pension Funds Continuing
5 Appropriation Act is amended by changing Section 1.3 as
6 follows:
 
7     (40 ILCS 15/1.3)
8     Sec. 1.3. Appropriations for the Teacher Health Insurance
9 Security Fund. Beginning in State fiscal year 1996, there is
10 hereby appropriated, on a continuing annual basis, from the
11 General Revenue Fund to the State Comptroller for deposit into
12 the Teacher Health Insurance Security Fund, an amount equal to
13 the amount certified by the Board of Trustees of the Teachers'
14 Retirement System of Illinois under subsection (c) of Section
15 6.6 of the State Employees Group Insurance Act of 1971 as the
16 estimated total amount of contributions to be paid under
17 subsection (a) of that Section 6.6 in that fiscal year.
18     In addition to any other amounts that may be appropriated
19 for this purpose, in State fiscal years 2005 through 2007,
20 there is hereby appropriated, on a continuing annual basis,
21 from the General Revenue Fund to the State Comptroller for
22 deposit into the Teacher Health Insurance Security Fund, an
23 amount equal to $13,000,000 in each fiscal year.
24     The moneys appropriated under this Section 1.3 shall be
25 deposited into the Teacher Health Insurance Security Fund and
26 used only for the purposes authorized in Section 6.5 of the
27 State Employees Group Insurance Act of 1971.

29     Section 15. The School Code is amended by changing Sections
30 2-3.11, 21-1a, 21-1b, 21-2, 21-7.1, 21-9, 21-12, 21-14, 21-16,
31 21-17, 21-18, and 21-23 as follows:

1     (105 ILCS 5/2-3.11)  (from Ch. 122, par. 2-3.11)
2     Sec. 2-3.11. Report to Governor and General Assembly. To
3 report to the Governor and General Assembly annually on or
4 before January 14 the condition of the schools of the State for
5 the preceding year, ending on June 30.
6     Such annual report shall contain reports of the State
7 Teacher Certification Board; the schools of the State
8 charitable institutions; reports on driver education, special
9 education, and transportation; and for such year the annual
10 statistical reports of the State Board of Education, including
11 the number and kinds of school districts; number of school
12 attendance centers; number of men and women teachers;
13 enrollment by grades; total enrollment; total days attendance;
14 total days absence; average daily attendance; number of
15 elementary and secondary school graduates; assessed valuation;
16 tax levies and tax rates for various purposes; amount of
17 teachers' orders, anticipation warrants, and bonds
18 outstanding; and number of men and women teachers and total
19 enrollment of private schools. The report shall give for all
20 school districts receipts from all sources and expenditures for
21 all purposes for each fund; the total operating expense, and
22 the per capita cost, and instructional expenditures; federal
23 and state aids and reimbursements; new school buildings, and
24 recognized schools; together with such other information and
25 suggestions as the State Board of Education may deem important
26 in relation to the schools and school laws and the means of
27 promoting education throughout the state.
28     In this Section, "instructional expenditures" means the
29 annual expenditures of school districts properly attributable
30 to expenditure functions defined in rules of the State Board of
31 Education as: 1100 (Regular Education); 1200-1220 (Special
32 Education); 1250 (Ed. Deprived/Remedial); 1400 (Vocational
33 Programs); 1600 (Summer School); 1650 (Gifted); 1800

1 (Bilingual Programs); 1900 (Truant Alternative); 2110
2 (Attendance and Social Work Services); 2120 (Guidance

5 2190 (Other Support Services Pupils); 2210 (Improvement of
6 Instruction); 2220 (Educational Media Services); 2230

16     (105 ILCS 5/21-1a)  (from Ch. 122, par. 21-1a)
17     Sec. 21-1a. Tests required for certification and teacher
18 preparation.
19     (a) After July 1, 1988, in addition to all other
20 requirements, early childhood, elementary, special, high
21 school, school service personnel, or, except as provided in
22 Section 34-6, administrative certificates shall be issued to
23 persons who have satisfactorily passed a test of basic skills
24 and subject matter knowledge. A person who holds a valid and
25 comparable out-of-state certificate, however, is not required
26 to take a test of basic skills and is not required to take a
27 test of subject matter knowledge, provided that the person has
28 successfully passed a test of subject matter knowledge in
29 another State or territory of the United States that is
30 directly related in content to the specific subject area of
31 certification. The tests of basic skills and subject matter
32 knowledge shall be the tests which from time to time are
33 designated by the State Board of Education in consultation with

1 the State Teacher Certification Board and may be tests prepared
2 by an educational testing organization or tests designed by the
3 State Board of Education in consultation with the State Teacher
4 Certification Board. The areas to be covered by the test of
5 basic skills shall include the basic skills of reading,
6 writing, grammar and mathematics. The test of subject matter
7 knowledge shall assess content knowledge in the specific
8 subject field. The tests shall be designed to be racially
9 neutral to assure that no person in taking the tests is thereby
10 discriminated against on the basis of race, color, national
11 origin or other factors unrelated to the person's ability to
12 perform as a certificated employee. The score required to pass
13 the tests of basic skills and subject matter knowledge shall be
14 fixed by the State Board of Education in consultation with the
15 State Teacher Certification Board. The tests shall be held not
16 fewer than 3 times a year at such time and place as may be
17 designated by the State Board of Education in consultation with
18 the State Teacher Certification Board.
19     (b) Except as provided in Section 34-6, the provisions of
20 subsection (a) of this Section shall apply equally in any
21 school district subject to Article 34, provided that the State
22 Board of Education shall determine which certificates issued
23 under Sections 34-8.1 and 34-83 prior to July 1, 1988 are
24 comparable to any early childhood certificate, elementary
25 school certificate, special certificate, high school
26 certificate, school service personnel certificate or
27 administrative certificate issued under this Article as of July
28 1, 1988.
29     (c) A person who holds an early childhood, elementary,
30 special, high school or school service personnel certificate
31 issued under this Article on or at any time before July 1,
32 1988, including a person who has been issued any such
33 certificate pursuant to Section 21-11.1 or in exchange for a
34 comparable certificate theretofore issued under Section 34-8.1

1 or Section 34-83, shall not be required to take or pass the
2 tests in order to thereafter have such certificate renewed.
3     (d) The State Board of Education in consultation with the
4 State Teacher Certification Board shall conduct a pilot
5 administration of the tests by administering the test to
6 students completing teacher education programs in the 1986-87
7 school year for the purpose of determining the effect and
8 impact of testing candidates for certification.
9     Beginning with the 2002-2003 academic year, a student may
10 not enroll in a teacher preparation program at a recognized
11 teacher training institution until he or she has passed the
12 basic skills test.
13     Beginning with the 2004-2005 academic year, a preservice
14 education teacher may not student teach until he or she has
15 passed the subject matter test in the discipline in which he or
16 she will student teach.
17     (e) The rules and regulations developed to implement the
18 required test of basic skills and subject matter knowledge
19 shall include the requirements of subsections (a), (b), and (c)
20 and shall include specific regulations to govern test
21 selection; test validation and determination of a passing
22 score; administration of the tests; frequency of
23 administration; applicant fees; frequency of applicants'
24 taking the tests; the years for which a score is valid; and,
25 waiving certain additional tests for additional certificates
26 to individuals who have satisfactorily passed the test of basic
27 skills and subject matter knowledge as required in subsection
28 (a). The State Board of Education shall provide, by rule,
29 specific policies that assure uniformity in the difficulty
30 level of each form of the basic skills test and each subject
31 matter knowledge test from test-to-test and year-to-year. The
32 State Board of Education shall also set a passing score for the
33 tests.
34     (f) The State Teacher Certification Board may issue a

1 nonrenewable temporary certificate between July 1, 1988 and
2 August 31, 1988 to individuals who have taken the tests of
3 basic skills and subject matter knowledge prescribed by this
4 Section but have not received such test scores by August 31,
5 1988. Such temporary certificates shall expire on December 31,
6 1988.
7     (g) Beginning February 15, 2000, the State Board of
8 Education, in consultation with the State Teacher
9 Certification Board, shall implement and administer a new
10 system of certification for teachers in the State of Illinois.
11 The State Board of Education, in consultation with the State
12 Teacher Certification Board, shall design and implement a
13 system of examinations and various other criteria which shall
14 be required prior to the issuance of Initial Teaching
15 Certificates and Standard Teaching Certificates. These
16 examinations and indicators shall be based on national and
17 State professional teaching standards, as determined by the
18 State Board of Education, in consultation with the State
19 Teacher Certification Board. The State Board of Education may
20 adopt any and all regulations necessary to implement and
21 administer this Section.
22     (h) The State Board of Education shall report to the
23 Illinois General Assembly and the Governor with
24 recommendations for further changes and improvements to the
25 teacher certification system no later than July 1, 1999 and on
26 an annual basis until July 1, 2001.

29     Sec. 21-1b. Subject endorsement on certificates. All
30 certificates initially issued under this Article after June 30,
31 1986, shall be specifically endorsed by the State Board of
32 Education for each subject the holder of the certificate is
33 legally qualified to teach, such endorsements to be made in

1 accordance with standards promulgated by the State Board of
2 Education in consultation with the State Teacher Certification
3 Board. All certificates which are issued under this Article
4 prior to July 1, 1986 may, by application to the State Board of
5 Education, be specifically endorsed for each subject the holder
6 is legally qualified to teach. Endorsements issued under this
7 Section shall not apply to substitute teacher's certificates
8 issued under Section 21-9 of this Code.
9     Commencing July 1, 1999, each application for endorsement
10 of an existing teaching certificate shall be accompanied by a
11 $30 nonrefundable fee. There is hereby created a Teacher
12 Certificate Fee Revolving Fund as a special fund within the
13 State Treasury. The proceeds of each $30 fee shall be paid into
14 the Teacher Certificate Fee Revolving Fund; and the moneys in
15 that Fund shall be appropriated and used to provide the
16 technology and other resources necessary for the timely and
17 efficient processing of certification requests.
18     The State Board of Education and each regional office of
19 education are authorized to charge a service or convenience fee
20 for the use of credit cards for the payment of certification
21 fees. This service or convenience fee may not exceed the amount
22 required by the credit card processing company or vendor that
23 has entered into a contract with the State Board or regional
24 office of education for this purpose, and the fee must be paid
25 to that company or vendor.

28     Sec. 21-2. Grades of certificates.
29     (a) All certificates issued under this Article shall be
30 State certificates valid, except as limited in Section 21-1, in
31 every school district coming under the provisions of this Act
32 and shall be limited in time and designated as follows:
33 Provisional vocational certificate, temporary provisional

1 vocational certificate, early childhood certificate,
2 elementary school certificate, special certificate, secondary
3 certificate, school service personnel certificate,
4 administrative certificate, provisional certificate, and
5 substitute certificate. The requirement of student teaching
6 under close and competent supervision for obtaining a teaching
7 certificate may be waived by the State Teacher Certification
8 Board upon presentation to the Board by the teacher of evidence
9 of 5 years successful teaching experience on a valid
10 certificate and graduation from a recognized institution of
11 higher learning with a bachelor's degree.
12     (b) Initial Teaching Certificate. Persons who (1) have
13 completed an approved teacher preparation program, (2) are
14 recommended by an approved teacher preparation program, (3)
15 have successfully completed the Initial Teaching Certification
16 examinations required by the State Board of Education, and (4)
17 have met all other criteria established by the State Board of
18 Education in consultation with the State Teacher Certification
19 Board, shall be issued an Initial Teaching Certificate valid
20 for 4 years of teaching, as defined in Section 21-14 of this
21 Code. Initial Teaching Certificates shall be issued for
22 categories corresponding to Early Childhood, Elementary,
23 Secondary, and Special K-12, with special certification
24 designations for Special Education, Bilingual Education,
25 fundamental learning areas (including Language Arts, Reading,
26 Mathematics, Science, Social Science, Physical Development and
27 Health, Fine Arts, and Foreign Language), and other areas
28 designated by the State Board of Education, in consultation
29 with the State Teacher Certification Board. Notwithstanding
30 any other provision of this Article, an Initial Teaching
31 Certificate shall be automatically extended for one year for
32 all persons who (i) have been issued an Initial Teaching
33 Certificate that expires on June 30, 2004 and (ii) have not
34 met, prior to July 1, 2004, the Standard Certificate

1 requirements under paragraph (c) of this Section. An
2 application and fee shall not be required for this extension.
3     (b-5) A person who holds an out-of-state certificate and
4 who is otherwise eligible for a comparable Illinois certificate
5 may be issued an Initial Certificate if that person has not
6 completed 4 years of teaching. Upon completion of 4 years of
7 teaching, the person is eligible for a Standard Certificate.
8 Beginning July 1, 2004, an out-of-state candidate who has
9 already earned a second-tier certificate in another state is
10 not subject to any Standard Certificate eligibility
11 requirements stated in paragraph (2) of subsection (c) of this
12 Section other than completion of the 4 years of teaching. An
13 out-of-state candidate who has completed less than 4 years of
14 teaching and does not hold a second-tier certificate from
15 another state must meet the requirements stated in paragraph
16 (2) of subsection (c) of this Section, proportionately reduced
17 by the amount of time remaining to complete the 4 years of
18 teaching.
19     (c) Standard Certificate.
20     (1) Persons who (i) have completed 4 years of teaching, as
21 defined in Section 21-14 of this Code, with an Initial
22 Certificate or an Initial Alternative Teaching Certificate and
23 have met all other criteria established by the State Board of
24 Education in consultation with the State Teacher Certification
25 Board, (ii) have completed 4 years of teaching on a valid
26 equivalent certificate in another State or territory of the
27 United States, or have completed 4 years of teaching in a
28 nonpublic Illinois elementary or secondary school with an
29 Initial Certificate or an Initial Alternative Teaching
30 Certificate, and have met all other criteria established by the
31 State Board of Education, in consultation with the State
32 Teacher Certification Board, or (iii) were issued teaching
33 certificates prior to February 15, 2000 and are renewing those
34 certificates after February 15, 2000, shall be issued a

1 Standard Certificate valid for 5 years, which may be renewed
2 thereafter every 5 years by the State Teacher Certification
3 Board based on proof of continuing education or professional
4 development. Beginning July 1, 2003, persons who have completed
5 4 years of teaching, as described in clauses (i) and (ii) of
6 this paragraph (1), have successfully completed the
7 requirements of paragraphs (2) through (4) of this subsection
8 (c), and have met all other criteria established by the State
9 Board of Education, in consultation with the State Teacher
10 Certification Board, shall be issued Standard Certificates.
11 Notwithstanding any other provisions of this Section,
12 beginning July 1, 2004, persons who hold valid out-of-state
13 certificates and have completed 4 years of teaching on a valid
14 equivalent certificate in another State or territory of the
15 United States shall be issued comparable Standard
16 Certificates. Beginning July 1, 2004, persons who hold valid
17 out-of-state certificates as described in subsection (b-5) of
18 this Section are subject to the requirements of paragraphs (2)
19 through (4) of this subsection (c), as required in subsection
20 (b-5) of this Section, in order to receive a Standard
21 Certificate. Standard Certificates shall be issued for
22 categories corresponding to Early Childhood, Elementary,
23 Secondary, and Special K-12, with special certification
24 designations for Special Education, Bilingual Education,
25 fundamental learning areas (including Language Arts, Reading,
26 Mathematics, Science, Social Science, Physical Development and
27 Health, Fine Arts, and Foreign Language), and other areas
28 designated by the State Board of Education, in consultation
29 with the State Teacher Certification Board.
30     (2) This paragraph (2) applies only to those persons
31 required to successfully complete the requirements of this
32 paragraph under paragraph (1) of this subsection (c). In order
33 to receive a Standard Teaching Certificate, a person must
34 satisfy one of the following requirements, which the person

1 must identify, in writing, as the requirement that the person
2 has chosen to satisfy to the responsible local professional
3 development committee established pursuant to subsection (f)
4 of Section 21-14 of this Code:
5         (A) Completion of a program of induction and mentoring
6     for new teachers that is based upon a specific plan
7     approved by the State Board of Education, in consultation
8     with the State Teacher Certification Board. Nothing in this
9     Section, however, prohibits an induction or mentoring
10     program from operating prior to approval. Holders of
11     Initial Certificates issued before September 1, 2007 must
12     complete, at a minimum, an approved one-year induction and
13     mentoring program. Holders of Initial Certificates issued
14     on or after September 1, 2007 must complete an approved
15     2-year induction and mentoring program. The plan must
16     describe the role of mentor teachers, the criteria and
17     process for their selection, and how all the following
18     components are to be provided:
19             (i) Assignment of a formally trained mentor
20         teacher to each new teacher for a specified period of
21         time, which shall be established by the employing
22         school or school district but shall be at least 2
23         school years in duration, provided that a mentor
24         teacher may not directly or indirectly participate in
25         the evaluation of a new teacher pursuant to Article 24A
26         of this Code or the evaluation procedure of the school.
27             (ii) Formal mentoring for each new teacher.
28             (iii) Support for each new teacher in relation to
29         the Illinois Professional Teaching Standards, the
30         content-area standards applicable to the new teacher's
31         area of certification, and any applicable local school
32         improvement and professional development plans.
33             (iv) Professional development specifically
34         designed to foster the growth of each new teacher's

1         knowledge and skills.
2             (v) Formative assessment that is based on the
3         Illinois Professional Teaching Standards and designed
4         to provide feedback to the new teacher and
5         opportunities for reflection on his or her
6         performance, which must not be used directly or
7         indirectly in any evaluation of a new teacher pursuant
8         to Article 24A of this Code or the evaluation procedure
9         of the school and which must include the activities
10         specified in clauses (B)(i), (B)(ii), and (B)(iii) of
11         this paragraph (2).
12             (vi) Assignment of responsibility for coordination
13         of the induction and mentoring program within each
14         school district participating in the program.
15         (B) Successful completion of 4 semester hours of
16     graduate-level coursework on the assessment of one's own
17     performance in relation to the Illinois Professional
18     Teaching Standards. The coursework must be approved by the
19     State Board of Education, in consultation with the State
20     Teacher Certification Board; must be offered either by an
21     institution of higher education, by such an institution in
22     partnership with a teachers' association or union or with a
23     regional office of education, or by another entity
24     authorized to issue college credit; and must include
25     demonstration of performance through all of the following
26     activities for each of the Illinois Professional Teaching
27     Standards:
28             (i) Observation, by the course instructor or
29         another experienced teacher, of the new teacher's
30         classroom practice (the observation may be recorded
31         for later viewing) for the purpose of identifying and
32         describing how the new teacher made content meaningful
33         for students; how the teacher motivated individuals
34         and the group and created an environment conducive to

1         positive social interactions, active learning, and
2         self-motivation; what instructional strategies the
3         teacher used to encourage students' development of
4         critical thinking, problem solving, and performance;

6         nonverbal, and visual communication techniques; and
7         how the teacher maintained standards of professional
8         conduct and provided leadership to improve students'
9         learning.
10             (ii) Review and analysis, by the course instructor
11         or another experienced teacher, of written
12         documentation (i.e., lesson plans, assignments,
13         assessment instruments, and samples of students' work)
14         prepared by the new teacher for at least 2 lessons. The
15         documentation must provide evidence of classroom
16         performance related to Illinois Professional Teaching
17         Standards 1 through 9, with an emphasis on how the
18         teacher used his or her understanding of students,
19         assessment data, and subject matter to decide on
20         learning goals; how the teacher designed or selected
21         activities and instructional materials and aligned
22         instruction to the relevant Illinois Learning
23         Standards; how the teacher adapted or modified
24         curriculum to meet individual students' needs; and how
25         the teacher sequenced instruction and designed or
26         selected student assessment strategies.
27             (iii) Demonstration of professional expertise on
28         the part of the new teacher in reflecting on his or her
29         practice, which was observed under clause (B)(i) of
30         this paragraph (2) and documented under clause (B)(ii)
31         of this paragraph (2), in terms of teaching strengths,
32         weaknesses, and implications for improvement according
33         to the Illinois Professional Teaching Standards.
34         (C) Successful completion of a minimum of 4 semester

1     hours of graduate-level coursework addressing preparation
2     to meet the requirements for certification by the National
3     Board for Professional Teaching Standards (NBPTS). The
4     coursework must be approved by the State Board of
5     Education, in consultation with the State Teacher
6     Certification Board, and must be offered either by an
7     institution of higher education, by such an institution in
8     partnership with a teachers' association or union or with a
9     regional office of education, or by another entity
10     authorized to issue college credit. The course must address
11     the 5 NBPTS Core Propositions and relevant standards
12     through such means as the following:
13             (i) Observation, by the course instructor or
14         another experienced teacher, of the new teacher's
15         classroom practice (the observation may be recorded
16         for later viewing) for the purpose of identifying and
17         describing how the new teacher made content meaningful
18         for students; how the teacher motivated individuals
19         and the group and created an environment conducive to
20         positive social interactions, active learning, and
21         self-motivation; what instructional strategies the
22         teacher used to encourage students' development of
23         critical thinking, problem solving, and performance;
24         how the teacher communicated using written, verbal,
25         nonverbal, and visual communication techniques; and
26         how the teacher maintained standards of professional
27         conduct and provided leadership to improve students'
28         learning.
29             (ii) Review and analysis, by the course instructor
30         or another experienced teacher, of written
31         documentation (i.e., lesson plans, assignments,
32         assessment instruments, and samples of students' work)
33         prepared by the new teacher for at least 2 lessons. The
34         documentation must provide evidence of classroom

1         performance, including how the teacher used his or her
2         understanding of students, assessment data, and
3         subject matter to decide on learning goals; how the
4         teacher designed or selected activities and

6         relevant Illinois Learning Standards; how the teacher
7         adapted or modified curriculum to meet individual
8         students' needs; and how the teacher sequenced
9         instruction and designed or selected student
10         assessment strategies.
11             (iii) Demonstration of professional expertise on
12         the part of the new teacher in reflecting on his or her
13         practice, which was observed under clause (C)(i) of
14         this paragraph (2) and documented under clause (C)(ii)
15         of this paragraph (2), in terms of teaching strengths,
16         weaknesses, and implications for improvement.
17         (C-5) Satisfactory completion of a minimum of 12
18     semester hours of graduate credit towards an advanced
19     degree in an education-related field from an accredited
20     institution of higher education.
21         (D) Receipt of an advanced degree from an accredited
22     institution of higher education in an education-related
23     field that is earned by a person either while he or she
24     holds an Initial Teaching Certificate or prior to his or
25     her receipt of that certificate , provided that at least 8
26     semester hours of the coursework completed count toward a
27     degree, certificate, or endorsement in a teaching field.
28         (E) Accumulation of 60 continuing professional
29     development units (CPDUs), earned by completing selected
30     activities that comply with paragraphs (3) and (4) of this
31     subsection (c). However, for an individual who holds an
32     Initial Teaching Certificate on the effective date of this
33     amendatory Act of the 92nd General Assembly, the number of
34     CPDUs shall be reduced to reflect the teaching time

1     remaining on the Initial Teaching Certificate.
2         (F) Completion of a nationally normed,
3     performance-based assessment, if made available by the
4     State Board of Education in consultation with the State
5     Teacher Certification Board, provided that the cost to the
6     person shall not exceed the cost of the coursework
7     described in clause (B) of this paragraph (2).
8         (G) Completion of requirements for meeting the
9     Illinois criteria for becoming "highly qualified" (for
10     purposes of the No Child Left Behind Act of 2001, Public
11     Law 107-110) in an additional teaching area.
12         (H) Receipt of a minimum 12-hour, post-baccalaureate,
13     education-related professional development certificate
14     issued by an Illinois institution of higher education and
15     developed in accordance with rules adopted by the State
16     Board of Education in consultation with the State Teacher
17     Certification Board.
18         (I) Completion of the National Board for Professional
19     Teaching Standards (NBPTS) process.
20         (J) Receipt of a subsequent Illinois certificate or
21     endorsement pursuant to Article 21 of this Code.
22     (3) This paragraph (3) applies only to those persons
23 required to successfully complete the requirements of this
24 paragraph under paragraph (1) of this subsection (c). Persons
25 who seek to satisfy the requirements of clause (E) of paragraph
26 (2) of this subsection (c) through accumulation of CPDUs may
27 earn credit At least one-half the CPDUs a person must accrue in
28 order to qualify for a Standard Teaching Certificate must be
29 earned through completion of coursework, workshops, seminars,
30 conferences, and other similar training events that are
31 pre-approved by the State Board of Education, in consultation
32 with the State Teacher Certification Board, for the purpose of
33 reflection on teaching practices in order to address all of the
34 Illinois Professional Teaching Standards necessary to obtain a

1 Standard Teaching Certificate. These activities must meet all
2 of the following requirements:
3         (A) Each activity must be designed to advance a
4     person's knowledge and skills in relation to one or more of
5     the Illinois Professional Teaching Standards or in
6     relation to the content-area standards applicable to the
7     teacher's field of certification.
8         (B) Taken together, the activities completed must
9     address each of the Illinois Professional Teaching
10     Standards as provided in clauses (B)(i), (B)(ii), and
11     (B)(iii) of paragraph (2) of this subsection (c).
12         (C) Each activity must be provided by an entity
13     approved by the State Board of Education, in consultation
14     with the State Teacher Certification Board, for this
15     purpose.
16         (D) Each activity, integral to its successful
17     completion, must require participants to demonstrate the
18     degree to which they have acquired new knowledge or skills,
19     such as through performance, through preparation of a
20     written product, through assembling samples of students'
21     or teachers' work, or by some other means that is
22     appropriate to the subject matter of the activity.
23         (E) One CPDU shall be available for each hour of direct
24     participation by a holder of an Initial Teaching
25     Certificate in a qualifying activity. An activity may be
26     attributed to more than one of the Illinois Professional
27     Teaching Standards, but credit for any activity shall be
28     counted only once.
29     (4) This paragraph (4) applies only to those persons
30 required to successfully complete the requirements of this
31 paragraph under paragraph (1) of this subsection (c). Persons
32 who seek to satisfy the requirements of clause (E) of paragraph
33 (2) of this subsection (c) through accumulation of CPDUs may
34 earn credit from the following, provided that each activity is

1 designed to advance a person's knowledge and skills in relation
2 to one or more of the Illinois Professional Teaching Standards
3 or in relation to the content-area standards applicable to the
4 person's field or fields of certification The balance of the
5 CPDUs a person must accrue in order to qualify for a Standard
6 Teaching Certificate, in combination with those earned
7 pursuant to paragraph (3) of this subsection (c), may be chosen
8 from among the following, provided that an activity listed in
9 clause (C) of this paragraph (4) shall be creditable only if
10 its provider is approved for this purpose by the State Board of
11 Education, in consultation with the State Teacher
12 Certification Board:
13         (A) Collaboration and partnership activities related
14     to improving a person's knowledge and skills as a teacher,
15     including all of the following:
16             (i) Peer review and coaching.
17             (ii) Mentoring in a formal mentoring program,
18         including service as a consulting teacher
19         participating in a remediation process formulated
20         under Section 24A-5 of this Code.
21             (iii) Facilitating parent education programs
22         directly related to student achievement for a school,
23         school district, or regional office of education.
24             (iv) Participating in business, school, or
25         community partnerships directly related to student
26         achievement.
27         (B) Teaching college or university courses in areas
28     relevant to a teacher's field of certification, provided
29     that the teaching may only be counted once during the
30     course of 4 years.
31         (C) Conferences, workshops, institutes, seminars, and
32     symposiums related to improving a person's knowledge and
33     skills as a teacher, including all of the following:
34             (i) Completing non-university credit directly

1         related to student achievement, the Illinois
2         Professional Teaching Standards, or content-area
3         standards.
4             (ii) Participating in or presenting at workshops,
5         seminars, conferences, institutes, and symposiums.
6             (iii) (Blank). Training as external reviewers for
7         the State Board of Education.
8             (iv) Training as reviewers of university teacher
9         preparation programs.
10         An activity listed in this clause (C) is creditable
11     only if its provider is approved for this purpose by the
12     State Board of Education, in consultation with the State
13     Teacher Certification Board.
14         (D) Other educational experiences related to improving
15     a person's knowledge and skills as a teacher, including all
16     of the following:
17             (i) Participating in action research and inquiry
18         projects.
19             (ii) Observing programs or teaching in schools,
20         related businesses, or industry that is systematic,
21         purposeful, and relevant to a teacher's field of
22         certification.
23             (iii) Participating in study groups related to
24         student achievement, the Illinois Professional
25         Teaching Standards, or content-area standards.
26             (iv) Participating in work/learn programs or
27         internships.
28             (v) Developing a portfolio of students' and
29         teacher's work.
30         (E) Professional leadership experiences related to
31     improving a person's knowledge and skills as a teacher,
32     including all of the following:
33             (i) Participating in curriculum development or
34     assessment activities at the school, school district,

1     regional office of education, State, or national level.
2             (ii) Participating in team or department
3         leadership in a school or school district.
4             (iii) (Blank). Participating on external or
5         internal school or school district review teams.

7         books relevant to a teacher's field of certification.
8             (v) Participating in non-strike related activities
9         of a professional association or labor organization
10         that are related to professional development.
11     (5) A person must complete the requirements his or her
12 chosen requirement under paragraph (2) of this subsection (c)
13 before the expiration of his or her Initial Teaching
14 Certificate and must submit assurance evidence of having done
15 so to the regional superintendent of schools or a local
16 professional development committee authorized by the regional
17 superintendent to submit recommendations to him or her for this
18 purpose. Within 30 days after receipt of a person's evidence of
19 completion, the local professional development committee shall
20 forward the evidence of completion to the responsible regional
21 superintendent of schools along with the local professional
22 development committee's recommendation, based on that
23 evidence, as to whether the person is eligible to receive a
24 Standard Teaching Certificate. The local professional
25 development committee shall provide a copy of this
26 recommendation to the affected person.
27     Within 30 days after receipt, the The regional
28 superintendent of schools shall review the assurance evidence
29 of completion submitted by a person and, based upon compliance
30 with all of the requirements for receipt of a Standard Teaching
31 Certificate, shall forward to the State Board of Education a
32 recommendation for issuance of the Standard Certificate or
33 non-issuance. The regional superintendent of schools shall
34 notify the affected person if the recommendation is for

1 non-issuance of the Standard Certificate. A person who is
2 considered not to be eligible for a Standard Certificate and
3 who has received the notice of non-issuance may appeal this
4 determination to the Regional Professional Development Review
5 Committee (RPDRC). The recommendation of the regional
6 superintendent and the RPDRC, along with all supporting
7 materials, must then be forwarded to the State Board of
8 Education for a final determination of the recommendation
9 forwarded.
10     Upon review of a regional superintendent of school's
11 recommendations, the State Board of Education shall issue
12 Standard Teaching Certificates to those who qualify and shall
13 notify a person, in writing, of a decision denying a Standard
14 Teaching Certificate. Any decision denying issuance of a
15 Standard Teaching Certificate to a person may be appealed to
16 the State Teacher Certification Board.
17     (6) The State Board of Education, in consultation with the
18 State Teacher Certification Board, may adopt rules to implement
19 this subsection (c) and may periodically evaluate any of the
20 methods of qualifying for a Standard Teaching Certificate
21 described in this subsection (c).
22     (7) The changes made to paragraphs (1) through (5) of this
23 subsection (c) by this amendatory Act of the 93rd General
24 Assembly shall apply to those persons who hold or are eligible
25 to hold an Initial Certificate on or after the effective date
26 of this amendatory Act of the 93rd General Assembly and shall
27 be given effect upon their application for a Standard
28 Certificate.
29     (8) Beginning July 1, 2004, persons who hold a Standard
30 Certificate and have acquired one master's degree in an
31 education-related field are eligible for certificate renewal
32 upon completion of two-thirds of the continuing education units
33 specified in subdivision (C) of paragraph (3) of subsection (e)
34 of Section 21-14 of this Code or of the continuing professional

1 development units specified in subdivision (E) of paragraph (3)
2 of subsection (e) of Section 21-14 of this Code. Persons who
3 hold a Standard Certificate and have acquired a second master's
4 degree, an education specialist, or a doctorate in an
5 education-related field or hold a Master Certificate are
6 eligible for certificate renewal upon completion of one-third
7 of the continuing education units specified in subdivision (C)
8 of paragraph (3) of subsection (e) of Section 21-14 of this
9 Code or of the continuing professional development units
10 specified in subdivision (E) of paragraph (3) of subsection (e)
11 of Section 21-14 of this Code.
12     (d) Master Certificate. Persons who have successfully
13 achieved National Board certification through the National
14 Board for Professional Teaching Standards shall be issued a
15 Master Certificate, valid for 10 years and renewable thereafter
16 every 10 years through compliance with requirements set forth
17 by the State Board of Education, in consultation with the State
18 Teacher Certification Board. However, each teacher who holds a
19 Master Certificate shall be eligible for a teaching position in
20 this State in the areas for which he or she holds a Master
21 Certificate without satisfying any other requirements of this
22 Code, except for those requirements pertaining to criminal
23 background checks. A holder of a Master Certificate in an area
24 of science or social science is eligible to teach in any of the
25 subject areas within those fields, including those taught at
26 the advanced level, as defined by the State Board of Education
27 in consultation with the State Teacher Certification Board. A
28 teacher who holds a Master Certificate shall be deemed to meet
29 State certification renewal requirements in the area or areas
30 for which he or she holds a Master Certificate for the 10-year
31 term of the teacher's Master Certificate.

2     Sec. 21-7.1. Administrative certificate.
3     (a) After July 1, 1999, an administrative certificate valid
4 for 5 years of supervising and administering in the public
5 common schools (unless changed under subsection (a-5) of this
6 Section) may be issued to persons who have graduated from a
7 regionally accredited institution of higher learning with a
8 master's degree and who have been recommended by a recognized
9 institution of higher learning as having completed a program of
10 preparation for one or more of these endorsements. Such
11 programs of academic and professional preparation required for
12 endorsement shall be administered by the institution in
13 accordance with standards set forth by the State Superintendent
14 of Education in consultation with the State Teacher
15 Certification Board.
16     (a-5) Beginning July 1, 2003, if an administrative
17 certificate holder holds a Standard Teaching Certificate, the
18 validity period of the administrative certificate shall be
19 changed, if necessary, so that the validity period of the
20 administrative certificate coincides with the validity period
21 of the Standard Teaching Certificate. Beginning July 1, 2003,
22 if an administrative certificate holder holds a Master Teaching
23 Certificate, the validity period of the administrative
24 certificate shall be changed so that the validity period of the
25 administrative certificate coincides with the validity period
26 of the Master Teaching Certificate.
27     (b) No administrative certificate shall be issued for the
28 first time after June 30, 1987 and no endorsement provided for
29 by this Section shall be made or affixed to an administrative
30 certificate for the first time after June 30, 1987 unless the
31 person to whom such administrative certificate is to be issued
32 or to whose administrative certificate such endorsement is to
33 be affixed has been required to demonstrate as a part of a

1 program of academic or professional preparation for such
2 certification or endorsement: (i) an understanding of the
3 knowledge called for in establishing productive parent-school
4 relationships and of the procedures fostering the involvement
5 which such relationships demand; and (ii) an understanding of
6 the knowledge required for establishing a high quality school
7 climate and promoting good classroom organization and
8 management, including rules of conduct and instructional
9 procedures appropriate to accomplishing the tasks of
10 schooling; and (iii) a demonstration of the knowledge and
11 skills called for in providing instructional leadership. The
12 standards for demonstrating an understanding of such knowledge
13 shall be set forth by the State Board of Education in
14 consultation with the State Teacher Certification Board, and
15 shall be administered by the recognized institutions of higher
16 learning as part of the programs of academic and professional
17 preparation required for certification and endorsement under
18 this Section. As used in this subsection: "establishing
19 productive parent-school relationships" means the ability to
20 maintain effective communication between parents and school
21 personnel, to encourage parental involvement in schooling, and
22 to motivate school personnel to engage parents in encouraging
23 student achievement, including the development of programs and
24 policies which serve to accomplish this purpose; and
25 "establishing a high quality school climate" means the ability
26 to promote academic achievement, to maintain discipline, to
27 recognize substance abuse problems among students and utilize
28 appropriate law enforcement and other community resources to
29 address these problems, to support teachers and students in
30 their education endeavors, to establish learning objectives
31 and to provide instructional leadership, including the
32 development of policies and programs which serve to accomplish
33 this purpose; and "providing instructional leadership" means
34 the ability to effectively evaluate school personnel, to

1 possess general communication and interpersonal skills, and to
2 establish and maintain appropriate classroom learning
3 environments. The provisions of this subsection shall not apply
4 to or affect the initial issuance or making on or before June
5 30, 1987 of any administrative certificate or endorsement
6 provided for under this Section, nor shall such provisions
7 apply to or affect the renewal after June 30, 1987 of any such
8 certificate or endorsement initially issued or made on or
9 before June 30, 1987.
10     (c) Administrative certificates shall be renewed every 5
11 years with the first renewal being 5 years following the
12 initial receipt of an administrative certificate, unless the
13 validity period for the administrative certificate has been
14 changed under subsection (a-5) of this Section, in which case
15 the certificate shall be renewed at the same time that the
16 Standard or Master Teaching Certificate is renewed.
17     (c-5) Before July 1, 2003, renewal requirements for
18 administrators whose positions require certification shall be
19 based upon evidence of continuing professional education which
20 promotes the following goals: (1) improving administrators'
21 knowledge of instructional practices and administrative
22 procedures; (2) maintaining the basic level of competence
23 required for initial certification; and (3) improving the
24 mastery of skills and knowledge regarding the improvement of
25 teaching performance in clinical settings and assessment of the
26 levels of student performance in their schools. Evidence of
27 continuing professional education must include verification of
28 biennial attendance in a program developed by the Illinois
29 Administrators' Academy and verification of annual
30 participation in a school district approved activity which
31 contributes to continuing professional education.
32     (c-10) Beginning July 1, 2003, except as otherwise provided
33 in subsection (c-15) of this Section, persons holding
34 administrative certificates must follow the certificate

1 renewal procedure set forth in this subsection (c-10), provided
2 that those persons holding administrative certificates on June
3 30, 2003 who are renewing those certificates on or after July
4 1, 2003 shall be issued new administrative certificates valid
5 for 5 years (unless changed under subsection (a-5) of this
6 Section), which may be renewed thereafter as set forth in this
7 subsection (c-10).
8     (1) A person holding an administrative certificate and
9 employed in a position requiring administrative certification,
10 including a regional superintendent of schools, must satisfy
11 develop an administrative certificate renewal plan for
12 satisfying the continuing professional development
13 requirements of this Section required to renew his or her
14 administrative certificate. The continuing professional
15 development An administrative certificate renewal plan must
16 include a minimum of 3 individual improvement goals developed
17 by the certificate holder and must include without limitation
18 the following continuing professional development purposes:
19         (1) (A) To improve the administrator's knowledge of
20     instructional practices and administrative procedures in
21     accordance with the Illinois Professional School Leader
22     Standards.
23         (2) (B) To maintain the basic level of competence
24     required for initial certification.
25         (3) (C) To improve the administrator's mastery of
26     skills and knowledge regarding the improvement of teaching
27     performance in clinical settings and assessment of the
28     levels of student performance in the schools.
29     An administrative certificate renewal plan must include a
30     description of how the improvement goals are to be achieved
31     and an explanation of the selected continuing professional
32     development activities to be completed, each of which must
33     meet one or more of the continuing professional development
34     purposes specified in this paragraph (1).

1     The continuing professional development (2) In addition to
2 the requirements in paragraph (1) of this subsection (c-10),
3 the administrative certificate renewal plan must include the
4 following in order for the certificate to be renewed:
5         (A) Participation in continuing professional
6     development activities, which must total a minimum of 100
7     hours of continuing professional development. and which
8     must meet all of the following requirements: (i) The
9     participation must consist of a minimum of 5 activities per
10     validity period of the certificate, and the certificate
11     holder must maintain documentation of completion of each
12     activity.
13                 (ii) The activities must address the goals in
14             the certificate holder's professional development
15             plan.
16                 (iii) The activities must be aligned with the
17             Illinois Professional School Leader Standards.
18                 (iv) A portion of the activities must address
19             the certificate holder's school improvement plan
20             at either the district or school level.
21                 (v) The participation must include a
22             communication, dissemination, or application
23             component.
24                 (vi) There must be documentation of completion
25             of each activity.
26         (B) Participation every year in an Illinois
27     Administrators' Academy course, which participation must
28     total a minimum of 30 36 continuing professional
29     development hours during the period of the certificate's
30     validity and which must include completion all of the
31     following: (i) Completion of applicable required
32     coursework, including completion of a communication,
33     dissemination, or application component, as defined by the
34     State Board of Education.

1                 (ii) Completion of a communication,
2             dissemination, or application component.
3                 (iii) Documentation of completion of each
4             activity.
5         (3) Each administrator who is subject to the
6     requirements of this subsection (c-10) but who is not
7     serving as a district or regional superintendent, a
8     director of a cooperative program or special education
9     program, or a director of a State-operated school must
10     submit his or her administrative certificate renewal plan
11     for review to the superintendent of the employing school
12     district or to the director of the cooperative or special
13     education program or State-operated school (or to the
14     superintendent's or director's designee). Each district or
15     regional superintendent, director of a cooperative program
16     or special education program, or director of a
17     State-operated school must submit his or her
18     administrative certificate renewal plan for review to a
19     review panel comprised of peers established by the regional
20     superintendent of schools for the geographic area where the
21     certificate holder is employed as an administrator.
22         (4) If the certificate holder's plan does not conform
23     to the requirements of this subsection (c-10), the reviewer
24     or review panel must notify the certificate holder, who
25     must revise the administrative certificate renewal plan. A
26     certificate holder who is not a regional superintendent of
27     schools may appeal that determination to the regional
28     superintendent of schools for the geographic area where the
29     certificate holder is employed as an administrator. A
30     certificate holder who is a regional superintendent of
31     schools may appeal that determination to the State
32     Superintendent of Education. The regional superintendent
33     of schools or the State Superintendent of Education (or the
34     regional superintendent's or State Superintendent's

1     designee) shall facilitate any modification of the plan, if
2     necessary, to make it acceptable.
3         (5) A certificate holder may modify his or her
4     administrative certificate renewal plan at any time during
5     the validity period of the administrative certificate
6     through the process outlined in paragraphs (3) and (4) of
7     this subsection (c-10).
8         (6) Evidence of completion of the activities in the
9     administrative certificate renewal plan must be submitted
10     to the responsible reviewer or review panel. Before the
11     expiration of the administrative certificate, the
12     certificate holder must request from the responsible
13     reviewer or review panel a signed verification form
14     developed by the State Board of Education confirming that
15     the certificate holder has met the requirements for renewal
16     contained in this Section. A certificate holder who is not
17     a regional superintendent of schools must submit this form
18     to the responsible regional superintendent of schools (or
19     his or her designee) at the time of application for renewal
20     of the certificate. A certificate holder who is a regional
21     superintendent of schools must submit this form for
22     validation to the State Superintendent of Education (or his
23     or her designee) at the time of application for renewal of
24     the certificate.
25     The certificate holder must complete a verification form
26 developed by the State Board of Education and certify that 100
27 hours of continuing professional development activities and 5
28 Administrators' Academy courses have been completed. (7) The
29 regional superintendent of schools shall review and validate
30 the verification form for a certificate holder. Based on
31 compliance with all of the requirements for renewal, the
32 regional superintendent of schools shall forward a
33 recommendation for renewal or non-renewal to the State
34 Superintendent of Education and shall notify the certificate

1 holder of the recommendation. The State Superintendent of
2 Education shall review the recommendation to renew or non-renew
3 and shall notify, in writing, the certificate holder of a
4 decision denying renewal of his or her certificate. Any
5 decision regarding non-renewal of an administrative
6 certificate may be appealed to the State Teacher Certification
7 Board.
8     The State Board of Education, in consultation with the
9 State Teacher Certification Board, shall adopt rules to
10 implement this subsection (c-10).
11     The regional superintendent of schools shall monitor the
12 process for renewal of administrative certificates established
13 in this subsection (c-10).
14     (c-15) This subsection (c-15) applies to the first period
15 of an administrative certificate's validity during which the
16 holder becomes subject to the requirements of subsection (c-10)
17 of this Section if the certificate has less than 5 years'
18 validity or has less than 5 years' validity remaining when the
19 certificate holder becomes subject to the requirements of
20 subsection (c-10) of this Section. With respect to this period,
21 the 100 hours of continuing professional development and 5
22 activities per validity period specified in clause (A) of
23 paragraph (2) of subsection (c-10) of this Section shall
24 instead be deemed to mean 20 hours of continuing professional
25 development and one activity per year of the certificate's
26 validity or remaining validity and the 30 36 continuing
27 professional development hours specified in clause (B) of
28 paragraph (2) of subsection (c-10) of this Section shall
29 instead be deemed to mean completion of at least one course per
30 year of the certificate's validity or remaining validity.
31 Certificate holders who evaluate certified staff must complete
32 a 2-day teacher evaluation course, in addition to the 30
33 continuing professional development hours. If the certificate
34 has 3 or fewer years of validity or 3 or fewer years of

1 validity remaining, the certificate holder is not subject to
2 the requirements for submission and approval of plans for
3 continuing professional development described in paragraphs
4 (1) through (4) of subsection (c-10) of this Section with
5 respect to that period of the certificate's validity.
6     (c-20) The State Board of Education, in consultation with
7 the State Teacher Certification Board, shall develop
8 procedures for implementing this Section and shall administer
9 the renewal of administrative certificates. Failure to submit
10 satisfactory evidence of continuing professional education
11 which contributes to promoting the goals of this Section shall
12 result in a loss of administrative certification.
13     (d) Any limited or life supervisory certificate issued
14 prior to July 1, 1968 shall continue to be valid for all
15 administrative and supervisory positions in the public schools
16 for which it is valid as of that date as long as its holder
17 meets the requirements for registration or renewal as set forth
18 in the statutes or until revoked according to law.
19     (e) The administrative or supervisory positions for which
20 the certificate shall be valid shall be determined by one or
21 more of 3 endorsements: general supervisory, general
22 administrative and superintendent.
23     Subject to the provisions of Section 21-1a, endorsements
24 shall be made under conditions set forth in this Section. The
25 State Board of Education shall, in consultation with the State
26 Teacher Certification Board, adopt rules pursuant to the
27 Illinois Administrative Procedure Act, establishing
28 requirements for obtaining administrative certificates where
29 the minimum administrative or supervisory requirements surpass
30 those set forth in this Section.
31     The State Teacher Certification Board shall file with the
32 State Board of Education a written recommendation when
33 considering additional administrative or supervisory
34 requirements. All additional requirements shall be based upon

1 the requisite knowledge necessary to perform those tasks
2 required by the certificate. The State Board of Education shall
3 in consultation with the State Teacher Certification Board,
4 establish standards within its rules which shall include the
5 academic and professional requirements necessary for
6 certification. These standards shall at a minimum contain, but
7 not be limited to, those used by the State Board of Education
8 in determining whether additional knowledge will be required.
9 Additionally, the State Board of Education shall in
10 consultation with the State Teacher Certification Board,
11 establish provisions within its rules whereby any member of the
12 educational community or the public may file a formal written
13 recommendation or inquiry regarding requirements.
14         (1) Until July 1, 2003, the general supervisory
15     endorsement shall be affixed to the administrative
16     certificate of any holder who has at least 16 semester
17     hours of graduate credit in professional education
18     including 8 semester hours of graduate credit in curriculum
19     and research and who has at least 2 years of full-time
20     teaching experience or school service personnel experience
21     in public schools, schools under the supervision of the
22     Department of Corrections, schools under the
23     administration of the Department of Rehabilitation
24     Services, or nonpublic schools meeting the standards
25     established by the State Superintendent of Education or
26     comparable out-of-state recognition standards approved by
27     the State Superintendent of Education.
28         Such endorsement shall be required for supervisors,
29     curriculum directors and for such similar and related
30     positions as determined by the State Superintendent of
31     Education in consultation with the State Teacher
32     Certification Board.
33         (2) The general administrative endorsement shall be
34     affixed to the administrative certificate of any holder who

1     has at least 20 semester hours of graduate credit in
2     educational administration and supervision and who has at
3     least 2 years of full-time teaching experience or school
4     service personnel experience in public schools, schools
5     under the supervision of the Department of Corrections,
6     schools under the administration of the Department of
7     Rehabilitation Services, or nonpublic schools meeting the
8     standards established by the State Superintendent of
9     Education or comparable out-of-state recognition standards
10     approved by the State Superintendent of Education.
11         Such endorsement shall be required for principal,
12     assistant principal, assistant or associate
13     superintendent, junior college dean and for related or
14     similar positions as determined by the State
15     Superintendent of Education in consultation with the State
16     Teacher Certification Board.
17         Notwithstanding any other provisions of this Act,
18     after January 1, 1990 and until January 1, 1991, any
19     teacher employed by a district subject to Article 34 shall
20     be entitled to receive an administrative certificate with a
21     general administrative endorsement affixed thereto if he
22     or she: (i) had at least 3 years of experience as a
23     certified teacher for such district prior to August 1,
24     1985; (ii) obtained a Master's degree prior to August 1,
25     1985; (iii) completed at least 20 hours of graduate credit
26     in education courses (including at least 12 hours in
27     educational administration and supervision) prior to
28     September 1, 1987; and (iv) has received a rating of
29     superior for at least each of the last 5 years. Any person
30     who obtains an administrative certificate with a general
31     administrative endorsement affixed thereto under this
32     paragraph shall not be qualified to serve in any
33     administrative position except assistant principal.
34         (3) The chief school business official endorsement

1     shall be affixed to the administrative certificate of any
2     holder who qualifies by having a Master's degree, two years
3     of administrative experience in school business
4     management, and a minimum of 20 semester hours of graduate
5     credit in a program established by the State Superintendent
6     of Education in consultation with the State Teacher
7     Certification Board for the preparation of school business
8     administrators. Such endorsement shall also be affixed to
9     the administrative certificate of any holder who qualifies
10     by having a Master's Degree in Business Administration,
11     Finance or Accounting from a regionally accredited
12     institution of higher education.
13         After June 30, 1977, such endorsement shall be required
14     for any individual first employed as a chief school
15     business official.
16         (4) The superintendent endorsement shall be affixed to
17     the administrative certificate of any holder who has
18     completed 30 semester hours of graduate credit beyond the
19     master's degree in a program for the preparation of
20     superintendents of schools including 16 semester hours of
21     graduate credit in professional education and who has at
22     least 2 years experience as an administrator or supervisor
23     in the public schools or the State Board of Education or
24     education service regions or in nonpublic schools meeting
25     the standards established by the State Superintendent of
26     Education or comparable out-of-state recognition standards
27     approved by the State Superintendent of Education and holds
28     general supervisory or general administrative endorsement,
29     or who has had 2 years of experience as a supervisor or
30     administrator while holding an all-grade supervisory
31     certificate or a certificate comparable in validity and
32     educational and experience requirements.
33         After June 30, 1968, such endorsement shall be required
34     for a superintendent of schools, except as provided in the

1     second paragraph of this Section and in Section 34-6.
2         Any person appointed to the position of superintendent
3     between the effective date of this Act and June 30, 1993 in
4     a school district organized pursuant to Article 32 with an
5     enrollment of at least 20,000 pupils shall be exempt from
6     the provisions of this paragraph (4) until June 30, 1996.
7     (f) All official interpretations or acts of issuing or
8 denying administrative certificates or endorsements by the
9 State Teacher's Certification Board, State Board of Education
10 or the State Superintendent of Education, from the passage of
11 P.A. 81-1208 on November 8, 1979 through September 24, 1981 are
12 hereby declared valid and legal acts in all respects and
13 further that the purported repeal of the provisions of this
14 Section by P.A. 81-1208 and P.A. 81-1509 is declared null and
15 void.

18     Sec. 21-9. Substitute certificates and substitute
19 teaching.
20     (a) A substitute teacher's certificate may be issued for
21 teaching in all grades of the common schools. Such certificate
22 may be issued upon request of the regional superintendent of
23 schools of any region in which the teacher is to teach. A
24 substitute teacher's certificate is valid for teaching in the
25 public schools of any county. Such certificate may be issued to
26 persons who either (a) hold a certificate valid for teaching in
27 the common schools as shown on the face of the certificate, (b)
28 hold a bachelor of arts degree from an institution of higher
29 learning accredited by the North Central Association or other
30 comparable regional accrediting association or have been
31 graduated from a recognized institution of higher learning with
32 a bachelor's degree, or (c) have had 2 years of teaching
33 experience and meet such other rules and regulations as may be

1 adopted by the State Board of Education in consultation with
2 the State Teacher Certification Board. Such certificate shall
3 expire on June 30 in the fourth year from date of issue.
4 Substitute teacher's certificates are not subject to
5 endorsement as described in Section 21-1b of this Code.
6     (b) A teacher holding a substitute teacher's certificate
7 may teach only in the place of a certified teacher who is under
8 contract with the employing board and may teach only when no
9 appropriate fully certified teacher is available to teach in a
10 substitute capacity. A teacher holding an early childhood
11 certificate, an elementary certificate, a high school
12 certificate, or a special certificate may also substitute teach
13 in grades K-12 but only in the place of a certified teacher who
14 is under contract with the employing board. A substitute
15 teacher may teach only for a period not to exceed 90 paid
16 school days or 450 paid school hours in any one school district
17 in any one school term. However, for the 2001-2002, 2002-2003,
18 and 2003-2004 school years, a teacher holding an early
19 childhood, elementary, high school, or special certificate may
20 substitute teach for a period not to exceed 120 paid school
21 days or 600 paid school hours in any one school district in any
22 one school term. Where such teaching is partly on a daily and
23 partly on an hourly basis, a school day shall be considered as
24 5 hours. The teaching limitations imposed by this subsection
25 upon teachers holding substitute certificates shall not apply
26 in any school district operating under Article 34.

1 Board. All college credentials offered as the basis of a
2 certificate shall be presented to the secretary of the State
3 Teacher Certification Board for inspection and approval.
4     Commencing July 1, 1999, each application for a certificate
5 or evaluation of credentials shall be accompanied by an
6 evaluation fee of $30 payable to the State Superintendent of
7 Education, which is not refundable, except that no application
8 or evaluation fee shall be required for a Master Certificate
9 issued pursuant to subsection (d) of Section 21-2 of this Code.
10 The proceeds of each $30 fee shall be paid into the Teacher
11 Certificate Fee Revolving Fund, created under Section 21-1b of
12 this Code; and the moneys in that Fund shall be appropriated
13 and used to provide the technology and other resources
14 necessary for the timely and efficient processing of
15 certification requests.
16     The State Board of Education and each regional office of
17 education are authorized to charge a service or convenience fee
18 for the use of credit cards for the payment of certification
19 fees. This service or convenience fee may not exceed the amount
20 required by the credit card processing company or vendor that
21 has entered into a contract with the State Board or regional
22 office of education for this purpose, and the fee must be paid
23 to that company or vendor.
24     When evaluation verifies the requirements for a valid
25 certificate, the applicant shall be issued an entitlement card
26 that may be presented to a regional superintendent of schools
27 for issuance of a certificate.
28     The applicant shall be notified of any deficiencies.

31     Sec. 21-14. Registration and renewal of certificates.
32     (a) A limited four-year certificate or a certificate issued
33 after July 1, 1955, shall be renewable at its expiration or

1 within 60 days thereafter by the county superintendent of
2 schools having supervision and control over the school where
3 the teacher is teaching upon certified evidence of meeting the
4 requirements for renewal as required by this Act and prescribed
5 by the State Board of Education in consultation with the State
6 Teacher Certification Board. An elementary supervisory
7 certificate shall not be renewed at the end of the first
8 four-year period covered by the certificate unless the holder
9 thereof has filed certified evidence with the State Teacher
10 Certification Board that he has a master's degree or that he
11 has earned 8 semester hours of credit in the field of
12 educational administration and supervision in a recognized
13 institution of higher learning. The holder shall continue to
14 earn 8 semester hours of credit each four-year period until
15 such time as he has earned a master's degree.
16     All certificates not renewed or registered as herein
17 provided shall lapse after a period of 5 years from the
18 expiration of the last year of registration. Such certificates
19 may be reinstated for a one year period upon payment of all
20 accumulated registration fees. Such reinstated certificates
21 shall only be renewed: (1) by earning 5 semester hours of
22 credit in a recognized institution of higher learning in the
23 field of professional education or in courses related to the
24 holder's contractual teaching duties; or (2) by presenting
25 evidence of holding a valid regular certificate of some other
26 type. Any certificate may be voluntarily surrendered by the
27 certificate holder. A voluntarily surrendered certificate
28 shall be treated as a revoked certificate.
29     (b) When those teaching certificates issued before
30 February 15, 2000 are renewed for the first time after February
31 15, 2000, all such teaching certificates shall be exchanged for
32 Standard Teaching Certificates as provided in subsection (c) of
33 Section 21-2. All Initial and Standard Teaching Certificates,
34 including those issued to persons who previously held teaching

1 certificates issued before February 15, 2000, shall be
2 renewable under the conditions set forth in this subsection
3 (b).
4     Initial Teaching Certificates are nonrenewable and are
5 valid for 4 years of teaching, as provided in subsection (b) of
6 Section 21-2 of this Code, and are renewable every 4 years
7 until the person completes 4 years of teaching. If the holder
8 of an Initial Certificate has completed 4 years of teaching but
9 has not completed the requirements set forth in paragraph (2)
10 of subsection (c) of Section 21-2 of this Code, then the
11 Initial Certificate may be reinstated for one year, during
12 which the requirements must be met. A holder of an Initial
13 certificate who has not completed 4 years of teaching may
14 continuously register the certificate for additional 4-year
15 periods without penalty. Initial Certificates that are not
16 registered shall lapse consistent with subsection (a) of this
17 Section and may be reinstated only in accordance with
18 subsection (a). Standard Teaching Certificates are renewable
19 every 5 years as provided in subsection (c) of Section 21-2 and
20 subsection (c) of this Section. For purposes of this Section,
21 "teaching" is defined as employment and performance of services
22 in an Illinois public or State-operated elementary school,
23 secondary school, or cooperative or joint agreement with a
24 governing body or board of control, in a certificated teaching
25 position, or a charter school operating in compliance with the
26 Charter Schools Law.
27     (c) In compliance with subsection (c) of Section 21-2 of
28 this Code, which provides that a Standard Teaching Certificate
29 may be renewed by the State Teacher Certification Board based
30 upon proof of continuing professional development, the State
31 Board of Education and the State Teacher Certification Board
32 shall jointly:
33         (1) establish a procedure for renewing Standard
34     Teaching Certificates, which shall include but not be

1     limited to annual timelines for the renewal process and the
2     components set forth in subsections (d) through (k) of this
3     Section;
4         (2) establish the standards for certificate renewal;
5         (3) approve or disapprove the providers of continuing
6     professional development activities;
7         (4) determine the maximum credit for each category of
8     continuing professional development activities, based upon
9     recommendations submitted by a continuing professional
10     development activity task force, which shall consist of 6
11     staff members from the State Board of Education, appointed
12     by the State Superintendent of Education, and 6 teacher
13     representatives, 3 of whom are selected by the Illinois
14     Education Association and 3 of whom are selected by the
15     Illinois Federation of Teachers;
16         (5) designate the type and amount of documentation
17     required to show that continuing professional development
18     activities have been completed; and
19         (6) provide, on a timely basis to all Illinois
20     teachers, certificate holders, regional superintendents of
21     schools, school districts, and others with an interest in
22     continuing professional development, information about the
23     standards and requirements established pursuant to this
24     subsection (c).
25     (d) Any Standard Teaching Certificate held by an individual
26 employed and performing services in an Illinois public or
27 State-operated elementary school, secondary school, or
28 cooperative or joint agreement with a governing body or board
29 of control in a certificated teaching position or a charter
30 school in compliance with the Charter Schools Law must be
31 maintained Valid and Active through certificate renewal
32 activities specified in the certificate renewal procedure
33 established pursuant to subsection (c) of this Section,
34 provided that a holder of a Valid and Active certificate who is

1 only employed on either a part-time basis or day-to-day basis
2 as a substitute teacher shall pay only the required
3 registration fee to renew his or her certificate and maintain
4 it as Valid and Active. All other Standard Teaching
5 Certificates held may be maintained as Valid and Exempt through
6 the registration process provided for in the certificate
7 renewal procedure established pursuant to subsection (c) of
8 this Section. A Valid and Exempt certificate must be
9 immediately activated, through procedures developed jointly by
10 the State Board of Education and the State Teacher
11 Certification Board, upon the certificate holder becoming
12 employed and performing services in an Illinois public or
13 State-operated elementary school, secondary school, or
14 cooperative or joint agreement with a governing body or board
15 of control in a certificated teaching position or a charter
16 school operating in compliance with the Charter Schools Law. A
17 holder of a Valid and Exempt certificate may activate his or
18 her certificate through procedures provided for in the
19 certificate renewal procedure established pursuant to
20 subsection (c) of this Section.
21     (e)(1) A Standard Teaching Certificate that has been
22 maintained as Valid and Active for the 5 years of the
23 certificate's validity shall be renewed as Valid and Active
24 upon the certificate holder: (i) completing an advanced degree
25 from an approved institution in an education-related field;
26 (ii) completing at least 8 semester hours of coursework as
27 described in subdivision (B) of paragraph (3) of this
28 subsection (e); (iii) earning at least 24 continuing education
29 units as described in subdivision (C) of paragraph (3) of this
30 subsection (e); (iv) completing the National Board for
31 Professional Teaching Standards process as described in
32 subdivision (D) of paragraph (3) of this subsection (e); or (v)
33 earning 120 continuing professional development units ("CPDU")
34 as described in subdivision (E) of paragraph (3) of this

1 subsection (e). The maximum continuing professional
2 development units for each continuing professional development
3 activity identified in subdivisions (F) through (J) of
4 paragraph (3) of this subsection (e) shall be jointly
5 determined by the State Board of Education and the State
6 Teacher Certification Board. If, however, the certificate
7 holder has maintained the certificate as Valid and Exempt for a
8 portion of the 5-year period of validity, the number of
9 continuing professional development units needed to renew the
10 certificate as Valid and Active shall be proportionately
11 reduced by the amount of time the certificate was Valid and
12 Exempt. Furthermore, if a certificate holder is employed and
13 performs teaching services on a part-time basis for all or a
14 portion of the certificate's 5-year period of validity, the
15 number of continuing professional development units needed to
16 renew the certificate as Valid and Active shall be reduced by
17 50% for the amount of time the certificate holder has been
18 employed and performed teaching services on a part-time basis.
19 Part-time shall be defined as less than 50% of the school day
20 or school term.
21     Notwithstanding any other requirements to the contrary, if
22 a Standard Teaching Certificate has been maintained as Valid
23 and Active for the 5 years of the certificate's validity and
24 the certificate holder has completed his or her certificate
25 renewal plan before July 1, 2002, the certificate shall be
26 renewed as Valid and Active.
27     (2) Beginning July 1, 2004, in order to satisfy the
28 requirements for continuing professional development provided
29 for in subsection (c) of Section 21-2 of this Code, each Each
30 Valid and Active Standard Teaching Certificate holder shall
31 complete professional development activities develop a
32 certificate renewal plan for satisfying the continuing
33 professional development requirement provided for in
34 subsection (c) of Section 21-2 of this Code. Certificate

1 holders with multiple certificates shall develop a certificate
2 renewal plan that addresses only that address the certificate
3 or those certificates that are required of his or her
4 certificated teaching position, if the certificate holder is
5 employed and performing services in an Illinois public or
6 State-operated elementary school, secondary school, or
7 cooperative or joint agreement with a governing body or board
8 of control, or that certificate or those certificates most
9 closely related to his or her teaching position, if the
10 certificate holder is employed in a charter school. Except as
11 otherwise provided in this subsection (e), the certificate
12 holder's activities must address a certificate renewal plan
13 shall include a minimum of 3 individual improvement goals
14 developed by the certificate holder and shall reflect purposes
15 (A), (B), and (C), or (D) and must may reflect purpose (E) (D)
16 of the following continuing professional development purposes:
17         (A) Advance both the certificate holder's knowledge
18     and skills as a teacher consistent with the Illinois
19     Professional Teaching Standards and the Illinois Content
20     Area Standards in the certificate holder's areas of
21     certification, endorsement, or teaching assignment in
22     order to keep the certificate holder current in those
23     areas.
24         (B) Develop the certificate holder's knowledge and
25     skills in areas determined to be critical for all Illinois
26     teachers, as defined by the State Board of Education, known
27     as "State priorities".
28         (C) Address the knowledge, skills, and goals of the
29     certificate holder's local school improvement plan, if the
30     teacher is employed in an Illinois public or State-operated
31     elementary school, secondary school, or cooperative or
32     joint agreement with a governing body or board of control.
33         (D) Expand the certificate holder's knowledge and
34     skills in an additional teaching field or toward the

1     acquisition of another teaching certificate, endorsement,
2     or relevant education degree.
3         (E) Address the needs of serving students with
4     disabilities, including adapting and modifying the general
5     curriculum related to the Illinois Learning Standards to
6     meet the needs of students with disabilities and serving
7     such students in the least restrictive environment.
8     Teachers who hold certificates endorsed for special
9     education must devote at least 50% of their continuing
10     professional development activities to this purpose.
11     Teachers holding other certificates must devote at least
12     20% of their activities to this purpose.
13 A certificate renewal plan must include a description of how
14 these goals are to be achieved and an explanation of selected
15 continuing professional development activities to be
16 completed, each of which must meet one or more of the
17 continuing professional development purposes specified in this
18 paragraph (2). The plan shall identify potential activities and
19 include projected timelines for those activities that will
20 assure completion of the plan before the expiration of the
21 5-year validity of the Standard Teaching Certificate. Except as
22 otherwise provided in this subsection (e), at least 50% of
23 continuing professional development units must relate to
24 purposes (A) and (B) set forth in this paragraph (2): the
25 advancement of a certificate holder's knowledge and skills as a
26 teacher consistent with the Illinois Professional Teaching
27 Standards and the Illinois Content Area Standards in the
28 certificate holder's areas of certification, endorsement, or
29 teaching assignment in order to keep the certificate holder
30 current in those areas and the development of a certificate
31 holder's knowledge and skills in the State priorities that
32 exist at the time the certificate renewal plan is developed.
33     A speech-language pathologist or audiologist who is
34 licensed under the Illinois Speech-Language Pathology and

1 Audiology Practice Act and who has met the continuing education
2 requirements of that Act and the rules promulgated under that
3 Act shall be deemed to have satisfied the continuing
4 professional development requirements established by the State
5 Board of Education and the Teacher Certification Board to renew
6 a Standard Certificate.
7     (3) Continuing professional development activities
8 included in a certificate renewal plan may include, but are not
9 limited to, the following activities:
10         (A) completion of an advanced degree from an approved
11     institution in an education-related field;
12         (B) at least 8 semester hours of coursework in an
13     approved education-related program, of which at least 2
14     semester hours relate to the continuing professional
15     development purpose set forth in purpose (A) of paragraph
16     (2) of this subsection (e), completion of which means no
17     provided that such a plan need not include any other
18     continuing professional development activities are
19     required nor reflect or contain activities related to the
20     other continuing professional development purposes set
21     forth in paragraph (2) of this subsection (e);
22         (C) continuing education units that satisfy the
23     continuing professional development purposes set forth in
24     paragraph (2) of this subsection (e), with each continuing
25     education unit equal to 5 clock hours, provided that a plan
26     that includes at least 24 continuing education units (or
27     120 clock/contact hours) need not include any other
28     continuing professional development activities;
29         (D) completion of the National Board for of
30     Professional Teaching Standards ("NBPTS") process for
31     certification or recertification, completion of which
32     means no provided that a plan that includes completion of
33     the NBPTS process need not include any other continuing
34     professional development activities are required nor

1     reflect or contain activities related to the continuing
2     professional development purposes set forth in paragraph
3     (2) of subsection (e) of this Section;
4         (E) completion of 120 continuing professional
5     development units that satisfy the continuing professional
6     development purposes set forth in paragraph (2) of this
7     subsection (e) and may include without limitation the
8     activities identified in subdivisions (F) through (J) of
9     this paragraph (3);
10         (F) collaboration and partnership activities related
11     to improving the teacher's knowledge and skills as a
12     teacher, including the following:
13             (i) participating on collaborative planning and
14         professional improvement teams and committees;
15             (ii) peer review and coaching;
16             (iii) mentoring in a formal mentoring program,
17         including service as a consulting teacher
18         participating in a remediation process formulated
19         under Section 24A-5 of this Code;
20             (iv) participating in site-based management or
21         decision making teams, relevant committees, boards, or
22         task forces directly related to school improvement
23         plans;
24             (v) coordinating community resources in schools,
25         if the project is a specific goal of the school
26         improvement plan;
27             (vi) facilitating parent education programs for a
28         school, school district, or regional office of
29         education directly related to student achievement or
30         school improvement plans;
31             (vii) participating in business, school, or
32         community partnerships directly related to student
33         achievement or school improvement plans; or
34             (viii) supervising a student teacher or teacher

1         education candidate in clinical supervision, provided
2         that the supervision may only be counted once during
3         the course of 5 years;
4         (G) college or university coursework related to
5     improving the teacher's knowledge and skills as a teacher
6     as follows:
7             (i) completing undergraduate or graduate credit
8         earned from a regionally accredited institution in
9         coursework relevant to the certificate area being
10         renewed, including coursework that incorporates
11         induction activities and development of a portfolio of
12         both student and teacher work that provides experience
13         in reflective practices, provided the coursework meets
14         Illinois Professional Teaching Standards or Illinois
15         Content Area Standards and supports the essential
16         characteristics of quality professional development;
17         or
18             (ii) teaching college or university courses in
19         areas relevant to the certificate area being renewed,
20         provided that the teaching may only be counted once
21         during the course of 5 years;
22         (H) conferences, workshops, institutes, seminars, and
23     symposiums related to improving the teacher's knowledge
24     and skills as a teacher, subject to disapproval of the
25     activity or event by the State Teacher Certification Board
26     acting jointly with the State Board of Education, including
27     the following:
28             (i) completing non-university credit directly
29         related to student achievement, school improvement
30         plans, or State priorities;
31             (ii) participating in or presenting at workshops,
32         seminars, conferences, institutes, and symposiums;
33             (iii) training as external reviewers for Quality
34         Assurance; or

1             (iv) training as reviewers of university teacher
2         preparation programs. ;
3     A teacher, however, may not receive credit for conferences,
4     workshops, institutes, seminars, or symposiums that are
5     designed for entertainment, promotional, or commercial
6     purposes or that are solely inspirational or motivational.
7     The State Superintendent of Education and regional
8     superintendents of schools are authorized to review the
9     activities and events provided or to be provided under this
10     subdivision (H) and to investigate complaints regarding
11     those activities and events, and either the State
12     Superintendent of Education or a regional superintendent
13     of schools may recommend that the State Teacher
14     Certification Board and the State Board of Education
15     jointly disapprove those activities and events considered
16     to be inconsistent with this subdivision (H);
17         (I) other educational experiences related to improving
18     the teacher's knowledge and skills as a teacher, including
19     the following:
20             (i) participating in action research and inquiry
21         projects;
22             (ii) observing programs or teaching in schools,
23         related businesses, or industry that is systematic,
24         purposeful, and relevant to certificate renewal;
25             (iii) traveling related to one's ones teaching
26         assignment, directly related to student achievement or
27         school improvement plans and approved by the regional
28         superintendent of schools or his or her designee at
29         least 30 days prior to the travel experience, provided
30         that the traveling shall not include time spent
31         commuting to destinations where the learning
32         experience will occur;
33             (iv) participating in study groups related to
34         student achievement or school improvement plans;

1             (v) serving on a statewide education-related
2         committee, including but not limited to the State
3         Teacher Certification Board, State Board of Education
4         strategic agenda teams, or the State Advisory Council
5         on Education of Children with Disabilities;
6             (vi) participating in work/learn programs or
7         internships; or
8             (vii) developing a portfolio of student and
9         teacher work;
10         (J) professional leadership experiences related to
11     improving the teacher's knowledge and skills as a teacher,
12     including the following:
13             (i) participating in curriculum development or
14         assessment activities at the school, school district,
15         regional office of education, State, or national
16         level;
17             (ii) participating in team or department
18         leadership in a school or school district;
19             (iii) participating on external or internal school
20         or school district review teams;
21             (iv) publishing educational articles, columns, or
22         books relevant to the certificate area being renewed;
23         or
24             (v) participating in non-strike related
25         professional association or labor organization service
26         or activities related to professional development; .
27         (K) receipt of a subsequent Illinois certificate or
28     endorsement pursuant to this Article; or
29         (L) completion of requirements for meeting the
30     Illinois criteria for becoming "highly qualified" (for
31     purposes of the No Child Left Behind Act of 2001, Public
32     Law 107-110) in an additional teaching area.
33         (M) Successful completion of 4 semester hours of
34     graduate-level coursework on the assessment of one's own

1     performance in relation to the Illinois Teaching
2     Standards, as described in clause (B) of paragraph (2) of
3     subsection (c) of Section 21-2 of this Code.
4         (N) Successful completion of a minimum of 4 semester
5     hours of graduate-level coursework addressing preparation
6     to meet the requirements for certification by the National
7     Board for Professional Teaching Standards, as described in
8     clause (C) of paragraph (2) of subsection (c) of Section
9     21-2 of this Code.
10     (4) A person must complete the requirements of this
11 subsection (e) before the expiration of his or her Standard
12 Teaching Certificate and must submit assurance to the regional
13 superintendent of schools or, if applicable, a local
14 professional development committee authorized by the regional
15 superintendent to submit recommendations to him or her for this
16 purpose. The statement of assurance shall contain a list of the
17 activities completed, the provider offering each activity, the
18 number of credits earned for each activity, and the purposes to
19 which each activity is attributed. The certificate holder shall
20 maintain the evidence of completion of each activity for at
21 least one certificate renewal cycle. The certificate holder
22 shall affirm under penalty of perjury that he or she has
23 completed the activities listed and will maintain the required
24 evidence of completion. The State Board of Education or the
25 regional superintendent of schools for each region shall
26 conduct random audits of assurance statements and supporting
27 documentation. A certificate renewal plan must initially be
28 approved by the certificate holder's local professional
29 development committee, as provided for in subsection (f) of
30 this Section. If the local professional development committee
31 does not approve the certificate renewal plan, the certificate
32 holder may appeal that determination to the regional
33 professional development review committee, as provided for in
34 paragraph (2) of subsection (g) of this Section. If the

2 with the local professional development committee's
3 determination, the certificate renewal plan shall be deemed
4 approved and the certificate holder may begin satisfying the
5 continuing professional development activities set forth in
6 the plan. If the regional professional development review
7 committee agrees with the local professional development
8 committee's determination, the certificate renewal plan shall
9 be deemed disapproved and shall be returned to the certificate
10 holder to develop a revised certificate renewal plan. In all
11 cases, the regional professional development review committee
12 shall immediately notify both the local professional
13 development committee and the certificate holder of its
14 determination.
15     (5) (Blank). A certificate holder who wishes to modify the
16 continuing professional development activities or goals in his
17 or her certificate renewal plan must submit the proposed
18 modifications to his or her local professional development
19 committee for approval prior to engaging in the proposed
20 activities. If the local professional development committee
21 does not approve the proposed modification, the certificate
22 holder may appeal that determination to the regional
23 professional development review committee, as set forth in
24 paragraph (4) of this subsection (e).
25     (6) (Blank). When a certificate holder changes assignments
26 or school districts during the course of completing a
27 certificate renewal plan, the professional development and
28 continuing education credit earned pursuant to the plan shall
29 transfer to the new assignment or school district and count
30 toward the total requirements. This certificate renewal plan
31 must be reviewed by the appropriate local professional
32 development committee and may be modified to reflect the
33 certificate holder's new work assignment or the school
34 improvement plan of the new school district or school building.

1     (f) Notwithstanding any other provisions of this Code, a
2 school district is authorized to enter into an agreement with
3 the exclusive bargaining representative, if any, to form a
4 local professional development committee (LPDC). The
5 membership and terms of members of the LPDC may be determined
6 by the agreement. Provisions regarding LPDCs contained in a
7 collective bargaining agreement in existence on the effective
8 date of this amendatory Act of the 93rd General Assembly
9 between a school district and the exclusive bargaining
10 representative shall remain in full force and effect for the
11 term of the agreement, unless terminated by mutual agreement.
12 The LPDC shall make recommendations to the regional
13 superintendent of schools on renewal of teaching certificates.
14 The regional superintendent of schools for each region each
15 school district, charter school, and cooperative or joint
16 agreement with a governing body or board of control that
17 employs certificated staff, shall establish and implement, in
18 conjunction with its exclusive representative, if any, one or
19 more local professional development committees, as set forth in
20 this subsection (f), which shall perform the following
21 functions:
22         (1) review recommendations for and approve certificate
23     renewal, if any, received from LPDCs plans and any
24     modifications made to these plans, including transferred
25     plans;
26         (2) (blank); maintain a file of approved certificate
27     renewal plans;
28         (3) (blank); monitor certificate holders' progress in
29     completing approved certificate renewal plans, provided
30     that a local professional development committee shall not
31     be required to maintain materials submitted by certificate
32     holders to demonstrate their progress in completing their
33     certificate renewal plans after the committee has reviewed
34     the materials and the credits have been awarded;

1         (4) (blank); assist in the development of professional
2     development plans based upon needs identified in
3     certificate renewal plans;
4         (5) determine whether certificate holders have met the
5     requirements for of their certificate renewal plans and
6     notify certificate holders if the decision is not to renew
7     the certificate of its determination;
8         (6) provide a certificate holder with the opportunity
9     to appeal a recommendation made by a LPDC, if any, not to
10     renew the certificate to the regional professional
11     development review committee address the committee when it
12     has determined that the certificate holder has not met the
13     requirements of his or her certificate renewal plan;
14         (7) issue and forward recommendations for renewal or
15     nonrenewal of certificate holders' Standard Teaching
16     Certificates to the State Teacher Certification Board
17     appropriate regional superintendent of schools, based upon
18     whether certificate holders have met the requirements of
19     their approved certificate renewal plans, with 30-day
20     written notice of its recommendation provided to the
21     certificate holder prior to forwarding the recommendation
22     to the regional superintendent of schools, provided that if
23     the local professional development committee's
24     recommendation is for certificate nonrenewal, the written
25     notice provided to the certificate holder shall include a
26     return receipt; and
27         (8) (blank). reconsider its recommendation of
28     certificate nonrenewal, upon request of the certificate
29     holder within 30 days of receipt of written notification
30     that the local professional development committee will
31     make such a recommendation, and forward to the regional
32     superintendent of schools its recommendation within 30
33     days of receipt of the certificate holder's request.
34     Each local professional development committee shall

1 consist of at least 3 classroom teachers; one superintendent or
2 chief administrator of the school district, charter school, or
3 cooperative or joint agreement or his or her designee; and one
4 at-large member who shall be either (i) a parent, (ii) a member
5 of the business community, (iii) a community member, or (iv) an
6 administrator, with preference given to an individual chosen
7 from among those persons listed in items (i), (ii), and (iii)
8 in order to secure representation of an interest not already
9 represented on the committee. Except in a school district in a
10 city having a population exceeding 500,000, a local
11 professional development committee shall be responsible for no
12 more than 200 certificate renewal plans annually unless
13 otherwise mutually agreed upon by the school district, charter
14 school, or governing body or board of control of a cooperative
15 or joint agreement and its exclusive representative, if any. If
16 mutually agreed upon by the school district, charter school, or
17 governing body or board of control of a cooperative or joint
18 agreement and its exclusive representative, if any, additional
19 members may be added to a local professional development
20 committee, provided that a majority of members are classroom
21 teachers. Except in a school district in a city having a
22 population exceeding 500,000, if additional members are added
23 to a local professional development committee, the maximum
24 number of certificate renewal plans for which the committee
25 shall annually be responsible may be increased by 50 plans for
26 each additional member, unless otherwise mutually agreed upon
27 by the school district, charter school, or governing body or
28 board of control of a cooperative or joint agreement and its
29 exclusive representative, if any. The school district, charter
30 school, or governing body or board of control of a cooperative
31 or joint agreement and its exclusive representative, if any,
32 shall determine the term of service of the members of a local
33 professional development committee. All individuals selected
34 to serve on local professional development committees must be

1 known to demonstrate the best practices in teaching or their
2 respective field of practice.
3     The exclusive representative, if any, shall select the
4 classroom teacher members of the local professional
5 development committee. If no exclusive representative exists,
6 then the classroom teacher members of a local professional
7 development committee shall be selected by the classroom
8 teachers that come within the local professional development
9 committee's authority. The school district, charter school, or
10 governing body or board of control of a cooperative or joint
11 agreement shall select the 2 non-classroom teacher members (the
12 superintendent or chief administrator of the school district,
13 charter school, or cooperative or joint agreement or his or her
14 designee and the at-large member) of a local professional
15 development committee. Vacancies in positions on a local
16 professional development committee shall be filled in the same
17 manner as the original selections. The members of a local
18 professional development committee shall select a chairperson.
19 Local professional development committee meetings shall be
20 scheduled so as not to interfere with committee members'
21 regularly scheduled teaching duties, except when otherwise
22 permitted by the policies of or agreed to or approved by the
23 school district, charter school, or governing body or board of
24 control of a cooperative or joint agreement, or its designee.
25     The board of education or governing board shall convene the
26 first meeting of the local professional development committee.
27 All actions taken by the local professional development
28 committee shall require that a majority of committee members be
29 present, and no committee action may be taken unless 50% or
30 more of those present are teacher members.
31     The State Board of Education and the State Teacher
32 Certification Board shall jointly provide local professional
33 development committee members with a training manual, and the
34 members shall certify that they have received and read the

1 manual.
2     Notwithstanding any other provisions of this subsection
3 (f), for a teacher employed and performing services in a
4 nonpublic or State-operated elementary or secondary school,
5 all references to a local professional development committee
6 shall mean the regional superintendent of schools of the
7 regional office of education for the geographic area where the
8 teaching is done.
9     (g)(1) Each regional superintendent of schools shall
10 review and concur or nonconcur with each recommendation for
11 renewal or nonrenewal of a Standard Teaching Certificate he or
12 she receives from a local professional development committee,
13 if any, or, if a certificate holder appeals the recommendation
14 to the regional professional development review committee, the
15 recommendation for renewal or nonrenewal he or she receives
16 from a regional professional development review committee and,
17 within 14 days of receipt of the recommendation, shall provide
18 the State Teacher Certification Board with verification of the
19 following, if applicable:
20         (A) the certificate holder has satisfactorily
21     completed professional development and continuing
22     education activities set forth in paragraph (3) of
23     subsection (e) of this Section; a certificate renewal plan
24     was filed and approved by the appropriate local
25     professional development committee;
26         (B) the certificate holder has submitted the statement
27     of assurance required under paragraph (4) of subsection (e)
28     of this Section, and this statement has been attached to
29     the application for renewal; the professional development
30     and continuing education activities set forth in the
31     approved certificate renewal plan have been satisfactorily
32     completed;
33         (C) the local professional development committee, if
34     any, has recommended the renewal of the certificate

1     holder's Standard Teaching Certificate and forwarded the
2     recommendation, along with all supporting documentation as
3     jointly required by the State Board of Education and the
4     State Teacher Certification Board, to the regional
5     superintendent of schools;
6         (D) the certificate holder has appealed his or her
7     local professional development committee's recommendation
8     of nonrenewal, if any, to the regional professional
9     development review committee and the result of that appeal;
10         (E) the regional superintendent of schools has
11     concurred or nonconcurred with the local professional
12     development committee's or regional professional
13     development review committee's recommendation, if any, to
14     renew or nonrenew the certificate holder's Standard
15     Teaching Certificate and made a recommendation to that
16     effect; and
17         (F) the established registration fee for the Standard
18     Teaching Certificate has been paid.
19     If At the same time the regional superintendent of schools
20 provides the State Teacher Certification Board with the notice
21 required by this subsection (g) includes a recommendation of
22 certificate nonrenewal, then, at the same time the regional
23 superintendent of schools provides the State Teacher
24 Certification Board with the notice, he or she shall also
25 notify the certificate holder in writing, by certified mail,
26 return receipt requested, that this notice has been provided to
27 the State Teacher Certification Board, provided that if the
28 notice provided by the regional superintendent of schools to
29 the State Teacher Certification Board includes a
30 recommendation of certificate nonrenewal, the written notice
31 provided to the certificate holder shall be by certified mail,
32 return receipt requested.
33     (2) Each certificate holder shall have the right to appeal
34 his or her local professional development committee's

1 recommendation of nonrenewal, if any, to the regional
2 professional development review committee, within 14 days of
3 receipt of notice that the recommendation has been sent to the
4 regional superintendent of schools. Each regional
5 superintendent of schools shall establish a regional
6 professional development review committee or committees for
7 the purpose of advising the regional superintendent of schools,
8 upon request, and handling certificate holder appeals. This
9 committee shall consist of at least 4 classroom teachers, one
10 non-administrative certificated educational employee, 2
11 administrators, and one at-large member who shall be either (i)
12 a parent, (ii) a member of the business community, (iii) a
13 community member, or (iv) an administrator, with preference
14 given to an individual chosen from among those persons listed
15 in items (i), (ii), and (iii) in order to secure representation
16 of an interest not already represented on the committee. The
17 teacher and non-administrative certificated educational
18 employee members of the review committee shall be selected by
19 their exclusive representative, if any, and the administrators
20 and at-large member shall be selected by the regional
21 superintendent of schools. A regional superintendent of
22 schools may add additional members to the committee, provided
23 that the same proportion of teachers to administrators and
24 at-large members on the committee is maintained. Any additional
25 teacher and non-administrative certificated educational
26 employee members shall be selected by their exclusive
27 representative, if any. Vacancies in positions on a regional
28 professional development review committee shall be filled in
29 the same manner as the original selections. Committee members
30 shall serve staggered 3-year terms. All individuals selected to
31 serve on regional professional development review committees
32 must be known to demonstrate the best practices in teaching or
33 their respective field of practice.
34     The exclusive representative responsible for choosing the

1 individuals that serve on a regional professional development
2 review committee shall notify each school district, charter
3 school, or governing body or board of control of a cooperative
4 or joint agreement employing the individuals chosen to serve
5 and provide their names to the appropriate regional
6 superintendent of schools. Regional professional development
7 review committee meetings shall be scheduled so as not to
8 interfere with the committee members' regularly scheduled
9 teaching duties, except when otherwise permitted by the
10 policies of or agreed to or approved by the school district,
11 charter school, or governing body or board of control of a
12 cooperative or joint agreement, or its designee, provided that
13 the school district, charter school, or governing body or board
14 of control shall not unreasonably withhold permission for a
15 committee member to attend regional professional development
16 review committee meetings.
17     In a city having a population exceeding 500,000 that does
18 not have a regional office of education, one or more separate
19 regional professional development review committees shall be
20 established as mutually agreed upon by the board of education
21 of the school district organized under Article 34 of this Code
22 and the exclusive representative. The composition of each
23 committee shall be the same as for a regional professional
24 development review committee, except that members of the
25 committee shall be jointly appointed by the board of education
26 and the exclusive representative. All other provisions of this
27 Section concerning regional professional development review
28 committees shall apply to these committees.
29     The regional professional development review committee may
30 require information in addition to that received from a
31 certificate holder's local professional development committee
32 or request that the certificate holder appear before it, shall
33 either concur or nonconcur with a local professional
34 development committee's recommendation of nonrenewal, and

1 shall forward to the regional superintendent of schools its
2 recommendation of renewal or nonrenewal. All actions taken by
3 the regional professional development review committee shall
4 require a quorum and be by a simple majority of those present
5 and voting. A record of all votes shall be maintained. The
6 committee shall have 45 days from receipt of a certificate
7 holder's appeal to make its recommendation to the regional
8 superintendent of schools.
9     The State Board of Education and the State Teacher
10 Certification Board shall jointly provide regional
11 professional development review committee members with a
12 training manual, and the members shall be required to attend
13 one training seminar sponsored jointly by the State Board of
14 Education and the State Teacher Certification Board.
15     (h)(1) The State Teacher Certification Board shall review
16 the regional superintendent of schools' recommendations to
17 renew or nonrenew Standard Teaching Certificates and notify
18 certificate holders in writing whether their certificates have
19 been renewed or nonrenewed within 90 days of receipt of the
20 recommendations, unless a certificate holder has appealed a
21 regional superintendent of schools' recommendation of
22 nonrenewal, as provided in paragraph (2) of this subsection
23 (h). The State Teacher Certification Board shall verify that
24 the certificate holder has met the renewal criteria set forth
25 in paragraph (1) of subsection (g) of this Section.
26     (2) Each certificate holder shall have the right to appeal
27 a regional superintendent of school's recommendation to
28 nonrenew his or her Standard Teaching Certificate to the State
29 Teacher Certification Board, within 14 days of receipt of
30 notice that the decision has been sent to the State Teacher
31 Certification Board, which shall hold an appeal hearing within
32 60 days of receipt of the appeal. When such an appeal is taken,
33 the certificate holder's Standard Teaching Certificate shall
34 continue to be valid until the appeal is finally determined.

1 The State Teacher Certification Board shall review the regional
2 superintendent of school's recommendation, the regional
3 professional development review committee's recommendation, if
4 any, and the local professional development committee's
5 recommendation, if any, and all relevant documentation to
6 verify whether the certificate holder has met the renewal
7 criteria set forth in paragraph (1) of subsection (g) of this
8 Section. The State Teacher Certification Board may request that
9 the certificate holder appear before it. All actions taken by
10 the State Teacher Certification Board shall require a quorum
11 and be by a simple majority of those present and voting. A
12 record of all votes shall be maintained. The State Teacher
13 Certification Board shall notify the certificate holder in
14 writing, within 7 days of completing the review, whether his or
15 her Standard Teaching Certificate has been renewed or
16 nonrenewed, provided that if the State Teacher Certification
17 Board determines to nonrenew a certificate, the written notice
18 provided to the certificate holder shall be by certified mail,
19 return receipt requested. All certificate renewal or
20 nonrenewal decisions of the State Teacher Certification Board
21 are final and subject to administrative review, as set forth in
22 Section 21-24 of this Code.
23     (i) Holders of Master Teaching Certificates shall meet the
24 same requirements and follow the same procedures as holders of
25 Standard Teaching Certificates, except that their renewal
26 cycle shall be as set forth in subsection (d) of Section 21-2
27 of this Code and their renewal requirements shall be subject to
28 paragraph (8) of subsection (c) of Section 21-2 of this Code.
29     A holder of a teaching certificate endorsed as a
30 speech-language pathologist who has been granted the
31 Certificate of Clinical Competence by the American
32 Speech-Language Hearing Association may renew his or her
33 Standard Teaching Certificate pursuant to the 10-year renewal
34 cycle set forth in subsection (d) of Section 21-2 of this Code.

1     (j) Holders of Valid and Exempt Standard and Master
2 Teaching Certificates who are not employed and performing
3 services in an Illinois public or State-operated elementary
4 school, secondary school, or cooperative or joint agreement
5 with a governing body or board of control, in a certificated
6 teaching position, may voluntarily activate their certificates
7 through by developing and submitting a certificate renewal plan
8 to the regional superintendent of schools of the regional
9 office of education for the geographic area where their
10 teaching is done, who, or whose designee, shall approve the
11 plan and serve as the certificate holder's local professional
12 development committee. These certificate holders shall follow
13 the same renewal criteria and procedures as all other Standard
14 and Master Teaching Certificate holders, except that their
15 continuing professional development activities need not plans
16 shall not be required to reflect or address the knowledge,
17 skills, and goals of a local school improvement plan.
18     (k) (Blank). Each school district, charter school, or
19 cooperative or joint agreement shall be paid an annual amount
20 of not less than $1,000, as determined by a formula based on
21 the number of Standard Teaching and Master Teaching Certificate
22 holders, subject to renewal and established by rule, not to
23 exceed $1,000,000 annually for all school districts, charter
24 schools, and cooperatives or joint agreements, for
25 administrative costs associated with conducting the meetings
26 of the local professional development committee, as determined
27 in consultation with the committee. Each regional office of
28 education shall receive $2,000 annually to pay school
29 districts, charter schools, or cooperatives or joint
30 agreements for costs, as defined by rule, incurred in staff
31 attendance at regional professional development review
32 committee meetings and the training seminar required under
33 paragraph (2) of subsection (g) of this Section.
34     (l) (Blank). The State Board of Education and the State

1 Teacher Certification Board shall jointly contract with an
2 independent party to conduct a comprehensive evaluation of the
3 certificate renewal system pursuant to this Section. The first
4 report of this evaluation shall be presented to the General
5 Assembly on January 1, 2005 and on January 1 of every third
6 year thereafter.
7     (m) The changes made to this Section by this amendatory Act
8 of the 93rd General Assembly that affect renewal of Standard
9 and Master Certificates shall apply to those persons who hold
10 Standard or Master Certificates on or after the effective date
11 of this amendatory Act of the 93rd General Assembly and shall
12 be given effect upon renewal of those certificates.

16     Sec. 21-16. Fees - Requirement for registration.
17     (a) Until February 15, 2000, every applicant when issued a
18 certificate shall pay to the regional superintendent of schools
19 a fee of $1, which shall be paid into the institute fund. Every
20 certificate issued under the provisions of this Act shall be
21 registered annually or, at the option of the holder of the
22 certificate, once every 3 years. The regional superintendent of
23 schools having supervision and control over the school where
24 the teaching is done shall register the certificate before the
25 holder begins to teach, otherwise it shall be registered in any
26 county in the State of Illinois; and one fee of $4 per year for
27 registration or renewal of one or more certificates which have
28 been issued to the same holder shall be paid into the institute
29 fund.
30     Until February 15, 2000, requirements for registration of
31 any certificate limited in time shall include evidence of
32 professional growth defined as successful teaching experience
33 since last registration of certificate, attendance at

1 professional meetings, membership in professional
2 organizations, additional credits earned in recognized
3 teacher-training institutions, travel specifically for
4 educational experience, reading of professional books and
5 periodicals, filing all reports as required by the regional
6 superintendent of schools and the State Superintendent of
7 Education or such other professional experience or combination
8 of experiences as are presented by the teacher and are approved
9 by the State Superintendent of Education in consultation with
10 the State Teacher Certification Board. A duplicate certificate
11 may be issued to the holder of a valid life certificate or
12 valid certificate limited in time by the State Superintendent
13 of Education; however, it shall only be issued upon request of
14 a regional superintendent of schools and upon payment to the
15 regional superintendent of schools who requests such duplicate
16 a fee of $4.
17     (b) Beginning February 15, 2000, all persons who are issued
18 Standard Teaching Certificates pursuant to clause (ii) of
19 paragraph (1) of subsection (c) of Section 21-2 and all persons
20 who renew Standard Teaching Certificates shall pay a $25 fee
21 for registration of all certificates held. All persons who are
22 issued Standard Teaching Certificates under clause (i) of
23 paragraph (1) of subsection (c) of Section 21-2 and all other
24 applicants for Standard Teaching Certificates shall pay an
25 original application fee, pursuant to Section 21-12, and a $25
26 fee for registration of all certificates held. These
27 certificates shall be registered and the registration fee paid
28 once every 5 years. Standard Teaching Certificate applicants
29 and holders shall not be required to pay any other registration
30 fees for issuance or renewal of their certificates, except as
31 provided in Section 21-17 of this Code. Beginning February 15,
32 2000, Master Teaching Certificates shall be issued and renewed
33 upon payment by the applicant or certificate holder of a $50
34 fee for registration of all certificates held. These

1 certificates shall be registered and the fee paid once every 10
2 years. Master Teaching Certificate applicants and holders
3 shall not be required to pay any other application or
4 registration fees for issuance or renewal of their
5 certificates, except as provided in Section 21-17 of this Code.
6 All other certificates issued under the provisions of this Code
7 shall be registered for the validity period of the certificate
8 at the rate of $5 per year for the total number of years for
9 which the certificate is valid for registration of all
10 certificates held, or for a maximum of 5 years for life
11 certificates. The regional superintendent of schools having
12 supervision and control over the school where the teaching is
13 done shall register the certificate before the holder begins to
14 teach, otherwise it shall be registered in any county in the
15 State of Illinois. Each holder shall pay the appropriate
16 registration fee to the regional superintendent of schools. The
17 regional superintendent of schools shall deposit the
18 registration fees into the institute fund. Any certificate
19 holder who teaches in more than one educational service region
20 shall register the certificate or certificates in all regions
21 where the teaching is done, but shall be required to pay one
22 registration fee for all certificates held, provided holders of
23 certificates issued pursuant to Section 21-9 of this Code shall
24 be required to pay one registration fee, in each educational
25 service region in which his or her certificate or certificates
26 are registered, for all certificates held.
27     A duplicate certificate may be issued to the holder of a
28 valid life certificate or valid certificate limited in time by
29 the State Superintendent of Education; however, it shall only
30 be issued upon request of a regional superintendent of schools
31 and upon payment to the regional superintendent of schools who
32 requests the duplicate a fee of $4, which shall be deposited
33 into the institute fund.
34     The State Board of Education and each regional office of

1 education are authorized to charge a service or convenience fee
2 for the use of credit cards for the payment of certification
3 fees. This service or convenience fee may not exceed the amount
4 required by the credit card processing company or vendor that
5 has entered into a contract with the State Board or regional
6 office of education for this purpose, and the fee must be paid
7 to that company or vendor.

10     Sec. 21-17. Fee and duplicate certificate. A duplicate
11 certificate shall be issued by the State Superintendent of
12 Education when requested by the regional superintendent of
13 schools as provided in Section 21-16. The request for a
14 duplicate certificate shall be accompanied by a fee of $4,
15 which shall be deposited into the Teacher Certificate Fee
16 Revolving Fund.
17     The State Board of Education and each regional office of
18 education are authorized to charge a service or convenience fee
19 for the use of credit cards for the payment of certification
20 fees. This service or convenience fee may not exceed the amount
21 required by the credit card processing company or vendor that
22 has entered into a contract with the State Board or regional
23 office of education for this purpose, and the fee must be paid
24 to that company or vendor.

27     Sec. 21-18. Registration of life certificate-Fee.
28     The holder of any life certificate, while he continues to
29 teach, shall annually before entering upon his duties, present
30 his certificate or proper evidence thereof to the regional
31 county superintendent of schools for registration and pay a fee
32 of $2, which fee shall be paid into the institute fund.

11     Sec. 21-23. Suspension or revocation of certificate.
12     (a) Any certificate issued pursuant to this Article,
13 including but not limited to any administrative certificate or
14 endorsement, may be suspended for a period not to exceed one
15 calendar year by the regional superintendent or for a period
16 not to exceed 5 calendar years by the State Superintendent of
17 Education upon evidence of immorality, a condition of health
18 detrimental to the welfare of pupils, incompetency,
19 unprofessional conduct, the neglect of any professional duty,
20 willful failure to report an instance of suspected child abuse
21 or neglect as required by the Abused and Neglected Child
22 Reporting Act, failure to establish satisfactory repayment on
23 an educational loan guaranteed by the Illinois Student
24 Assistance Commission, or other just cause. Unprofessional
25 conduct shall include refusal to attend or participate in,
26 institutes, teachers' meetings, professional readings, or to
27 meet other reasonable requirements of the regional
28 superintendent or State Superintendent of Education.
29 Unprofessional conduct also includes conduct that violates the
30 standards, ethics, or rules applicable to the security,
31 administration, monitoring, or scoring of, or the reporting of
32 scores from, any assessment test or the Prairie State
33 Achievement Examination administered under Section 2-3.64 or

1 that is known or intended to produce or report manipulated or
2 artificial, rather than actual, assessment or achievement
3 results or gains from the administration of those tests or
4 examinations. It shall also include neglect or unnecessary
5 delay in making of statistical and other reports required by
6 school officers. The regional superintendent or State
7 Superintendent of Education shall upon receipt of evidence of
8 immorality, a condition of health detrimental to the welfare of
9 pupils, incompetency, unprofessional conduct, the neglect of
10 any professional duty or other just cause serve written notice
11 to the individual and afford the individual opportunity for a
12 hearing prior to suspension. If a hearing is requested within
13 10 days of notice of opportunity for hearing it shall act as a
14 stay of proceedings not to exceed 30 days, unless the
15 individual requests a delay. In such an instance, the stay of
16 proceedings must be continued for another 30 days. No
17 certificate shall be suspended until the teacher has an
18 opportunity for a hearing at the educational service region.
19 When a certificate is suspended, the right of appeal shall lie
20 to the State Teacher Certification Board. When an appeal is
21 taken within 10 days after notice of suspension it shall act as
22 a stay of proceedings not to exceed 120 60 days. If a
23 certificate is suspended for a period greater than one year,
24 the State Superintendent of Education shall review the
25 suspension prior to the expiration of that period to determine
26 whether the cause for the suspension has been remedied or
27 continues to exist. Upon determining that the cause for
28 suspension has not abated, the State Superintendent of
29 Education may order that the suspension be continued for an
30 appropriate period. Nothing in this Section prohibits the
31 continuance of such a suspension for an indefinite period if
32 the State Superintendent determines that the cause for the
33 suspension remains unabated. Any certificate may be revoked for
34 the same reasons as for suspension by the State Superintendent

1 of Education. No certificate shall be revoked until the teacher
2 has an opportunity for a hearing before the State Teacher
3 Certification Board, which hearing must be held within 120 60
4 days from the date the appeal is taken, unless the State
5 Teacher Certification Board requests a delay. In such an
6 instance, the stay of the revocation proceedings must be
7 continued until the completion of the proceedings.
8     The State Board may refuse to issue or may suspend the
9 certificate of any person who fails to file a return, or to pay
10 the tax, penalty or interest shown in a filed return, or to pay
11 any final assessment of tax, penalty or interest, as required
12 by any tax Act administered by the Illinois Department of
13 Revenue, until such time as the requirements of any such tax
14 Act are satisfied.
15     (b) Any certificate issued pursuant to this Article may be
16 suspended for an appropriate length of time as determined by
17 either the regional superintendent or State Superintendent of
18 Education upon evidence that the holder of the certificate has
19 been named as a perpetrator in an indicated report filed
20 pursuant to the Abused and Neglected Child Reporting Act,
21 approved June 26, 1975, as amended, and upon proof by clear and
22 convincing evidence that the licensee has caused a child to be
23 an abused child or neglected child as defined in the Abused and
24 Neglected Child Reporting Act.
25     The regional superintendent or State Superintendent of
26 Education shall, upon receipt of evidence that the certificate

6 The State Superintendent may revoke any certificate upon proof
7 at hearing by clear and convincing evidence that the
8 certificate holder has caused a child to be an abused child or
9 neglected child as defined in the Abused and Neglected Child
10 Reporting Act. No certificate shall be revoked until the
11 teacher has an opportunity for a hearing before the State
12 Teacher Certification Board, which hearing must be held within
13 120 60 days from the date the appeal is taken, unless the
14 teacher or the hearing officer appointed by the State Teacher
15 Certification Board requests a delay. In such an instance, the
16 stay of the revocation proceedings must be continued until the
17 completion of the proceedings.
18     (c) The State Superintendent of Education or a person
19 designated by him shall have the power to administer oaths to
20 witnesses at any hearing conducted before the State Teacher
21 Certification Board pursuant to this Section. The State
22 Superintendent of Education or a person designated by him is
23 authorized to subpoena and bring before the State Teacher
24 Certification Board any person in this State and to take
25 testimony either orally or by deposition or by exhibit, with
26 the same fees and mileage and in the same manner as prescribed
27 by law in judicial proceedings in the civil cases in circuit
28 courts of this State.
29     Any circuit court, upon the application of the State
30 Superintendent of Education, may, by order duly entered,
31 require the attendance of witnesses and the production of
32 relevant books and papers at any hearing the State
33 Superintendent of Education is authorized to conduct pursuant
34 to this Section, and the court may compel obedience to its

1 orders by proceedings for contempt.
2     (d) As used in this Section, "teacher" means any school
3 district employee regularly required to be certified, as
4 provided in this Article, in order to teach or supervise in the
5 public schools.

7     Section 90. The State Mandates Act is amended by adding
8 Section 8.28 as follows:
 
9     (30 ILCS 805/8.28 new)
10     Sec. 8.28. Exempt mandate. Notwithstanding Sections 6 and 8
11 of this Act, no reimbursement by the State is required for the
12 implementation of any mandate created by this amendatory Act of
13 the 93rd General Assembly.
14     Section 99. Effective date. This Act takes effect upon
15 becoming law.".
