1 AN ACT in relation to civil procedure.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Code of Civil Procedure is amended by
5 changing Section 12-103 as follows:
6 (735 ILCS 5/12-103) (from Ch. 110, par. 12-103)
7 Sec. 12-103. Representative capacity. A judgment
8 entered against a person not as a result of a contract made
9 by him or her or a tort committed by him or her but solely
10 because he or she is the holder of title to property as
11 receiver, trustee of a specifically identified trust,
12 representative as defined in Section 1-2.11 of the Probate
13 Act of 1975, or in any other fiduciary capacity, shall be
14 enforced only against property held in the particular
15 representative capacity, but no judgment shall be enforced
16 against, nor shall the judgment constitute a lien upon, other
17 property owned by thatsuch person, whether individually or
18 in some other designated identifiable representative
19 capacity.
