1 AN ACT in relation to property.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Conveyances Act is amended by changing
5 Section 1 as follows:
6 (765 ILCS 5/1) (from Ch. 30, par. 1)
7 Sec. 1. Livery of seizin not necessary. Livery of
8 seizin shall in no case be necessary for the conveyance of
9 real property; but every deed, mortgage or other conveyance
10 in writing, not procured by duress, and signed by the party
11 making the same, the maker or makers being of full age and
12 sound mind, shall be sufficient, without livery of seizin,
13 for the giving, granting, selling, mortgaging, leasing or
14 otherwise conveying or transferring any lands, tenements or
15 hereditaments in this state, so as, to all intents and
16 purposes, absolutely and fully to vest in every donee,
17 grantee, bargainee, mortgagee, lessee or purchaser, all such
18 estate or estates as shall be specified in any such deed,
19 mortgage, lease or other conveyance. Nothing herein contained
20 shall be so construed as to divest or defeat the older or
21 better estate or right of any person or persons, not party to
22 any such deed, mortgage, lease, or other conveyance.
