1 AMENDMENT TO HOUSE BILL 2105
2 AMENDMENT NO. . Amend House Bill 2105 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The School Code is amended by changing
5 Section 11A-9 as follows:
6 (105 ILCS 5/11A-9) (from Ch. 122, par. 11A-9)
7 Sec. 11A-9. Tax levy. The board of education of a
8 community unit district may levy taxes for educational,
9 operations and maintenance and the purchase and improvements
10 of school grounds, pupil transportation, and fire prevention
11 and safety purposes, respectively, at not exceeding the rates
12 specified in the petition, which rates may thereafter be
13 increased or decreased in the same manner and within the
14 limits provided by Sections 17-2 through 17-7. The board of
15 education may further levy taxes for other purposes as
16 generally permitted by law.
17 If the election of the board of education of the new
18 district occurs at the general election or the nonpartisan
19 election (or the consolidated election beginning in 2003) and
20 the board of education makes its initial levy in that same
21 year, the county clerk shall extend such levy notwithstanding
22 any other law which requires the adoption of a budget before

1 the clerk may extend such levy. In addition, the districts
2 from which the new district is formed, by joint agreement and
3 with the approval of the regional superintendent, shall be
4 permitted to amend outstanding levies in the same calendar
5 year in which the creation of the new district is approved at
6 the rates specified in the petition.
7 If the election of the board of education of the new
8 district does not occur in the same calendar year that the
9 proposition to create the new district is approved, the
10 districts from which the new district is formed, by joint
11 agreement and with the approval of the regional
12 superintendent, shall be permitted to levy in the same
13 calendar year in which the creation of the new district is
14 approved at the rates specified in the petition. The county
15 clerks shall extend any such levy notwithstanding any law
16 that requires adoption of a budget before extension of the
17 levy.

19 Section 99. Effective date. This Act takes effect upon
