 1                    AMENDMENT TO HOUSE BILL 3493

 2        AMENDMENT NO.     .  Amend House Bill 3493,  AS  AMENDED,
 3    by  replacing  everything  after the enacting clause with the
 4    following:

 5        "Section 5. The State Finance Act is  amended  by  adding
 6    Section 5.595 as follows:

 7        (30 ILCS 105/5.595 new)
 8        Sec.  5.595.  The  Methamphetamine Manufacturing Facility
 9    Cleanup Fund.

10        Section 10. The Illinois  Controlled  Substances  Act  is
11    amended by adding Section 411.3 as follows:

12        (720 ILCS 570/411.3 new)
13        Sec.   411.3.  Methamphetamine   Manufacturing   Facility
14    Cleanup Fund.
15        (a)  There   is   created  in  the  State  treasury,  the
16    Methamphetamine Manufacturing Facility Cleanup Fund. A person
17    convicted of a violation  of  Section  401  of  this  Act  by
18    manufacturing    methamphetamine    or    by   possessing   a
19    methamphetamine manufacturing chemical  with  the  intent  to
20    manufacture  methamphetamine  shall be assessed an additional

 1    fine by the court to pay for  the  cost  of  cleanup  of  the
 2    facility in which the methamphetamine was being manufactured.
 3        (b)  The  court  shall  impose  a minimum fine of $5 upon
 4    each person convicted of a violation of Section 401  of  this
 5    Act  by  manufacturing  methamphetamine  or  by  possessing a
 6    methamphetamine manufacturing chemical or  a  methamphetamine
 7    precursor with the intent to manufacture methamphetamine. The
 8    proceeds   of   the   fine   shall   be  deposited  into  the
 9    Methamphetamine Manufacturing Facility Cleanup Fund.
10        (c)  The Methamphetamine Manufacturing  Facility  Cleanup
11    Fund  shall  be  administered by the Environmental Protection
12    Agency.  The Agency shall make grants from the Fund to  units
13    of  local  government  to  pay  for  the  cost  of cleanup of
14    facilities   in   which   the   methamphetamine   was   being
15    manufactured.  The Agency shall adopt  rules  specifying  the
16    manner  in  which  units  of  local  government may apply for
17    grants under this Section.".
