AMENDMENT TO HOUSE BILL 3835

2     AMENDMENT NO. ______. Amend House Bill 3835 by deleting
3 everything after the enacting clause and inserting the
4 following:
 
 
5     "Section 5. The Illinois Vehicle Code is amended by
6 changing Sections 3-609, 3-609.1, 3-620, 3-621, 3-622, 3-623,
7 3-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650,
8 3-651, and 3-806.4 as follows:
 
9     (625 ILCS 5/3-609)  (from Ch. 95 1/2, par. 3-609)
10     Sec. 3-609. Disabled Veterans' Plates. Any disabled
11 veteran who has been or declared eligible for funds for the
12 purchase of a motor vehicle of the first division or for a
13 motor vehicle of the second division weighing not more than
14 8,000 pounds by the United States Federal Government because of
15 his disability, may make application for the registration of
16 one such vehicle, to the Secretary of State without the payment
17 of any registration fee. Registration shall be for a multi-year
18 period effective in 1980 and may be issued staggered
19 registration.
20     Any disabled veteran of World War I, of World War II, of
21 the National Emergency between June 25, 1950 and January 31,
22 1955 or of the period beginning February 1, 1955 and ending on
23 the day before the first day thereafter in which individuals

1 (other than individuals liable for induction by reason of prior
2 deferment) are no longer liable for induction for training and
3 service into the armed forces under the Military Selective
4 Service Act of 1967, or of any armed conflict involving the
5 armed forces of the United States, who has a service-connected
6 disability of such a nature that it would, if it had been
7 incurred in World War II, have entitled him to be awarded an
8 automobile by the United States Federal Government, or who is
9 receiving compensation from the Veterans Administration for
10 total service-connected disability, may make application to
11 the Secretary of State for the registration of one motor
12 vehicle of the first division without accompanying such
13 application with the payment of any fee.
14     Renewal of such registration must be accompanied with
15 documentation for eligibility of registration without fee
16 unless the applicant has a permanent qualifying disability, and
17 such registration plates may not be issued to any person not
18 eligible therefor.
19     The Illinois Veterans Commission may assist in providing
20 the documentation of disability.
21     Any license plate manufactured on or after January 1, 2005
22 and issued under this Section must:
23         (1) be manufactured in the United States; and
24         (2) if a suitable manufacturing facility is available
25     in this State, be manufactured in this State.

27     (625 ILCS 5/3-609.1)  (from Ch. 95 1/2, par. 3-609.1)
28     Sec. 3-609.1. Congressional Medal of Honor plates. Any
29 resident of the State of Illinois who has been awarded the
30 Congressional Medal of Honor may make application for the
31 registration of a motor vehicle owned solely or in part by such
32 recipient, to the Secretary of State without the payment of any
33 registration fee. Registration shall be for a multi-year period

1 effective from issuance. The Secretary of State shall furnish
2 at his office at no cost to such Congressional Medal of Honor
3 recipients, plates bearing up to 3 letters designating the
4 recipient's initials followed by the letters C M H signifying
5 the Congressional Medal of Honor. The plate shall be suitable
6 for attachment to a motor vehicle or motorcycle registered
7 under this Code.
8     Any license plate manufactured on or after January 1, 2005
9 and issued under this Section must:
10         (1) be manufactured in the United States; and
11         (2) if a suitable manufacturing facility is available
12     in this State, be manufactured in this State.

14     (625 ILCS 5/3-620)  (from Ch. 95 1/2, par. 3-620)
15     Sec. 3-620. The Secretary, upon receipt of an application
16 made on the form prescribed by the Secretary of State, may
17 issue special registration plates to United States citizens,
18 who are present or former members of the United States armed
19 forces or any of its allies, and who were prisoners of war of
20 World War I, World War II, the Korean Conflict, and the
21 Vietnamese conflict, or to the widowed spouse of a former
22 member of the United States armed forces, providing that
23 widowed spouse was married to the POW at the time of death, and
24 is a single person at the time of application. The special
25 plates issued pursuant to this Section shall be affixed only to
26 passenger vehicles of the first division subject to the
27 staggered registration system, motorcycles, and vehicles of
28 the second division having a gross weight of 8,000 pounds or
29 less and shall be issued without charge. Only one set of plates
30 may be issued at no fee.
31     The design and color of the prisoner of war plates shall be
32 wholly within the discretion of the Secretary of State.
33     Any license plate manufactured on or after January 1, 2005

1 and issued under this Section must:
2         (1) be manufactured in the United States; and
3         (2) if a suitable manufacturing facility is available
4     in this State, be manufactured in this State.

7     Sec. 3-621. The Secretary, upon receipt of an application,
8 made in the form prescribed by the Secretary of State, may
9 issue to members of the Illinois National Guard, and to
10 Illinois residents who are either former members of the
11 Illinois National Guard or the surviving spouses of Illinois
12 National Guard members, special registration plates. The
13 special plates issued pursuant to this Section shall be affixed
14 only to passenger vehicles of the first division, motorcycles,
15 or motor vehicles of the second division weighing not more than
16 8,000 pounds subject to the staggered registration system.
17     The design and color of such plates shall be wholly within
18 the discretion of the Secretary of State.
19     Any license plate manufactured on or after January 1, 2005
20 and issued under this Section must:
21         (1) be manufactured in the United States; and
22         (2) if a suitable manufacturing facility is available
23     in this State, be manufactured in this State.

27     Sec. 3-622. The Secretary, upon receipt of an application

29 issue to members of the United States Armed Forces Reserves who
30 reside in Illinois, and to Illinois residents who are either
31 former members of the United States Armed Forces Reserves or

2 The special plates issued pursuant to this Section shall be
3 affixed only to passenger vehicles of the first division,
4 motorcycles, or motor vehicles of the second division weighing
5 not more than 8,000 pounds subject to the staggered
6 registration system. The design and color of such plates shall
7 be wholly within the discretion of the Secretary of State.
8     Any license plate manufactured on or after January 1, 2005
9 and issued under this Section must:
10         (1) be manufactured in the United States; and
11         (2) if a suitable manufacturing facility is available
12     in this State, be manufactured in this State.

16     Sec. 3-623. Purple Heart Plates. The Secretary, upon
17 receipt of an application made in the form prescribed by the
18 Secretary of State, may issue to recipients awarded the Purple
19 Heart by a branch of the armed forces of the United States who
20 reside in Illinois, special registration plates. The special
21 plates issued pursuant to this Section should be affixed only
22 to passenger vehicles of the 1st division, including
23 motorcycles, or motor vehicles of the 2nd division weighing not
24 more than 8,000 pounds.
25     The design and color of such plates shall be wholly within
26 the discretion of the Secretary of State. Appropriate
27 documentation, as determined by the Secretary, and the
28 appropriate registration fee shall accompany the application.
29 However, for an individual who has been issued Purple Heart
30 plates for a vehicle and who has claimed and received a grant
31 under the Senior Citizens and Disabled Persons Property Tax
32 Relief and Pharmaceutical Assistance Act, the annual fee for
33 the registration of the vehicle shall be as provided in Section

1 3-806.3 of this Code.
2     Any license plate manufactured on or after January 1, 2005
3 and issued under this Section must:
4         (1) be manufactured in the United States; and
5         (2) if a suitable manufacturing facility is available
6     in this State, be manufactured in this State.

10     Sec. 3-624. The Secretary, upon receipt of an application
11 made in the form prescribed by the Secretary of State, may
12 issue to retired members of the United States Armed Forces who
13 reside in Illinois, special registration plates. The special
14 plates issued pursuant to this Section shall be affixed only to
15 passenger vehicles of the first division, motorcycles, or motor
16 vehicles of the second division weighing not more than 8,000
17 pounds and subject to the staggered registration system. The
18 design and color of such plates shall be wholly within the
19 discretion of the Secretary of State.
20     Any license plate manufactured on or after January 1, 2005
21 and issued under this Section must:
22         (1) be manufactured in the United States; and
23         (2) if a suitable manufacturing facility is available
24     in this State, be manufactured in this State.

27     Sec. 3-625. Pearl Harbor Plates. The Secretary, upon
28 receipt of an application made in the form prescribed by the
29 Secretary of State, may issue special registration plates to
30 any Illinois resident who, while a member of the armed forces
31 of the United States, participated in the battle of Pearl
32 Harbor on December 7, 1941, or to the widowed spouse of any

1 Illinois resident who, while a member of the armed forces of
2 the United States, participated in the battle of Pearl Harbor
3 on December 7, 1941, provided that the widowed spouse was
4 married to the battle of Pearl Harbor participant at the time
5 of the participant's death and is a single person at the time
6 of application. The special plates issued pursuant to this
7 Section should be affixed only to passenger vehicles of the 1st
8 division, motorcycles, or motor vehicles of the 2nd division
9 weighing not more than 8,000 pounds.
10     The design and color of such plates shall be wholly within
11 the discretion of the Secretary of State. Appropriate
12 documentation, as determined by the Secretary, and the
13 appropriate registration fee shall accompany the application.
14     Any license plate manufactured on or after January 1, 2005
15 and issued under this Section must:
16         (1) be manufactured in the United States; and
17         (2) if a suitable manufacturing facility is available
18     in this State, be manufactured in this State.

21     (625 ILCS 5/3-626)
22     Sec. 3-626. Korean War Veteran license plates.
23     (a) In addition to any other special license plate, the
24 Secretary, upon receipt of all applicable fees and applications
25 made in the form prescribed by the Secretary of State, may
26 issue special registration plates designated as Korean War
27 Veteran license plates to residents of Illinois who
28 participated in the United States Armed Forces during the
29 Korean War. The special plate issued under this Section shall
30 be affixed only to passenger vehicles of the first division,
31 motorcycles, motor vehicles of the second division weighing not
32 more than 8,000 pounds, and recreational vehicles as defined by
33 Section 1-169 of this Code. Plates issued under this Section

1 shall expire according to the staggered multi-year procedure
2 established by Section 3-414.1 of this Code.
3     (b) The design, color, and format of the plates shall be
4 wholly within the discretion of the Secretary of State. The
5 Secretary may, in his or her discretion, allow the plates to be
6 issued as vanity plates or personalized in accordance with
7 Section 3-405.1 of this Code. The plates are not required to
8 designate "Land Of Lincoln", as prescribed in subsection (b) of
9 Section 3-412 of this Code. The Secretary shall prescribe the
10 eligibility requirements and, in his or her discretion, shall
11 approve and prescribe stickers or decals as provided under
12 Section 3-412.
13     (c) An applicant shall be charged a $15 fee for original
14 issuance in addition to the applicable registration fee. Of
15 this additional fee, $13 shall be deposited into the Secretary
16 of State Special License Plate Fund and $2 shall be deposited
17 into the Korean War Memorial Construction Fund.
18     (d) The Korean War Memorial Construction Fund is created as
19 a special fund in the State treasury. All moneys in the Korean
20 War Memorial Construction Fund shall, subject to
21 appropriation, be used by the Department of Veteran Affairs to
22 provide grants for construction of the Korean War Memorial to
23 be located at Oak Ridge Cemetery in Springfield, Illinois. Upon
24 the completion of the Memorial, the Department of Veteran
25 Affairs shall certify to the State Treasurer that the
26 construction of the Memorial has been completed. Upon the
27 certification by the Department of Veteran Affairs, the State
28 Treasurer shall transfer all moneys in the Fund and any future
29 deposits into the Fund into the Secretary of State Special
30 License Plate Fund.
31     (e) An individual who has been issued Korean War Veteran
32 license plates for a vehicle and who has claimed and received a
33 grant under the Senior Citizens and Disabled Persons Property
34 Tax Relief and Pharmaceutical Assistance Act shall pay the

1 original issuance and the regular annual fee for the
2 registration of the vehicle as provided in Section 3-806.3 of
3 this Code in addition to the fees specified in subsection (c)
4 of this Section.
5     (f) Any license plate manufactured on or after January 1,
6 2005 and issued under this Section must:
7         (1) be manufactured in the United States; and
8         (2) if a suitable manufacturing facility is available
9     in this State, be manufactured in this State.

12     Sec. 3-628. Bronze Star plates.
13     (a) Beginning January 1, 1996, in addition to any other
14 special license plate, the Secretary, upon receipt of all
15 applicable fees and applications made in the form prescribed by
16 the Secretary of State, may issue special registration plates
17 to residents of Illinois who have been awarded the Bronze Star
18 by the United States Armed Forces. The special plate issued
19 under this Section shall be affixed only to passenger vehicles
20 of the first division, motorcycles, or motor vehicles of the
21 second division weighing not more than 8,000 pounds. Plates
22 issued under this Section shall expire according to the
23 staggered multi-year procedure established by Section 3-414.1
24 of this Code.
25     (b) The design, color, and format of the plates shall be
26 wholly within the discretion of the Secretary of State. The
27 Secretary may, in his or her discretion, allow the plates to be
28 issued as vanity plates or personalized in accordance with
29 Section 3-405.1 of this Code. The plates are not required to
30 designate "Land Of Lincoln", as prescribed in subsection (b) of
31 Section 3-412 of this Code. The Secretary shall prescribe the
32 eligibility requirements and, in his or her discretion, shall

7 2005 and issued under this Section must:
8         (1) be manufactured in the United States; and
9         (2) if a suitable manufacturing facility is available
10     in this State, be manufactured in this State.

13     Sec. 3-638. U.S. Veteran License Plates.
14     (a) In addition to any other special license plate, the

17 issue U.S. Veteran license plates to residents of Illinois who
18 meet eligibility requirements prescribed by the Secretary of
19 State. The special U.S. Veteran plate issued under this Section
20 shall be affixed only to passenger vehicles of the first
21 division, motorcycles, and motor vehicles of the second
22 division weighing not more than 8,000 pounds. Plates issued
23 under this Section shall expire according to the staggered
24 multi-year procedure established by Section 3-414.1 of this
25 Code.
26     (b) The design, color, and format of the plates shall be
27 wholly within the discretion of the Secretary of State. The
28 Secretary may, in his or her discretion, allow the plates to be
29 issued as vanity plates or personalized in accordance with
30 Section 3-405.1 of this Code. The plates are not required to

14     Sec. 3-642. Silver Star plates.
15     (a) The Secretary, upon receipt of all applicable fees and
16 applications made in the form prescribed by the Secretary, may
17 issue special registration plates to residents of Illinois who
18 have been awarded the Silver Star by the United States Armed
19 Forces. The special plate issued under this Section shall be
20 affixed only to passenger vehicles of the first division,
21 motorcycles, or motor vehicles of the second division weighing
22 not more than 8,000 pounds. Plates issued under this Section
23 shall expire according to the staggered multi-year procedure
24 established by Section 3-414.1 of this Code.
25     (b) The design, color, and format of the plates shall be
26 wholly within the discretion of the Secretary. The Secretary
27 may, in his or her discretion, allow the plates to be issued as
28 vanity plates or personalized in accordance with Section
29 3-405.1 of this Code. The plates are not required to designate
30 "Land Of Lincoln", as prescribed in subsection (b) of Section
31 3-412 of this Code. The Secretary shall prescribe the
32 eligibility requirements and, in his or her discretion, shall
33 approve and prescribe stickers or decals as provided under

13     Sec. 3-645. Vietnam Veteran License Plates.
14     (a) In addition to any other special license plate, the
15 Secretary, upon receipt of all applicable fees and applications
16 made in the form prescribed by the Secretary of State, may
17 issue Vietnam Veteran license plates to residents of Illinois
18 who meet eligibility requirements prescribed by the Secretary
19 of State. The special Vietnam Veteran plate issued under this
20 Section shall be affixed only to passenger vehicles of the
21 first division, motorcycles, and motor vehicles of the second
22 division weighing not more than 8,000 pounds. Plates issued
23 under this Section shall expire according to the staggered
24 multi-year procedure established by Section 3-414.1 of this
25 Code.
26     (b) The design, color, and format of the plates shall be
27 wholly within the discretion of the Secretary of State. The
28 Secretary may, in his or her discretion, allow the plates to be
29 issued as vanity plates or personalized in accordance with
30 Section 3-405.1 of this Code. The plates are not required to
31 designate "Land Of Lincoln", as prescribed in subsection (b) of
32 Section 3-412 of this Code. The Secretary shall prescribe the

22 vehicles of the first division, motorcycles, and motor vehicles
23 of the second division weighing not more than 8,000 pounds.
24 Plates issued under this Section shall expire according to the
25 staggered multi-year procedure established by Section 3-414.1
26 of this Code.

15     Sec. 3-650. Army Combat Veteran license plates.
16     (a) In addition to any other special license plate, the
17 Secretary, upon receipt of all applicable fees and applications
18 made in the form prescribed by the Secretary of State, may
19 issue Army Combat Veteran license plates to residents of
20 Illinois who meet eligibility requirements prescribed by the
21 Secretary of State. The special Army Combat Veteran plate
22 issued under this Section shall be affixed only to passenger
23 vehicles of the first division, motorcycles, and motor vehicles
24 of the second division weighing not more than 8,000 pounds.
25 Plates issued under this Section shall expire according to the
26 staggered multi-year procedure established by Section 3-414.1
27 of this Code.
28     (b) The plates shall display the Army Combat Infantry
29 Badge. In all other respects, the design, color, and format of
30 the plates shall be within the discretion of the Secretary of
31 State. The Secretary may, in his or her discretion, allow the
32 plates to be issued as vanity plates or personalized in
33 accordance with Section 3-405.1 of this Code. The plates are

1 not required to designate "Land Of Lincoln", as prescribed in
2 subsection (b) of Section 3-412 of this Code. The Secretary
3 shall prescribe the eligibility requirements and, in his or her
4 discretion, shall approve and prescribe stickers or decals as
5 provided under Section 3-412.
6     (c) An applicant shall be charged a $15 fee for original
7 issuance in addition to the applicable registration fee. This
8 additional fee shall be deposited into the Secretary of State
9 Special License Plate Fund.
10     (d) Any license plate manufactured on or after January 1,
11 2005 and issued under this Section must:
12         (1) be manufactured in the United States; and
13         (2) if a suitable manufacturing facility is available
14     in this State, be manufactured in this State.

18     Sec. 3-651. U.S. Marine Corps license plates.
19     (a) In addition to any other special license plate, the
20 Secretary, upon receipt of all applicable fees and applications
21 made in the form prescribed by the Secretary of State, may
22 issue special registration plates designated as U.S. Marine
23 Corps license plates to residents of Illinois who meet
24 eligibility requirements prescribed by the Secretary of State.
25 The special plate issued under this Section shall be affixed
26 only to passenger vehicles of the first division, motorcycles,
27 motor vehicles of the second division weighing not more than
28 8,000 pounds, and recreational vehicles as defined by Section
29 1-169 of this Code. Plates issued under this Section shall
30 expire according to the staggered multi-year procedure
31 established by Section 3-414.1 of this Code.
32     (b) The design, color, and format of the plates shall be
33 wholly within the discretion of the Secretary of State, except

1 that the U.S. Marine Corps emblem shall appear on the plates.
2 The Secretary may, in his or her discretion, allow the plates
3 to be issued as vanity or personalized plates in accordance
4 with Section 3-405.1 of this Code. The plates are not required
5 to designate "Land Of Lincoln", as prescribed in subsection (b)
6 of Section 3-412 of this Code. The Secretary shall prescribe
7 the eligibility requirements and, in his or her discretion,
8 shall approve and prescribe stickers or decals as provided
9 under Section 3-412.
10     (c) An applicant shall be charged a $20 fee for original
11 issuance in addition to the applicable registration fee. Of
12 this additional fee, $15 shall be deposited into the Secretary
13 of State Special License Plate Fund and $5 shall be deposited
14 into the Marine Corps Scholarship Fund. For each registration
15 renewal period, a $20 fee, in addition to the appropriate
16 registration fee, shall be charged. Of this additional fee, $2
17 shall be deposited into the Secretary of State Special License
18 Plate Fund and $18 shall be deposited into the Marine Corps
19 Scholarship Fund.
20     (d) The Marine Corps Scholarship Fund is created as a
21 special fund in the State treasury. All moneys in the Marine
22 Corps Scholarship Fund shall, subject to appropriation by the
23 General Assembly and approval by the Secretary, be used by the
24 Marine Corps Scholarship Foundation, Inc., a recognized
25 charitable organization that meets the requirements of Title
26 26, Section 501(c)(3) of the United States Code, to provide
27 grants for scholarships for higher education. The scholarship
28 recipients must be the children of current or former members of
29 the United States Marine Corps who meet the academic,
30 financial, and other requirements established by the Marine
31 Corps Scholarship Foundation. In addition, the recipients must
32 be Illinois residents and must attend a college or university
33 located within the State of Illinois.
34     The State Treasurer shall require the Marine Corps

1 Scholarship Foundation to establish a separate account for
2 receipt of the proceeds of the Marine Corps Scholarship Fund.
3 That account shall be subject to audit either annually or at
4 another interval, as determined by the State Treasurer.
5 Proceeds from the Marine Corps Scholarship Fund shall be
6 transferred on a quarterly basis by the State Treasurer's
7 office to this separate account.
8     (e) Any license plate manufactured on or after January 1,
9 2005 and issued under this Section must:
10         (1) be manufactured in the United States; and
11         (2) if a suitable manufacturing facility is available
12     in this State, be manufactured in this State.

16     Sec. 3-806.4. Gold Star recipients. Commencing with the
17 1991 registration year, upon proper application, the Secretary
18 of State shall issue one pair of registration plates to any
19 Illinois resident, who as the surviving widow or widower, or in
20 the absence thereof, as the surviving parent, is awarded the
21 Gold Star by the United States in recognition of spouses or
22 children who served in the Armed Forces of the United States
23 and lost their lives while in service whether in peacetime or
24 war. If the parent no longer survives, the Secretary of State
25 shall issue the plates to a surviving sibling, of the person
26 who served in the Armed Forces, who is an Illinois resident. No
27 more than one set of plates shall be issued for each Gold Star
28 awarded, and only one surviving parent, or in the absence of a
29 surviving parent, only one surviving sibling shall be issued a
30 set of registration plates, except for those surviving parents
31 who, as recipients of the Gold Star, have legally separated or
32 divorced, in which case each surviving parent shall be allowed

1 under this Section shall be for first division vehicles and
2 second division vehicles of 8,000 pounds or less. An applicant
3 shall be charged a $15 fee for the original issuance in

5 deposited into the Road Fund to help defray the administrative
6 processing costs.
7     Any license plate manufactured on or after January 1, 2005
8 and issued under this Section must:
9         (1) be manufactured in the United States; and
10         (2) if a suitable manufacturing facility is available
11     in this State, be manufactured in this State.
