SYNOPSIS AS INTRODUCED:
 
815 ILCS 601/10

    Amends the Automatic Contract Renewal Act. Changes language to provide that any person, firm, partnership, association, or corporation that sells or offers to sell any products or services for a specified period of time pursuant to a written contract that contains a provision for automatic renewal must provide the recipient of the products or services with clear and conspicuous written notice that the recipient may cancel the contract and the procedures for cancellation. Provides that notice must be given at least 30 days prior to the end of the specified period of time. Provides that if the contract is less than 30 days in duration, the contract must contain a clear and conspicuous written notice of the right to cancel the contract and the procedures for cancellation. Provides that if notice is not given to the recipient any products or services will be deemed an unconditional gift.

1     AN ACT concerning business transactions.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Automatic Contract Renewal Act is amended by
5 changing Section 10 as follows:
 
6     (815 ILCS 601/10)
7     Sec. 10. Automatic renewal; requirements. Any person,
8 firm, partnership, association, or corporation that sells or
9 offers to sell any products or services for a specified period
10 of time pursuant to a written contract that contains an
11 automatic renewal provision effective at the end of the
12 specified period of time must provide the recipient of the
13 products or services, at least 30 days prior to the end of the
14 specified period of time, with a clear and conspicuous written
15 notice that the recipient may cancel the contract. Notice must
16 include the procedure for cancellation. If the contract is less
17 than 30 days in duration, the contract must contain a clear and
18 conspicuous written notice of the right to cancel the contract
19 and the procedure for cancellation. If notice is not provided
20 to the recipient in accordance with the provisions of this
21 Section, any products or services furnished to the recipient
22 after the end of the period of time specified in the contract
23 shall be deemed an unconditional gift. If a contract is subject
24 to automatic renewal, the clause providing for automatic
25 renewal must appear in the contract in a clear and conspicuous
26 manner.
