AMENDMENT TO HOUSE BILL 4475

2     AMENDMENT NO. ______. Amend House Bill 4475 by replacing
3 lines 4 through 30 on page 1 and lines 1 through 25 on page 2
4 with the following:
 
5     "Section 1. Short title. This Act may be cited as the
6 Excellence in Alzheimer's Disease Center Treatment Act.
 
7     Section 5. Purpose. This Act is intended to maintain and
8 enhance excellence in Alzheimer's disease treatment in
9 Illinois in order to develop strategies to treat and prevent
10 Alzheimer's disease in Illinois and across the United States,
11 ensure that all Illinois citizens obtain the highest quality
12 clinical care for Alzheimer's disease and other dementias,
13 reduce the enormous societal cost of this disease, ensure that
14 Illinois is a national center for Alzheimer's disease research,
15 and maintain and enhance Illinois' ability to attract
16 additional federal and private research funding.
 
17     Section 15. Definitions. As used in this Act:
18     "Academic medical center hospital" means a hospital
19 located in Illinois that is either (i) under common ownership
20 with the college of medicine of a college or university or (ii)
21 a free-standing hospital in which the majority of the clinical
22 chiefs of service are department chairmen in an affiliated
23 medical school.

1     "Qualified Academic Medical Center Hospital - Pre 1996
2 Designation" means any academic medical center hospital that
3 was designated by the National Institutes of Health and
4 National Institutes on Aging as an Alzheimer's Disease Core (or
5 Research) Center prior to calendar year 1996.
6     "Qualified Academic Medical Center Hospital - Post 1996
7 Designation" means any academic medical center hospital that
8 was designated by the National Institutes of Health and
9 National Institutes on Aging as an Alzheimer's Disease Core (or
10 Research) Center in or after calendar year 1996 through
11 calendar year 2003.
 
12     Section 20. Funds created.
13     (a) The Alzheimer's Disease Center Clinical Fund is created
14 as a special fund in the State treasury, to which the General
15 Assembly shall from time to time appropriate funds and from
16 which the Comptroller shall pay amounts as authorized by law.
17 The amount appropriated to this Fund for any State fiscal year
18 after fiscal year 2004 shall not be less than 72.7% of the
19 total amount that was appropriated to the Department of Public
20 Aid for Alzheimer's Disease care in fiscal year 2004.
21     (b) The Alzheimer's Disease Center Expanded Clinical Fund
22 is created as a special fund in the State treasury, to which
23 the General Assembly shall from time to time appropriate funds
24 and from which the Comptroller shall pay amounts as authorized
25 by law. The amount appropriated to this Fund for any State
26 fiscal year after fiscal year 2004 shall not be less than 27.3%
27 of the total amount that was appropriated to the Department of
28 Public Aid for Alzheimer's Disease care in fiscal year 2004.
29     (c) The Alzheimer's Disease Center Independent Clinical
30 Fund is created as a special fund in the State treasury, to
31 which the General Assembly shall from time to time appropriate
32 funds and from which the Comptroller shall pay amounts as
33 authorized by law.

1     Section 25. The Alzheimer's Disease Center Clinical Fund.
2     (a) Each institution defined as a Qualified Academic
3 Medical Center Hospital - Pre 1996 Designation shall be
4 eligible for payments from the Alzheimer's Disease Center
5 Clinical Fund.
6     (b) Appropriations allocated to this Fund shall be divided
7 equally among the qualifying hospitals.
8     (c) One quarter of the amount payable to each qualified
9 institution shall be paid on the fifteenth working day after
10 July 1, October 1, January 1, and March 1.
 
11     Section 30. The Alzheimer's Disease Center Expanded
12 Clinical Fund.
13     (a) Each institution defined as a Qualified Academic
14 Medical Center Hospital - Pre 1996 Designation or as a
15 Qualified Academic Medical Center Hospital - Post 1996
16 Designation shall be eligible for payments from the Alzheimer's
17 Disease Center Expanded Clinical Fund.
18     (b) Appropriations allocated to this Fund shall be divided
19 equally among the qualifying hospitals. A Qualified Academic
20 Medical Center Hospital that qualifies under both the Pre and
21 Post Designation description is counted as one hospital for
22 payment purposes under this Section.
23     (c) One quarter of the amount payable to each qualified
24 institution shall be paid on the fifteenth working day after
25 July 1, October 1, January 1, and March 1.
 
26     Section 35. The Alzheimer's Disease Center Independent
27 Clinical Fund.
28     (a) Each institution defined as a Qualified Academic
29 Medical Center Hospital - Pre 1996 Designation or as a
30 Qualified Academic Medical Center Hospital - Post 1996
31 Designation shall be eligible for payments from the Alzheimer's

1 Disease Center Expanded Clinical Fund.
2     (b) Appropriations allocated to this Fund shall be
3 allocated to specific Qualified Academic Medical Center
4 Hospitals (either Pre 1996 or Post 1996 Designation) for
5 specific and unique clinical/research projects. The payment
6 amounts to each qualifying institution shall be determined by
7 the General Assembly
8     (c) One quarter of the amount payable to each qualified
9 institution shall be paid on the fifteenth working day after
10 July 1, October 1, January 1, and March 1.
 
11     Section 40. Use of funds. Funds shall be used for the
12 following 6 general purposes:
13         (1) Clinical Care. Funds disbursed to each Qualified
14 Academic Medical Center Hospital (either Pre 1996 or Post
15 1996 Designation) must be used to support clinical care for
16 affected persons and their families. In addition to
17 providing clinical care, the Qualified Academic Medical
18 Center Hospitals (either Pre 1996 or Post 1996 Designation)
19 shall serve as models of multi-disciplinary diagnostic and
20 treatment facilities for Alzheimer's disease and other
21 dementias. The clinical activities may include, but are not
22 limited, to (A) supporting multi-disciplinary clinical
23 staff (for example, nurses and social workers) for
24 counseling, family planning, legal advice, and advanced
25 directives, and (B) community screening and referral
26 programs.
27         (2) Underserved Community Outreach. Funds disbursed to
28 each Qualified Academic Medical Center Hospital (either
29 Pre 1996 or Post 1996 Designation) must be used to support
30 some type of outreach program in underserved communities
31 (for example, racial or ethnic minorities, low income, or
32 rural whites). The exact nature of the programs should take
33 advantage of the expertise and location of each Qualified

1 Academic Medical Center Hospital (either Pre 1996 or Post
2 1996 Designation).
3         (3) Research. Funds disbursed to each Qualified
4 Academic Medical Center Hospital (either Pre 1996 or Post
5 1996 Designation) must be used to support research on aging
6 and dementia. The research activities should be aimed
7 primarily at the treatment and prevention of disease. The
8 research activities may be clinical or experimental
9 studies on human subjects or they may be basic science
10 laboratory projects on animals or cell cultures. The
11 research activities may include, but are not limited, to
12 (A) defined projects, (B) obtaining pilot data to support
13 external funding, (C) matching funds for externally funded
14 studies, (D) research infrastructure support for clinical
15 trials, epidemiologic studies, experimental studies, or
16 wet laboratory studies.
17         (4) Education. Funds disbursed to each Qualified
18 Academic Medical Center Hospital (either Pre 1996 or Post
19 1996 Designation) must be used to support education
20 regarding aging and dementia. These centers must address
21 the problems posed by aging and dementia. The educational
22 activities may include, but are not limited, to (A)
23 programs for physicians, nurses, and social workers (for
24 example, primary provider program), (B) programs for
25 administrators, activity directors, nurses and nurses
26 assistants in nursing homes, retirement facilities, senior
27 housing, and social service agencies (for example, ASSIST
28 Networks), (C) training physicians and allied health
29 professional of the future (for example, fellowships,
30 residency, medical students, nursing students, and social
31 work students), (D) newsletters, Websites, manuals, and
32 other written and electronic educational materials, and
33 (E) conferences and lectures for professionals and
34 non-professionals.

1         (5) Brain Bank. Funds should be used by each Qualified
2 Academic Medical Center Hospital (either Pre 1996 or Post
3 1996 Designation) to support a brain banking program. The
4 exact nature of the programs should take advantage of the
5 expertise, interests, and needs of investigators at each
6 Qualified Academic Medical Center Hospital (either Pre
7 1996 or Post 1996 Designation). The program could be for
8 research purposes, post-mortem diagnostic services, or
9 some combination.
10         (6) Administration. Funds, as needed, may be used to
11 cover administrative costs, facility costs (for example,
12 rent), and other costs commonly incurred by clinical,
13 research, and educational programs according to the local
14 rules governing each Qualified Academic Medical Center
15 Hospital (either Pre 1996 or Post 1996 Designation).
 
16     Section 45. Payment of funds. The Comptroller shall
17 disburse all funds appropriated to the Alzheimer's Disease
18 Center Clinical Fund, the Alzheimer's Disease Center Expanded
19 Clinical Fund, and the Alzheimer's Disease Center Independent
20 Clinical Fund to the appropriate Qualified Academic Medical
21 Center Hospitals (either Pre 1996 or Post 1996 Designation) as
22 the funds are appropriated by the General Assembly and come due
23 under this Act. The payment of these funds shall be made
24 directly to the Qualified Academic Medical Center Hospital
25 (either Pre 1996 or Post 1996 Designation) due the funds.
 
26     Section 50. Reporting requirements. Qualified Academic
27 Medical Center Hospitals (either Pre 1996 or Post 1996
28 Designation) receiving payments from the Alzheimer's Disease
29 Center Clinical Fund, the Alzheimer's Disease Center Expanded
30 Clinical Fund, or the Alzheimer's Disease Center Independent
31 Clinical Fund shall submit reports to the Department of Public
32 Health and the ADA Advisory Committee. The ADA Advisory

1 Committee, in consultation with the Qualified Academic Medical
2 Center Hospitals (either Pre 1996 or Post 1996 Designation),
3 shall determine the report contents and the date when it shall
4 be submitted.
 
5     Section 55. Payment methodology. The Department of Public
6 Aid, in consultation with the Alzheimer's Disease Advisory
7 Committee and the Department of Public Health, shall develop a
8 reimbursement methodology consistent with this Act for
9 distribution of all moneys from the funds in a manner that
10 would help ensure these funds could be matchable under Title
11 XIX of the Social Security Act. The Department of Public Aid
12 shall promulgate rules necessary to make payments to the
13 Qualifying Academic Medical Center Hospitals (either Pre 1996
14 or Post 1996 Designation).
 
15     Section 60. Reimbursements of payments by the State.
16 Nothing in this Act may be used to reduce reimbursements or
17 payments by the State to a Qualifying Academic Medical Center
18 Hospital (either Pre 1996 or Post 1996 Designation) under any
19 other Act.
 
20     Section 65. Contravention of law. Funds received under this
21 Act shall not be used in contravention of any law of this
22 State.
 
23     Section 90. The State Finance Act is amended by adding
24 Sections 5.625, 5.626, and 5.627 as follows:

9     "Section 99. Effective date. This Act takes effect upon
10 becoming law.".
