AMENDMENT TO HOUSE BILL 5058

2     AMENDMENT NO. ______. Amend House Bill 5058, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Illinois Act on the Aging is amended by
6 adding Section 8.08 as follows:
 
7     (20 ILCS 105/8.08 new)
8     Sec. 8.08. Comprehensive Older Adults Services and Care
9 Planning Committee.
10     (a) The purpose of this Section is to promote cooperation
11 and consultation on the incremental redesign of Illinois'
12 long-term care system to provide services to older adults among
13 the Directors of Aging, Public Aid, and Public Health;
14 providers of care and services; and older adults and those who
15 advocate on their behalf. It is envisioned that the long-term
16 goal of this redesign will be the development, availability,
17 and accessibility of a comprehensive, affordable, and
18 sustainable long-term care system in Illinois. It is envisioned
19 that the redesign will encompass all aspects of the delivery of
20 services and care to older adults whether the services and care
21 are provided in the home, community, or a residential facility.
22     (b) The Comprehensive Older Adults Services and Care
23 Planning Committee is hereby created to advise the Directors of
24 Aging, Public Aid, and Public Health on all matters related to

1 the redesign of the long-term care system and the delivery of
2 services and care to older adults in general.
3     (c) The Committee shall be comprised of the following:
4         (1) The Director of Aging or his or her designee, who
5 shall serve as chair and shall be an ex officio and
6 nonvoting member.
7         (2) The Director of Public Aid and the Director of
8 Public Health or their designees, who shall serve as
9 vice-chairs and shall be ex officio and nonvoting members.
10         (3) One representative each of the Department of Public
11 Aid, the Department of Public Health, the Department of
12 Veterans Affairs, the Department of Human Services, the
13 Department of Insurance, the Department of Commerce and
14 Economic Affairs, the Department on Aging, the Office of
15 the State Ombudsman, and the Illinois Housing Finance
16 Authority, who shall be selected by their Director and
17 shall be ex officio and nonvoting members.
18         (4) Thirteen members appointed by the Director of Aging
19 in collaboration with the Directors of Public Health and
20 Public Aid as follows:
21             (A) one member selected from recommendations
22 submitted by organizations representing providers
23 funded under the Community Care Program pursuant to
24 this Act;
25             (B) one member selected from recommendations
26 submitted by organizations representing providers
27 funded under the federal Older Americans Act;
28             (C) one member selected from recommendations
29 submitted by organizations representing providers
30 funded by Title XVIII of the Social Security Act
31 (Medicare);
32             (D) one member selected from recommendations
33 submitted by organizations representing home and
34 community care providers funded only with general

1 revenue funds or other levied funds;
2             (E) one member selected from recommendations
3 submitted by organizations representing facilities
4 licensed under the Nursing Home Care Act;
5             (F) one member selected from recommendations
6 submitted by organizations representing establishments
7 licensed under the Assisted Living and Shared Housing
8 Act;
9             (G) one member selected from recommendations
10 submitted by organizations representing facilities
11 certified under the Supportive Living Facilities
12 Program (Section 5-5.01a of the Illinois Public Aid
13 Code);
14             (H) one member selected from recommendations
15 submitted by organizations representing community
16 based residential facilities;
17             (I) two members selected from recommendations
18 submitted by membership based statewide senior
19 advocacy groups, who do not receive state funds;
20             (J) one member with special expertise in
21 gerontology research or in health law; and
22             (K) two members who are Illinois residents over age
23 65.
24     (d) In selecting voting members of the Committee, the
25 Directors shall attempt to ensure that the Committee includes
26 representation from urban and rural areas and different
27 geographical areas. No more than one voting member shall be
28 selected from the recommendations of any single organization
29 and no more than one voting member shall be employed by the
30 same agency, organization, association, or employer.
31     (e) Voting members of the Committee shall serve for a term
32 of 3 years or until a replacement is named. All members shall
33 be appointed no later than January 1, 2005. Of the initial
34 appointees, 4 members shall serve a term of one year; 4 shall

1 serve for a term of 2 years; and 5 shall serve for a term of 3
2 years. A member's term does not expire until a successor is
3 appointed by the Director of Aging. Any member appointed to
4 fill a vacancy occurring prior to the expiration of the term
5 for which his or her predecessor was appointed shall be
6 appointed for the remainder of that term. The Committee shall
7 meet at least quarterly and more frequently at the call of the
8 Chair. A simple majority of those appointed shall constitute a
9 quorum. The affirmative vote of a majority of those present and
10 voting shall be necessary for committee action. Members of the
11 Committee shall receive no compensation for their services. (f)
12 The Director on Aging, in collaboration with the Directors of
13 Public Health and Public Aid, may form subcommittees comprised
14 of individuals recommended by advocacy groups, trade
15 associations, and other stakeholders. Subcommittee membership
16 is not limited to Committee members. Members of any
17 subcommittee formed under this Act shall receive no
18 compensation for their services.
19     (f) The Departments of Aging, Public Health, and Public Aid
20 shall cooperate with, seek the advice of, and collaborate with
21 the Committee on all matters relative to this Section. The
22 Department on Aging and the Departments of Public Health and
23 Public Aid shall enter into written inter-agency agreements to
24 implement this Section. The Department on Aging shall be the
25 lead agency, but the Departments of Public Health and Public
26 Aid shall assist in providing resources to support the work of
27 this Committee.
28     (g) The Departments shall issue a joint report to the
29 General Assembly on January 1 of each year on their progress
30 relative to this Section and the recommendations of the
31 Committee.
 
32     Section 99. Effective date. This Act takes effect upon
33 becoming law.".
