 1                    AMENDMENT TO SENATE BILL 222

 2        AMENDMENT NO.     .  Amend Senate Bill  222  by  deleting
 3    lines  6  through 30 on page 1 and lines 1 through 28 on page
 4    2; and

 5    by replacing lines 13 through 33  on  page  38  and  lines  1
 6    through 23 on page 39 with the following:

 7        "(415 ILCS 5/28.6 new)
 8        Sec.   28.6.   Rulemaking   to  update  incorporation  by
 9    reference.
10        (a)  Any person may file a proposal  with  the  Board  to
11    update  an  incorporation  by  reference  included in a Board
12    rule.  The Board or the Agency may also make such a  proposal
13    on its own initiative.
14        (b)  A rulemaking to update an incorporation by reference
15    under this Section shall be for the sole purpose of replacing
16    a  reference  to  an  older or obsolete version of a document
17    with a reference to the current version of that  document  or
18    its successor document.
19        (c)  A rulemaking to update an incorporation by reference
20    under  this  Section shall comply with Sections 5-40 and 5-75
21    of the Illinois Administrative Procedure Act. Sections 27 and
22    28 of this Act do not apply to rulemaking under this Section.

 1        (d)  If an objection to the proposed amendment  is  filed
 2    during  the public comment period required under Section 5-40
 3    of  the  Illinois  Administrative  Procedure  Act,  then  the
 4    proposed amendment shall not  be  adopted  pursuant  to  this
 5    Section.  Nothing in this Section precludes the adoption of a
 6    change  to an incorporation by reference through other lawful
 7    rulemaking procedures.
 8        (e)  The Board may adopt procedural  rules  to  implement
 9    this Section.".
