 1                    AMENDMENT TO SENATE BILL 319

 2        AMENDMENT NO.     .  Amend Senate Bill 319,  AS  AMENDED,
 3    with  reference  to  page and line numbers of House Amendment
 4    No. 1, on page 3, line 11, after  the  period,  by  inserting
 5    "For  the  purposes  of  this  paragraph,  "person"  does not
 6    include a resident."; and

 7    on page 3, line 29, after the period, by  inserting  "Nothing
 8    in  this  Section  requires  an  investigation  to include an
 9    on-site visit."; and

10    on page 4, line 15, after  the  period,  by  inserting  "Upon
11    receipt  of  a  complaint  alleging  abuse  or  neglect  of a
12    resident,   the   Department   shall   conduct   an   initial
13    investigation and make an initial determination  whether  the
14    report  is  a  good  faith  indication  of  alleged  abuse or
15    neglect. If the Department determines the report  is  a  good
16    faith  indication  of  alleged  abuse  or  neglect,  a formal
17    investigation shall commence."; and

18    on page 4, line 16,  by  replacing  "complaints  of  alleging
19    abuse  or  neglect" with "reports of alleged abuse or neglect
20    made in good faith complaints alleging abuse or neglect"; and

21    on page 4, by replacing lines 24 and 25 with the following:
22    "investigated  within  30  days  after  the  receipt  of  the

 1    complaint.  The Department"; and

 2    on page 5, line  6,  after  the  period,  by  inserting  "The
 3    Department may extend the period in which such determinations
 4    must be made in individual cases for additional periods of up
 5    to 30 days each for good cause shown. The Department shall by
 6    rule establish what shall constitute good cause."; and

 7    on  page 12, line 33, after the period, by inserting "For the
 8    purposes of this subsection, "person" does  not  include  the
 9    subject of the report.".
