1 AMENDMENT TO SENATE BILL 1049
2 AMENDMENT NO. . Amend Senate Bill 1049, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Park District Code is amended by adding
6 Section 5-2e as follows:
7 (70 ILCS 1205/5-2e new)
8 Sec. 5-2e. Park district property within municipality
9 with recreation board or within a supervised recreation
10 system; disconnection. Any territory of a park district that
11 is located within a municipality that has established a
12 recreation board under Section 11-95-3 of the Illinois
13 Municipal Code, or a supervised recreation system that levies
14 taxes for the establishment, conduct, and maintenance
15 thereof, may be disconnected from the park district if the
16 affected land owners are levied a tax by both governmental
17 bodies for recreational services. A petition must be signed
18 by 10% of the owners of record of the land within the
19 territory proposed to be disconnected. The petition must
20 allege the facts in support of the disconnection. The
21 petition shall be filed with the municipal clerk. The
22 corporate authorities of the municipality shall adopt an

1 ordinance that provides that the question of disconnection be
2 submitted to the electors of the territory proposed to be
3 disconnected.
4 Upon adoption of the ordinance, the municipal clerk shall
5 certify the ordinance and the question to the proper election
6 authorities, who shall submit the question to the electors of
7 the territory at an election in accordance with the general
8 election law.
9 The question cast at this election shall be in
10 substantially the following form:
11 Shall (describe territory) be disconnected from
12 (name of park district) and the levy of any taxes by the
13 Park District be discontinued?
14 The votes shall be recorded as "Yes" or "No".
15 If a majority of the votes cast upon the question are in
16 favor of disconnection, the territory shall be disconnected
17 from the park district, the park district shall cease to
18 exercise its power or authority over the disconnected
19 territory, and the levy of any taxes (except for taxes levied
20 pursuant to Section 3-7 for contracted indebtedness) by the
21 park district shall be discontinued.
22 Section 99. Effective date. This Act takes effect upon
23 becoming law.".
