1 AMENDMENT TO SENATE BILL 1108
2 AMENDMENT NO. . Amend Senate Bill 1108, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Illinois Vehicle Code is amended by
6 changing Section 18a-302 as follows:
7 (625 ILCS 5/18a-302) (from Ch. 95 1/2, par. 18a-302)
8 Sec. 18a-302. Owner or other person in lawful possession
9 or control of private property - Right to employ relocation
10 service.
11 (a) It shall be unlawful for an owner or other person in
12 lawful possession or control of private property to remove or
13 employ a commercial relocator to remove an unauthorized
14 vehicle from such property unless written notice is provided
15 to the effect that such vehicles will be removed, including
16 the name, address and telephone number of the appropriate
17 commercial vehicle relocator, if any.
18 (b) Except as provided in subsection (c), such notice
19 shall consist of a sign, posted in a conspicuous place in the
20 affected area, of a size at least 24 inches in height by 36
21 inches in width. Such sign shall be at least 4 feet from the
22 ground but less than 8 feet from the ground and shall be

1 either illuminated or painted with reflective paint, or both.
2 Such sign shall state the amount of towing charges to which
3 the person parking may be subject. This provision shall not
4 be construed as prohibiting any unit of local government from
5 imposing additional or greater notice requirements.
6 (c) In private lots in a municipality with a population
7 of 1,000,000 or more, the notice shall consist of a sign,
8 posted in a conspicuous place in the affected area, of a size
9 at least 48 inches in height by 48 inches in width. The sign
10 shall be at least 4 feet from the ground but less than 9 feet
11 from the ground and shall be either illuminated or brightly
12 painted with reflective paint, or both. The sign shall state
13 the amount of towing charges to which the person parking may
14 be subject. This provision does not prohibit any unit of
15 local government from imposing additional or greater notice
16 requirements.
17 (d) No express notice shall be required under this
18 Section upon residential property which, paying due regard to
19 the circumstances and the surrounding area, is clearly
20 reserved or intended exclusively for the use or occupation of
21 residents or their vehicles.

23 Section 99. Effective date. This Act takes effect
