 1                    AMENDMENT TO SENATE BILL 1109

 2        AMENDMENT NO.     .  Amend Senate Bill 1109, AS  AMENDED,
 3    by  replacing  everything  after the enacting clause with the
 4    following:

 5        "Section 5.  The Illinois Public Aid Code is  amended  by
 6    changing Section 5-4.1 as follows:

 7        (305 ILCS 5/5-4.1) (from Ch. 23, par. 5-4.1)
 8        Sec.  5-4.1.   Co-payments.   The  Department may by rule
 9    provide that recipients under any Article of this Code  shall
10    pay  a fee as a co-payment for services.  Co-payments may not
11    exceed $2 $3 for brand name  drugs,  $1  for  other  pharmacy
12    services  other than for generic drugs, and $2 for physicians
13    services, dental services,  optical  services  and  supplies,
14    chiropractic  services, podiatry services, and encounter rate
15    clinic services. There shall be  no  co-payment  for  generic
16    drugs.  Co-payments may not exceed $3 for hospital outpatient
17    and clinic services.  Provided, however, that any  such  rule
18    must  provide  that  no  co-payment requirement can exist for
19    renal dialysis, radiation therapy,  cancer  chemotherapy,  or
20    insulin,  and  other products necessary on a recurring basis,
21    the absence of which would  be  life  threatening,  or  where
22    co-payment   expenditures   for   required   services  and/or

 1    medications for chronic diseases that the Illinois Department
 2    shall by rule designate shall cause  an  extensive  financial
 3    burden  on  the  recipient,  and provided no co-payment shall
 4    exist for emergency room encounters  which  are  for  medical
 5    emergencies.

 7        Section  99.  Effective date.  This Act takes effect upon
 8    becoming law.".
