 1                    AMENDMENT TO SENATE BILL 1578

 2        AMENDMENT NO.     .  Amend Senate Bill 1578 as follows:

 3    by replacing everything after the enacting  clause  with  the
 4    following:

 5        "Section  5.  The  Illinois  Controlled Substances Act is
 6    amended by adding Section 411.3 as follows:

 7        (720 ILCS 570/411.3 new)
 8        Sec. 411.3. Methamphetamine restitution. If a  person  is
 9    convicted  of  a  violation  of  clause  (6.5)  or  (6.6)  of
10    subsection   (a),   subsection  (c-5),  clause  (d)(iii),  or
11    subsection (d-5) of Section 401, and the offense involves the
12    manufacture  of  methamphetamine  or  the  possession  of   a
13    methamphetamine   manufacturing   chemical   as   defined  in
14    paragraph (z-1)  of  Section  102,  and  the  manufacture  of
15    methamphetamine  or possession of one or more methamphetamine
16    manufacturing chemicals requires an emergency  response,  the
17    person convicted shall be required to make restitution to all
18    public  entities involved in the emergency response, to cover
19    the reasonable cost of their participation in  the  emergency
20    response. The convicted person shall make this restitution in
21    addition  to  any  other  fine or penalty required by law. In

 1    this Section,  "emergency  response"  includes,  but  is  not
 2    limited  to,  collecting  evidence,  securing  the  site, and
 3    cleaning up the site where the relevant offense  or  offenses
 4    took place, whether these actions are performed by the public
 5    entities  themselves  or  by  private contractors paid by the
 6    public entities.".
