1 AN ACT in relation to public health.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Vital Records Act is amended by adding
5 Section 20.5 as follows:
6 (410 ILCS 535/20.5 new)
7 Sec. 20.5. Certificate of stillbirth.
8 (a) The State Registrar shall prescribe and distribute a
9 form for a certificate of stillbirth. The certificate shall
10 be in the same format as a certificate of live birth prepared
11 under Section 12 and shall be filed in the same manner as a
12 certificate of live birth.
13 (b) After each fetal death that occurs in this State
14 after a gestation period of at least 26 completed weeks, the
15 person who files a fetal death certificate in connection with
16 that death as required under Section 20 shall, only upon
17 request by the woman who delivered the stillborn fetus, also
18 prepare a certificate of stillbirth. The person shall
19 prepare the certificate on the form prescribed and furnished
20 by the State Registrar and in accordance with the rules
21 adopted by the State Registrar.
22 (c) If the stillborn's parent or parents do not wish to
23 provide a name for the stillborn, the person who prepares the
24 certificate of stillbirth shall leave blank any references to
25 the stillborn's name.
26 (d) When a stillbirth occurs in this State and the
27 stillbirth has not been registered within one year after the
28 delivery, a certificate marked "delayed" may be filed and
29 registered in accordance with regulations adopted by the
30 State Registrar. The certificate must show on its face the
31 date of registration.

1 (e) In the case of a fetal death that occurred in this
2 State after a gestation period of at least 26 completed weeks
3 and before the effective date of this amendatory Act of the
4 93rd General Assembly, a parent of the stillborn child may
5 request that the person who filed a fetal death certificate
6 in connection with that death as required under Section 20
7 shall also prepare a certificate of stillbirth with respect
8 to the fetus. If a parent of a stillborn makes such a
9 request under this subsection (e), the person who filed a
10 fetal death certificate shall prepare the certificate of
11 stillbirth and file it with the designated registrar within
12 30 days after the request by the parent.
13 Section 99. Effective date. This Act takes effect upon
14 becoming law.
