 1                    AMENDMENT TO SENATE BILL 1921

 2        AMENDMENT NO.     .  Amend Senate Bill 1921 by  replacing
 3    the title with the  following:

 4        "AN ACT concerning livestock."; and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 5.  The Illinois Horse Meat Act  is  amended  by
 8    adding Section 1.5 and changing Section 14 as follows:

 9        (225 ILCS 635/1.5 new)
10        Sec. 1.5.  Meat for human consumption.
11        (a)  Notwithstanding  any  other  provision of law, it is
12    unlawful for any person to slaughter a horse if  that  person
13    knows  or should know that any of the horse meat will be used
14    for human consumption.
15        (b)  Notwithstanding any other provision of  law,  it  is
16    unlawful  for any person to possess, to import into or export
17    from this State, or to sell, buy, give away, hold, or  accept
18    any  horse with the intent of slaughtering that horse if that
19    person knows or should know that any of the horse  meat  will
20    be used for human consumption.
21        (c)  Notwithstanding  any  other  provision of law, it is

 1    unlawful for any person to possess, to import into or  export
 2    from  this State, or to sell, buy, give away, hold, or accept
 3    any horse meat if that person knows or should know  that  the
 4    horse meat will be used for human consumption.

 6        Sec.  14.  Horse  meat  labeled  as  such in hermetically
 7    sealed  containers  and   registered   under   the   Illinois
 8    Commercial  Feed  Act of 1961 is excluded from the provisions
 9    of this Act.  Horse  meat  prepared  in  federally  inspected
10    plants  located in the State of Illinois, for sale outside of
11    the State of  Illinois,  is  excluded  from  the  provisions,
12    except for Section 1.5, of this Act.

14        Section 10.  The Animals Intended for Food Act is amended
15    by changing Section 2.1 as follows:

16        (410 ILCS 605/2.1) (from Ch. 8, par. 107.1)
17        Sec. 2.1.
18        When  in  the  interest  of the general public and in the
19    opinion  of  the  Department  of  Agriculture  it  is  deemed
20    advisable, the Department  has  authority  to  quarantine  or
21    restrict  any  and all animals intended for human consumption
22    that contain poisonous or deleterious  substances  which  may
23    render  meat  or meat products or poultry or poultry products
24    from such animals or poultry injurious to health;  except  in
25    case the quantity of such substances in such animals does not
26    ordinarily render meat or meat products or poultry or poultry
27    products from such animals injurious to health.
28        The   Department  or  its  duly  authorized  agent  shall
29    investigate or cause to be investigated all  cases  where  it
30    has  reason  to  believe  that  animals  intended  for  human
31    consumption   are   contaminated   with   any   poisonous  or

 1    deleterious substance which may render them unfit  for  human
 2    consumption.
 3        The Department or its duly designated agent in performing
 4    the  duties vested in it under this Act is empowered to enter
 5    any premises, barns, stables, sheds, or other places for  the
 6    purposes of administering this Act.
 7        The  Department may allow the sale or transfer of animals
 8    under quarantine or restriction subject to  reasonable  rules
 9    and regulations as may be prescribed.
10        For  the  purposes  of  this Act, the term "Animal" means
11    cattle, calves, sheep, swine, horses, mules or other equidae,
12    goats, poultry and any other animal which can be  or  may  be
13    used  in  and for meat or poultry or their products for human
14    consumption.

16        Section 15.  The Humane Slaughter  of  Livestock  Act  is
17    amended by changing Section 2 as follows:

18        (510 ILCS 75/2) (from Ch. 8, par. 229.52)
19        Sec. 2. As used in this Act:
20        (1)  "Director"  means  the Director of the Department of
21    Agriculture of the State of Illinois.
22        (2)  "Person"   means   any   individual,    partnership,
23    corporation,  or association doing business in this State, in
24    whole or in part.
25        (3)  "Slaughterer" means any person regularly engaged  in
26    the commercial slaughtering of livestock.
27        (4)  "Livestock"  means  cattle,  calves,  sheep,  swine,
28    horses,  mules,  goats, and any other animal which can or may
29    be used in and for the preparation of meat or  meat  products
30    for  consumption  by  human  beings  or animals. "Livestock",
31    however, does not include horses, mules, or other equidae  to
32    be  used  in and for the preparation of meat or meat products

 1    for consumption by human beings, which  is  prohibited  under
 2    Section 1.5 of the Illinois Horse Meat Act.
 3        (5)  "Packer" means any person engaged in the business of
 4    slaughtering  or manufacturing or otherwise preparing meat or
 5    meat products for sale, either by such person or  others;  or
 6    of  manufacturing or preparing livestock products for sale by
 7    such person or others.
 8        (6)  "Humane method" means either (a)  a  method  whereby
 9    the  animal  is  rendered insensible to pain by gunshot or by
10    mechanical, electrical, chemical or other means that is rapid
11    and effective, before being shackled, hoisted,  thrown,  cast
12    or   cut;   or   (b)  a  method  in  accordance  with  ritual
13    requirements of the Jewish faith or any other religious faith
14    whereby the animal suffers loss of consciousness by anemia of
15    the  brain  caused  by  the  simultaneous  and  instantaneous
16    severance of the carotid arteries with a sharp instrument.

18        Section 99.  Effective date.  This Act takes effect  upon
19    becoming law.".
