AMENDMENT TO SENATE BILL 2530

2     AMENDMENT NO. ______. Amend Senate Bill 2530 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The State Finance Act is amended by changing
5 Section 8h as follows:
 
6     (30 ILCS 105/8h)
7     Sec. 8h. Transfers to General Revenue Fund.
8     (a) Except as provided in subsection (b), notwithstanding
9 Notwithstanding any other State law to the contrary, the
10 Director of the Governor's Office of Management and Budget may
11 from time to time direct the State Treasurer and Comptroller to
12 transfer a specified sum from any fund held by the State
13 Treasurer to the General Revenue Fund in order to help defray
14 the State's operating costs for the fiscal year. The total
15 transfer under this Section from any fund in any fiscal year
16 shall not exceed the lesser of 8% of the revenues to be
17 deposited into the fund during that year or 25% of the
18 beginning balance in the fund. No transfer may be made from a
19 fund under this Section that would have the effect of reducing
20 the available balance in the fund to an amount less than the
21 amount remaining unexpended and unreserved from the total
22 appropriation from that fund for that fiscal year. This Section
23 does not apply to any funds that are restricted by federal law
24 to a specific use or to any funds in the Motor Fuel Tax Fund or

1 the Hospital Provider Fund. Notwithstanding any other
2 provision of this Section, the total transfer under this
3 Section from the Road Fund or the State Construction Account
4 Fund shall not exceed 5% of the revenues to be deposited into
5 the fund during that year.
6     In determining the available balance in a fund, the
7 Director of the Governor's Office of Management and Budget may
8 include receipts, transfers into the fund, and other resources
9 anticipated to be available in the fund in that fiscal year.
10     The State Treasurer and Comptroller shall transfer the
11 amounts designated under this Section as soon as may be
12 practicable after receiving the direction to transfer from the
13 Director of the Governor's Office of Management and Budget.
14     (b) This Section does not apply to any fund established
15 under the Community Senior Services and Resources Act.

17     Section 10. The Community Senior Services and Resources Act
18 is amended by adding Section 32 as follows:
 
19     (320 ILCS 60/32 new)
20     Sec. 32. Bequests and gifts; awareness campaign.
21     (a) The Director may accept monetary grants, gifts, and
22 bequests for deposit into the Community Senior Services and
23 Resources Fund.
24     (b) The Director may accept monetary grants, gifts, and
25 bequests for the benefit of a specified center or distinct area
26 of the State. Each such grant, gift, or bequest shall be kept
27 in a distinct fund. The Department may make grants from these
28 funds for the purposes established for the Community Senior
29 Services and Resources Fund and in accordance with the terms
30 and conditions of the grant, gift, or bequest. These funds are
31 exempt from Section 8h of the State Finance Act.
32     (c) The Department, in conjunction with the Community

1 Senior Services and Resource Center Advisory Committee, shall
2 design an awareness campaign that can be implemented by senior
3 services and resource centers at their individual expense.
 
4     Section 99. Effective date. This Act takes effect upon
5 becoming law.".
