SYNOPSIS AS INTRODUCED:
 
815 ILCS 505/2QQ new

    Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a person or entity may not print an individual's social security number on an insurance card that is used to establish the eligibility of an individual or his or her dependents to receive health, dental, optical, or accident insurance benefits, prescription drug benefits, or benefits under a managed care plan or a plan provided by a health maintenance organization, a health services plan corporation, or a similar entity. Provides that existing insurance cards with an individual's social security number must be replaced with insurance cards without the individual's social security number. Provides that a violation constitutes an unlawful practice within the meaning of the Act. Effective January 1, 2005.

1     AN ACT concerning consumer protection.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2QQ as follows:
 
6     (815 ILCS 505/2QQ new)
7     Sec. 2QQ. Insurance cards; social security number.
8     (a) As used in this Section, "insurance card" means a card
9 that a person or entity provides to an individual so that the
10 individual may present the card to establish the eligibility of
11 the individual or his or her dependents to receive health,
12 dental, optical, or accident insurance benefits, prescription
13 drug benefits, or benefits under a managed care plan or a plan
14 provided by a health maintenance organization, a health
15 services plan corporation, or a similar entity.
16     (b) A person or entity may not print an individual's social
17 security number on an insurance card.
18     (c) An insurance card issued to an individual before the
19 effective date of this amendatory Act of the 93rd General
20 Assembly that does not comply with subsection (b) must be
21 replaced by July 1, 2005 with an insurance card that complies
22 with subsection (b) if the individual's eligibility for
23 benefits continues after the effective date of this amendatory
24 Act of the 93rd General Assembly.
25     (d) A violation of this Section constitutes an unlawful
26 practice within the meaning of this Act.
 
27     Section 99. Effective date. This Act takes effect January
28 1, 2005.
